Chapter II Scope and Criteria of Bidding Article 5 For infrastructure, public utilities and other construction projects related to social public interests and public safety, all or part of the construction projects invested by state-owned funds or financed by the state, provinces and municipalities, and the construction projects financed by loans and aid from international organizations or foreign governments, the procurement of important equipment and materials related to project construction shall meet one of the following conditions.

Where the specific scope and scale of a project subject to tender as stipulated by laws, regulations and rules are lower than the above standards, such provisions shall prevail. Article 6 Infrastructure construction projects related to social public interests and public safety include:
(1) Energy projects such as coal, oil, natural gas, electric power and new energy;
(2) Transportation projects such as railways, highways, pipelines, water transport, aviation, transportation auxiliary industries and other transportation industries;
(three) postal services, telecommunications hubs, communications, information networks and other communication projects;
(four) flood control, irrigation, drainage, water diversion (supply), beach management, soil and water conservation, water conservancy projects;
(five) urban infrastructure projects such as roads, bridges, subway and light rail transportation, sewage discharge and treatment, garbage disposal, underground pipelines, public parking lots, etc.;
(6) Ecological environment protection projects;
(seven) other infrastructure projects. Seventh public utilities construction projects involving social public interests and public safety include:
(a) water supply, power supply, gas supply, heating, greening and other municipal engineering projects;
(two) science and technology, education, culture and other projects;
(three) sports, tourism and other projects;
(four) news publishing, radio, film and television and other projects;
(five) health, social welfare and other projects;
(six) commercial housing, including affordable housing and other projects;
(7) Other public utility projects. Eighth all or part of the use of state-owned funds to invest in construction projects include:
(a) the use of financial budget funds at all levels of the project;
(two) the use of various government special construction funds included in the financial management of the project;
(three) the use of state-owned enterprises and institutions' own funds, and the state-owned assets investors actually have control over the project;
(four) commercial bank loan projects guaranteed by state-owned enterprises or mortgaged or pledged by state-owned assets. Article 9 State-financed construction projects include:
(1) Projects financed by bonds issued by the state;
(two) the use of foreign loans or guarantees to raise funds for the project;
(three) the use of national policy loans;
(4) Projects authorized by the state to be invested by investors;
(5) Financing projects chartered by the state. Tenth construction projects that use loans and aid funds from international organizations or foreign governments include:
(1) Projects using loan funds from international financial organizations such as the World Bank and the Asian Development Bank;
(2) Projects using loan funds from foreign governments and their institutions;
(3) Projects that use aid funds from international organizations or foreign governments. Eleventh projects that should be invited to tender according to law may not be invited to tender under any of the following circumstances. However, according to the nature of the project, when submitting the feasibility study report, the fund application report, the project application report or the project filing report, an application for not inviting tenders shall be made, and the reasons shall be explained:
(a) involving national security, state secrets, emergency rescue and disaster relief, or belonging to the use of poverty alleviation funds to implement work for relief, the need to use migrant workers and other special circumstances, not suitable for bidding projects;
(two) the survey and design of construction projects, the use of specific patents or proprietary technology, or its architectural artistic modeling has special requirements, and approved by the competent department of the project;
(three) other projects that are not suitable for bidding according to law.
