The auxiliary police of public security organs as mentioned in these Regulations refers to the non-people police who provide auxiliary support for the daily operation and police activities of public security organs according to the development of social security situation and the actual needs of public security work.
Police auxiliary personnel are divided into police auxiliary personnel and service police auxiliary personnel according to their job responsibilities. Article 3 The management of police auxiliary personnel shall follow the principles of standardization according to law, clear rights and responsibilities, strict supervision, reasonable guarantee and who uses, manages and is responsible. Article 4 The people's governments at or above the county level shall incorporate the construction of police auxiliary personnel into the local economic and social development plan, and incorporate the wages, benefits, public funds and other related funds of police auxiliary personnel into the fiscal budget at the corresponding level. Article 5 The public security organs of the people's governments at or above the county level shall be responsible for the management of auxiliary police personnel within their respective administrative areas. The public security organ at a higher level shall strengthen the guidance and supervision of the management of the police auxiliary personnel of the public security organ at a lower level.
Institutions, civil affairs, finance, human resources and social security, health, retired military affairs and other departments shall, in accordance with their respective responsibilities, do a good job in the management of police auxiliary personnel. Sixth police auxiliary personnel who have made outstanding achievements and contributions shall be commended and rewarded in accordance with the relevant provisions of the state and this province. Chapter II Duties Article 7 Auxiliary police officers shall, under the command of public security organs and the leadership of the people's police, assist the people's police in carrying out relevant work in accordance with laws, regulations and relevant provisions of the state, and shall not enforce the law alone or in their own names. Article 8 The auxiliary police shall be responsible for assisting the people's police in non-law enforcement posts of public security organs to do the following related work:
(a) administrative work such as clerical assistant, file management, wiring inquiry, window service, certificate handling, information collection and entry;
(two) psychological counseling, medical treatment, translation, computer network maintenance, data analysis and communication support and other technical support work;
(three) in addition to weapons and police equipment, police equipment storage and maintenance, financial management and other police security work;
(four) other work that can be done in accordance with the relevant provisions of the state. Article 9 The auxiliary police shall be responsible for assisting the people's police in law enforcement posts of public security organs to do the following related work:
(a) to prevent and stop illegal and criminal activities;
(2) conducting public security patrols, public security inspections and safety inspections in places where people gather;
(3) Investigating, intercepting, controlling, monitoring and guarding criminal suspects;
(four) to maintain the order of cases (events), protect cases (events), and rescue the injured;
(five) to divert traffic, discourage and correct traffic safety violations, and collect traffic violation information;
(six) daily management of drug addicts, inspection of precursor chemicals enterprises, and public collection of drugs;
(seven) to carry out entry-exit management services and border inspection;
(eight) to carry out publicity and education on public security, traffic safety and drug control;
(nine) in accordance with the relevant provisions of the state can be engaged in other work. Tenth auxiliary police shall not engage in the following work:
(1) Handling matters involving state secrets;
(two) case investigation and evidence collection, issue an appraisal report, and identify the responsibility for traffic accidents;
(3) Implementing criminal compulsory measures;
(4) Making administrative decisions;
(5) Examining cases;
(6) Keeping weapons and police equipment;
(seven) other work prohibited by laws, regulations and relevant provisions of the state. Eleventh public security organs shall not arrange police assistants to engage in the work that should be undertaken by the people's police according to laws, regulations and state regulations.
The consequences caused by the performance of duties by police auxiliary personnel shall be borne by the public security organs that use police auxiliary personnel.
The act of police assistants assisting the people's police in performing their duties according to law is protected by law, and citizens, legal persons or other organizations shall support and cooperate. Chapter III Recruitment Article 12 The recruitment of police auxiliary personnel shall face the society, follow the principles of openness, equality, competition and merit selection, and unify the recruitment standards and procedures. Article 13 The public security organ of the provincial people's government shall, jointly with the departments of organization establishment, finance, human resources and social security at the same level, formulate measures for the administration of the establishment of police auxiliary personnel in the public security organs of the province in accordance with the principle of reasonably controlling the scale, improving the quality and inclining to the grassroots level, and submit them to the provincial people's government for approval before implementation.
The public security organ of the people's government at or above the county level shall put forward the employment plan according to the quota management measures, and report it to the people's government at the same level for approval after being audited by the establishment, finance, human resources and social security departments at the same level. Article 14 To apply for police assistants, the following conditions shall be met:
(1) Having China nationality;
(2) Upholding the Constitution and observing national laws and regulations;
(three) support the China * * * production party and the socialist system;
(four) at least eighteen years of age;
(five) physical and mental health, good conduct;
(six) with a high school education and the ability to perform their duties;
(seven) other conditions stipulated by the state and the province.
Police assistants should have a college degree or above and the professional qualifications and skills needed to perform their duties.
It is forbidden to employ persons who are prohibited from engaging in police auxiliary work by laws, regulations and relevant provisions of the state.
