Recently, Mr. Dai, a citizen, accidentally discovered that his personal credit information was inquired by the Credit Information Center of China Merchants Bank. It is reported that when a commercial bank inquires about personal credit information, it should obtain the written authorization of the inquired person, but the bank refuses to show Mr. Dai the written authorization. At present, the Shandong Banking Regulatory Commission has been involved in the investigation.
The public found that personal credit records were inquired.
On February 10, Mr. Dai went to the People's Bank to inquire about the Personal Credit Report for mortgage loan. Careful Mr. Dai accidentally found that the Credit Card Center of China Merchants Bank inquired about its own credit record.
In Mr. Dai's personal credit report, there is a form of "Details of Institutional Inquiry Records", which records the bank's inquiry about the credit records of the parties. "I remember every inquiry record, except that China Merchants Bank Credit Card Center checked my credit record on March 2065438+2 1." Mr. Dai said.
It is reported that according to the relevant provisions of the Interim Measures for the Administration of Personal Credit Information Database of the People's Bank of China, when a commercial bank uses the personal credit information database to inquire about credit information, it shall obtain the written authorization of the inquired person. Mr. Dai said: Before March 2065438+2 1 in 2004, he had never had any contact with China Merchants Bank's credit card, and he had never signed a written authorization for the bank to inquire about its credit information. "I am worried that personal information will be stolen or traded, and I hope that China Merchants Bank can produce relevant written authorization".
The bank said that the customer applied for a credit card and refused to show evidence.
Subsequently, the reporter followed Mr. Dai to China Merchants Bank Jinan Branch. In the face of Mr. Dai's inquiry, the relevant person in charge of China Merchants Bank Jinan Branch said: On March 2065438+2 1 2004, China Merchants Bank inquired about Mr. Dai's credit record, which was a normal work flow of the bank. "This customer used his mobile phone to apply for China Merchants Bank credit card online, and we traced back to Mr. Dai's mobile phone number through the information on the mobile phone webpage."
In the face of this reply, Mr. Dai insisted that for security reasons, he never used mobile phones or the Internet when handling any bank card business. Subsequently, Mr. Dai asked the bank to produce relevant evidence, but was rejected. "For details, please consult Shanghai Headquarters of China Merchants Bank Credit Card Center."
Regarding Mr. Dai's request to see the written authorization, the person in charge said that the online signing agreement is equivalent to the written authorization. "When a user applies for a credit card through the Internet or a mobile phone, there will be a confirmation of the relevant agreement on the application homepage. When the user clicks the confirm button, he agrees to our relevant agreement. "
In order to inquire about his credit card handling history in the bank, Mr. Dai called the hotline of China Merchants Bank Credit Card Customer Service Center. The customer service staff told us that on April 25th, 20 14, Mr. Dai had received the relevant information about handling credit cards. Before that, Mr. Dai had no other handling records.
CBRC: It has been involved in the investigation.
Li Youzhen, a lawyer of Shandong Shunqi Law Firm, said: According to the relevant provisions of the Civil Law, citizens' credit information is a major privacy, and no unit is allowed to inquire without authorization. "A commercial bank shall obtain the written authorization of the inquired person when inquiring about personal credit information. If the operation is illegal or leaks, the bank staff will be held accountable and fined up to 30,000 yuan. Anyone suspected of committing a crime will be transferred to the judicial organs for handling. " Li Youzhen said.
"Written authorization generally refers to a paper-based authorization rather than an electronic version, which requires the signature of the parties." Li Youzhen said that even if China Merchants Bank has evidence to prove that Mr. Dai used his mobile phone to apply for a credit card, it is obliged to show Mr. A Dai a written authorization to check his credit history. "If it cannot be provided, it is an illegal operation, and China Merchants Bank should publicly apologize to Mr. Dai."
In view of China Merchants Bank's refusal to provide written authorization, it is suggested that Mr. Dai complain to the CBRC. "I hope the relevant departments can give me a reasonable answer." On the 2nd, Mr. Dai formally complained to the Shandong Banking Regulatory Commission on this matter, and the Banking Regulatory Commission has been involved in the investigation.
