What should I do if the property right of the relocated house expires?

The 70-year property right of the house expires in the following way:

1. The application for renewal submitted to the land management department may be submitted jointly by the house owners. If there is no conflict with the public interest, it shall be approved and the land transfer fee shall be paid, which shall be lower than the price of similar land transfer fees;

2. If the land management department fails to approve the renewal application according to the needs of social public interests, the state will recover the land use right free of charge and compensate the attachments on the land according to the participation value at the time of recovery;

3. The way to deal with the expiration of special housing property rights is that the 70-year expiration of housing property rights can be that the house has been used for 70 years, or that the house property rights expire due to some accidents and the house is damaged due to unforeseen natural disasters. In this case, the house has been damaged and there is no possibility of renewing the lease. At this time, the relevant units will choose two ways to compensate the affected people: physical housing assistance or monetary assistance. If the affected people voluntarily apply for and accept housing assistance in kind or monetary form, the ownership of the original house and land will automatically end, that is to say, as long as the resettled residents are accepted, it is equivalent to giving up the property rights and land use rights of the original house.

Legal basis: Article 359 of the Civil Code of People's Republic of China (PRC).

If the term of the right to use residential construction land expires, it will be automatically renewed. The payment or reduction of the renewal fee shall be handled in accordance with the provisions of laws and administrative regulations.

The renewal of the right to use non-residential construction land after the expiration of the term shall be handled according to law. The ownership of houses and other immovable property on the land, if there is an agreement, shall be in accordance with the agreement; If there is no agreement or the agreement is unclear, it shall be handled in accordance with the provisions of laws and administrative regulations.
