Measures for the administration of filing and registration of quality certification consulting institutions

Article 1 In order to strengthen the supervision and management of quality certification consulting institutions, standardize the quality certification consulting market, and safeguard the legitimate rights and interests of all parties involved in quality certification consulting activities, these Measures are formulated in accordance with the relevant national laws and regulations on quality certification and the responsibilities entrusted to the State Bureau of Quality and Technical Supervision by the State Council.
Article 2 These Measures shall apply to the filing, registration, supervision and management of quality certification consulting institutions. The term "quality certification consulting institutions" as mentioned in these Measures refers to the institutions that guide enterprises and institutions to establish or improve their management systems.
Article 3 Institutions engaged in quality certification consulting activities in China (including overseas quality certification consulting institutions and their branches or offices) shall have the necessary resources to engage in consulting activities. Make the necessary registration.
Individuals shall not engage in quality certification consulting activities as natural persons.
Article 4 The State Bureau of Quality and Technical Supervision is responsible for supervising the establishment and implementation of the filing and registration system for quality certification consulting institutions, and its specific responsibilities are:
(a) to formulate the principles and policies for the supervision and management of quality certification consulting institutions;
(two) to formulate the basic requirements for the registration of quality certification consulting institutions;
(three) to supervise and manage the filing and registration of the quality and technical supervision bureaus of all provinces, autonomous regions and municipalities directly under the central government;
(four) uniform provisions of the quality certification consulting institutions for the record registration marks and certificate styles;
(five) regularly publish the list of quality certification consulting institutions approved for filing and registration; Make an announcement on the quality certification consulting institutions that have cancelled their registration;
(six) to accept complaints from relevant parties to the quality and technical supervision bureaus of all provinces, autonomous regions and municipalities directly under the Central Government and the quality certification consulting institutions registered for the record;
(seven) to protect the quality certification consulting institutions from engaging in quality certification consulting activities legally and standardize the quality certification consulting market.
Article 5 The bureaus of quality and technical supervision of all provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the filing and registration authorities) are responsible for the specific implementation of filing and registration within their respective administrative areas, and their duties are:
(1) Accepting the application for filing and registration of quality certification consulting institutions, organizing relevant experts to conduct filing and examination according to these Measures, and issuing filing and registration certificates to quality certification consulting institutions that have been approved for filing and registration;
(two) to supervise and inspect the quality certification consulting institutions that have been registered for the record;
(three) regularly submit to the State Bureau of Quality and Technical Supervision the implementation of the registration of quality certification consulting institutions, the list of approved quality certification consulting institutions, the summary of registration work and the performance of registered quality certification consulting institutions;
(four) failing to suspend or cancel the registration certificate of the quality certification consulting institution in accordance with the provisions;
(five) to deal with the improper use of the registration certificate and logo of the registration authority;
(six) to publish the directory of quality certification consulting institutions registered in the region and the directory of quality certification consulting institutions whose registration has been revoked. Guide enterprises to seek the consulting services of quality certification consulting institutions approved by filing and registration;
(seven) to handle complaints about the quality certification consulting institutions registered for the record.
Article 6 A quality certification consulting institution shall be a unit with legal person qualification and capable of independently bearing civil liabilities.
Seventh quality certification consulting institutions should have the necessary fixed office space to meet the needs of providing consulting services, and should have corresponding communication means and other office facilities.
Eighth quality certification consulting institutions should have more than four full-time consultants. Full-time consultants should have/kloc-0 or more senior auditors and at least 3 interns (including interns) registered by China Certification staff Registration Committee, or more than 2 auditors and 2 interns (including interns), and the remaining 70% of full-time consultants should be qualified as interns (including interns). The work of part-time staff should not affect the effectiveness of consulting activities.
Ninth quality certification consulting institutions should establish a quality system according to the current national quality management standards or guidelines, form relevant documents, and maintain its effective operation. The documented management system shall at least include the following contents: contract review procedures, consulting project planning and implementation planning procedures, document and data control procedures, subcontracting and collaboration procedures, consulting process control procedures, nonconformity control and corrective measures procedures, internal quality system audit and management review procedures, conformity audit procedures, personnel management and training procedures, quality record control procedures, confidentiality procedures and customer complaints and tracking service procedures.
Tenth quality certification consulting institutions registered for the record shall formulate and publish their quality certification consulting fees.
Eleventh institutions engaged in quality certification consulting activities shall apply to the registration authority where the institution is located for registration.
Twelfth quality certification consulting institutions for the record registration according to the following procedures:
(1) application. The quality certification consulting institution applying for filing and registration shall fill in the application for filing and registration in accordance with the relevant provisions, provide relevant written materials and submit them to the filing and registration authority.
(2) review. The registration authority shall assign relevant experts to review the written materials of the quality certification consulting institutions, and conduct on-site review of the operation of the quality certification consulting institutions after passing the examination.
(3) filing and registration. Upon examination, if it meets the requirements for filing and registration, the filing and registration organ shall issue a certificate of filing and registration to the quality certification consulting institution; If it does not meet the requirements, it shall not be registered and explain the reasons.
Article 13 The State Bureau of Quality and Technical Supervision shall uniformly organize the supervision and inspection of the activities of registration authorities and quality certification consulting institutions registered for the record.
Article 14 The filing and registration authority shall supervise and inspect the quality certification consulting institutions that have been approved for filing and registration. During the validity period of the certificate, the registration authority shall supervise and inspect the capacity of the quality certification consulting institutions registered for the record at least once a year.
Fifteenth in any of the following circumstances, the State Bureau of Quality and Technical Supervision shall, according to the seriousness of the case, order it to make corrections and deal with it in informed criticism:
(a) failing to register the quality certification consulting institutions according to these measures;
(two) personnel engaged in quality certification consulting activities in the registration authority;
(3) The filing and registration authority restricts the clients from accepting the consulting services provided by the quality certification consulting institutions registered for specific filing by administrative means;
(four) hinder the institutions engaged in quality certification consulting activities to apply for registration;
(5) Failing to recognize the registration certificates of other registration authorities and repeating the registration activities.
Sixteenth registered quality certification consulting institutions in any of the following circumstances, the registration authority should urge them to take measures to rectify within a time limit, overdue rectification, according to the seriousness of the case, suspend or cancel its registration:
(a) failed to maintain the consulting ability required by these measures;
(two) major changes in the organization, resources and operation have not been reported to the registration authority in time;
(three) there is evidence that it has engaged in activities that damage or hinder the fairness and effectiveness of quality certification, or used unfair competition means;
(four) improper use of the registration certificate or logo.
Seventeenth approved for the record registration of quality certification consulting institutions to provide consulting services for enterprises within two years, the personnel involved in consulting projects shall not participate in the quality certification audit activities of the enterprise.
National registered auditors (including national registered senior auditors, auditors and practicing auditors) shall not accept the entrustment or employment of quality certification consulting institutions that have not been registered for the record, nor shall they carry out consulting activities in their own names. Once the above acts are discovered, they will be dealt with by the National Registration Committee of Certification staff, China.
Eighteenth registration certificate issued by the registration authority has the same effect in China. The registration certificate of quality certification consulting institutions shall be valid for four years, and an application for renewal shall be filed within six months before the expiration of the validity period.
Nineteenth quality certification consulting institutions for the record registration management rules shall be formulated by the State Bureau of quality and technical supervision.
Twentieth quality certification consulting institutions registered for the record shall pay the registration management fee to the registration authority in accordance with the relevant provisions of the state.
Article 21 The State Bureau of Quality and Technical Supervision shall be responsible for the interpretation of these Measures.
Article 22 These Measures shall come into force as of the date of promulgation.
