Regulations of Beijing Municipality on Mental Health

Chapter I General Provisions Article 1 In order to strengthen mental health work, improve citizens' mental health level, safeguard the legitimate rights and interests of mental patients and promote social harmony and stability, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to mental health services such as mental health promotion, mental disease prevention, diagnosis, treatment and rehabilitation and related management activities within the administrative area of this Municipality. Article 3 The city's mental health work follows the principle of territorial management, adheres to the policy of giving priority to prevention, combining prevention with treatment, giving priority to intervention, covering widely and managing according to law, and establishes a working mechanism of government leadership, departmental cooperation and social participation. Fourth mental health work is an important part of the city's public health system construction, and should be included in the national economic and social development plan.

According to the level of economic and social development and the needs of mental health work, the city has established a financial guarantee system for mental health work, improved the mental health service network, and promoted the development of mental health. Article 5 The municipal, district and county people's governments shall uniformly organize and lead the mental health work within their respective administrative areas.

The municipal, district and county health administrative departments are the competent departments of mental health work, responsible for organizing the formulation and implementation of mental health work plans, and supervising and managing mental health work.

Civil affairs, public security, finance, personnel, education, development and reform, judicial administration, industry and commerce, labor and social security and other administrative departments, sub-district offices and township people's governments shall do a good job in mental health-related work within their respective functions and duties.

Trade unions, the Communist Youth League, women's federations, disabled persons' federations, aging committees and other social organizations, residents' committees and villagers' committees shall assist in mental health work in accordance with the provisions of these regulations. Article 6 The legitimate rights and interests of patients with mental illness are protected by law.

It is forbidden to discriminate and insult mental patients and their families; It is forbidden to abuse or abandon patients with mental illness. Article 7 The legitimate rights and interests of mental health practitioners are protected by law.

The whole society should respect and understand mental health practitioners. No unit or individual may interfere with the normal practice of mental health institutions and their employees.

The people's governments at all levels in this Municipality and their relevant departments shall take measures to strengthen the occupational protection of mental health practitioners. Article 8 This Municipality encourages units and individuals to care for and help patients with mental illness and their families, and support the development of mental health undertakings through funding and voluntary service.

This Municipality shall commend or reward the units and individuals that have made outstanding contributions in mental health work. Chapter II Promotion of Mental Health and Prevention of Mental Illness Article 9 This Municipality shall establish a mental illness prevention and control system with mental illness prevention and control institutions as the main body, medical institutions as the backbone, communities as the foundation and families as the support. The specific measures shall be formulated separately by the municipal public health administrative department. Article 10 A mental illness information reporting system shall be established in this Municipality.

The municipal public health administrative department shall establish a classified report and management system for mental illness information.

Medical institutions shall, in accordance with the contents, procedures, time limits and methods stipulated by the municipal public health administrative department, report to the district and county mental disease prevention and control institutions where the medical institutions are located the situation of patients diagnosed with mental illness. The county mental illness prevention and control institutions shall verify the information and report to the municipal mental illness prevention and control institutions. Eleventh county mental illness prevention and control institutions shall establish files for patients with severe mental illness, and inform the community health service institutions, street offices and Township People's governments of the information of patients with severe mental illness. Neighborhood offices and Township People's governments shall timely grasp the situation of patients with severe mental illness in their respective jurisdictions, and establish a patient information communication mechanism with mental illness prevention and control institutions.

District and county mental illness prevention and control institutions and community health service institutions shall regularly visit patients with severe mental illness. Residents' committees and villagers' committees shall assist in regular visits and assist in treatment according to the condition of mental patients. Twelfth city, district and county people's governments should incorporate the psychological crisis intervention of major disasters into the emergency plan for public emergencies. The administrative department of health shall organize the professional training of psychological crisis intervention.

The municipal, district and county people's governments and their relevant departments shall organize psychological crisis intervention to reduce the incidence of mental illness after major disasters. Thirteenth city, district and county health administrative departments should organize mental health education, popularize mental health knowledge, improve citizens' mental health level, and prevent the occurrence of mental illness.

The municipal, district and county health administrative departments shall strengthen the on-the-job training of mental health professionals and improve their professional level and working ability; Strengthen the training and education of non-mental health professionals in medical institutions to improve their ability to identify mental illness; Provide technical support for public security, judicial administration, civil affairs, education and other administrative departments and related social groups to carry out mental health knowledge training. Article 14 The administrative departments of education and health shall train teachers on mental health knowledge, so as to improve teachers' ability to promote students' mental health. Schools should provide necessary conditions for teachers to receive mental health knowledge training.

Schools should incorporate mental health education into teaching plans, carry out mental health education, consultation and counseling according to the characteristics of students of different ages, create a learning environment conducive to students' mental health, and promote students' physical and mental health. Institutions of higher learning and qualified primary and secondary schools should be equipped with professionals to provide psychological counseling services for students.
