What procedures and materials are needed for marriage registration?
The marriage registration procedure is mainly composed of application, examination and registration.
(1) application
Couples who meet the requirements of marriage registration can apply for marriage registration at the marriage registration office where one party's household registration is located with relevant documents, certification materials and registration photos, and fill in the application registration statement according to the guidance of the staff.
The documents and materials for applying for marriage registration depend on individual circumstances. For example, when applying for marriage registration in China (except Hong Kong, Macao and Taiwan), China citizens need to hold their ID card, household registration book, marriage examination certificate, single certificate and a statement that they are not related to each other (lineal blood relatives and collateral blood relatives within three generations), and divorce certificates are required.
Foreigners (including foreigners residing or temporarily residing in China, China people and foreigners residing in China) applying for marriage in the mainland of China must hold their valid passports, Alien Residence Permit issued by public security organs, and proof of marital status issued by Chinese notary offices certified by the Ministry of Foreign Affairs (or authorized by the Ministry of Foreign Affairs) and China's embassies and consulates in that country.
(2) Review
The marriage registration authority shall verify and examine the parties applying for marriage registration to find out whether the application for marriage is correct. The marriage registration authority will generally ask the parties concerned and ask them to provide corresponding certification materials when necessary.
(3) Registration (Licensing)
The marriage registration authority shall register those who meet the conditions for marriage and issue a marriage certificate; For those who have experienced divorce, the marriage registration office will cancel their divorce certificates; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.
What procedures and documents do you need for divorce?
The divorce registration process is as follows:
(1) application
Both husband and wife who want a divorce should sign a divorce agreement as required, apply to the marriage registration authority with jurisdiction, and provide the following application materials as required:
1, marriage certificate issued by mainland marriage registration authority or Chinese embassy (consulate) abroad;
2. Valid identity documents that meet the requirements for divorce registration, such as identity cards, household registration books, Hong Kong, Macao and Taiwan passes, passports, etc. ;
3. An application for divorce registration filled in at the marriage registration office.
(2) Accept
The marriage registrar shall, in accordance with the relevant provisions, conduct a preliminary examination of the above-mentioned materials submitted by the parties. After the documents and certification materials submitted by the parties are correct after the first trial, they will send a receipt for accepting the divorce registration application to the parties. If it does not meet the application conditions, the marriage registration authority will not accept it, and if necessary, it will issue a Notice of Not Accepting the Application for Divorce Registration according to the requirements of the parties.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, any party who does not want to divorce may present his valid identity certificate and the Receipt for Accepting the Application for Divorce Registration to the marriage registration office that accepts the application for divorce registration, but it is necessary to explain the situation in writing and fill out the Application for Withdrawing the Registration for Divorce in person. After verification, the marriage registration authority shall issue the Confirmation of Divorce Registration to the parties concerned, and file the Application for Divorce Registration, the Application for Divorce Registration and the Confirmation of Divorce Registration (stubs) together. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply for a divorce certificate at the marriage registration office, the application for divorce registration shall be deemed to have been withdrawn.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period expires is a holiday, the date of the cooling-off period expires is the first day after the holiday), both parties shall apply to the marriage registration authority for a divorce certificate with relevant documents and materials specified in the Marriage Registration Code, such as the divorce agreement signed by both parties, marriage certificate, photos and valid documents to prove their identity. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. Do not meet the conditions for divorce registration, do not provide divorce registration procedures. If a party requests to issue a notice not to register for divorce, it shall issue it.
(5) Registration and certification
The marriage registration authority shall, in accordance with the relevant provisions, register the parties concerned and issue a divorce certificate.
