Article 1 This system is formulated to strengthen the signing and management of commercial housing sales contracts of the company and ensure the orderly sales of the company. Article 2 The management of commercial housing sales contracts as mentioned in this system refers to the comprehensive management of commercial housing sales contracts and their annexes (including house plans, delivery standards and supplementary agreements) and all other documents, drawings and materials related to commercial housing sales. Article 3 A commercial housing sales contract may be signed by a marketing company entrusted by the company, or it may be signed by relevant personnel organized by the company itself. Article 4 The contract for the sale of commercial housing shall be filled in by the signing representative, reviewed by the sales person in charge, reviewed by the business department of the company, signed and numbered, and filed. Article 5 The company implements the contract training system. Before the commercial housing sales contract is signed, the company will arrange legal counsel to conduct pre-signing training for the signing representatives and file the training records. Chapter II Preparation before Signing Article 6 Before signing a contract for the sale of commercial housing, the business department shall prepare all the materials needed for signing the contract, draw up the signing process and training contents for the record. Article 7 The preparatory work before signing the contract includes the following contents: (1) Preparation of relevant documents and materials: 1, construction land planning permit 2, land use certificate; 3, the construction project planning permit; 4. Construction permit; 5. Pre-sale permit; 6. Pre-sale area report. (2) Preparation of main drawings and materials: 1, floor plan of the building, location map in the whole building (bearing shall be indicated) and general plan; 2. Statistical table of signing data (residential and non-residential). Including: building number, building floor number (ground floor and underground floor should be indicated), floor number, unit number, room number, house use, floor height, clear height, orientation, balcony number, balcony structure (whether it is closed or not), building area (indicating interior building area and pool area), main building structure of the building where the house is located and other related information; For projects with sloping roofs, the minimum and maximum rice number of sloping roofs should be indicated; 3, sales control table (residential and non residential). Including building number, floor number, room number, unit number and construction area; 4. Delivery standards (residential and non-residential); 5, "residential quality guarantee" and "commercial housing manual". (3) Bank mortgage, bank account number and other related information. Article 8 In case of any change or modification of relevant documents, drawings and materials, a countersignature system shall be implemented, and all departments shall be informed in writing in time. Chapter III Signing and Examination of Subscription Letter Article 9 Before the commercial housing sales contract is formally signed, the signing representative may sign the subscription letter with the customer. Article 10 The signing process of the subscription book is as follows: Article 11 The subscription book shall specify the name of the signing representative, contact telephone number, customer name (signed by the customer himself), ID number, contact address, contact telephone number, signing date and two copies of the customer's ID card. Article 12 The subscription book is made in duplicate. After the customer deposits the subscription money into the company account, the receipt is exchanged for the financial receipt and subscription book, and the remaining subscription book together with a copy of the customer's ID card is returned to the company by the sales person in charge. Article 13 Subscription books shall be registered and filed after being audited by the business department, and information statistics shall be made, and unsigned or invalid subscription books shall be registered and recovered. Article 14 The statistical information of the subscription book shall include the following main contents: (1)No.: R (subscription book)-XX (project name abbreviation) -00X (serial number); (2) the name and telephone number of the customer; (three) the purpose and construction area of the house; (4) Building number, floor number, unit number and room number; (five) the purchase unit price and total price; (6) Payment method and signing date. Article 15 The signing representative must retrieve the subscription book held by the customer and submit it to the company together with the formal commercial housing sales contract and its annexes. Chapter IV Signing and Examination of Contracts and Annexes Article 16 After the company obtains the pre-sale permit, the signing representative is responsible for contacting the customer and signing the formal commercial housing sales contract and annexes. Article 17 The signing process of the Commodity House Purchase and Sales Contract and its annexes is as follows: Article 18 After checking and confirming that the Commodity House Purchase and Sales Contract and its annexes and samples signed by the signing representative are correct, the information required by the signing instructions is complete and signed on the Sales Signing Audit Sheet, the sales person in charge will forward it to the sales department for checking. Nineteenth commercial housing sales contracts and accessories and related materials are incomplete, the signing representative must be responsible for the completion within the time limit required by the company. Otherwise, the contract will not be sealed for the record, and the signing representative and the person in charge of sales will be jointly and severally liable for the consequences. Chapter V Filing, Supervision, Filing and Return of Contracts Article 20 After the business department has passed the examination, it shall affix its seal, enter the relevant data information of the commercial housing sales contract into the filing system and report it to the housing management authority for supervision. Article 21 After the seal of the Housing Authority is completed, the business department will return one copy of the Commodity House Purchase and Sales Contract and one copy of its annex to the customer after verifying that the payment has been paid. If the full amount is paid in one lump sum, the contract and an attachment can be returned to the customer at that time. Other commercial housing sales contracts, attachments and other materials should be reported to the company for the record. Twenty-second commercial housing sales contracts and supplementary agreements shall be numbered. Chapter VI Supplementary Provisions Article 23 When signing the subscription book or the commercial housing sales contract and its annexes, the signing representative shall be fined by 50 yuan in any of the following circumstances: (1) failing to fill in the relevant contract terms as required; (two) did not fill in the sales contract audit form; (3) Failing to keep a copy of the customer's ID card; Article 24 When signing the subscription book or the commercial housing sales contract and its annexes, the signing representative incorrectly filled in the contract terms such as house price, construction area (including interior construction area and pool area), building number, unit number, room number and floor height. , and will be fined 100 yuan. Article 25 If the signing representative fills in the name on behalf of the customer in the buyer column of the subscription book or the commercial housing sales contract and its annexes, 200 yuan will be fined; If losses are caused to the company, it shall also bear the compensation expenses. Article 26 When signing the Commodity House Sales Contract and its annexes, the signing representative shall not add anything irrelevant to the terms of the contract in the contract and its annexes. If there is any change, the Application Form for Signing Change must be filled in according to the company's regulations, and it will be implemented according to the changed terms after being approved by the general manager. Otherwise 500 yuan will be fined. Twenty-seventh signing representatives and sales leaders shall truthfully publicize, explain and explain the matters in the sale of commercial housing to customers. If there are unclear matters that need to be verified and consulted by the company's internal personnel, they should communicate with the internal personnel first, and then explain and explain to the customers. Otherwise 200 yuan will be fined. Article 28 The person in charge of handling the pre-sale permit shall ensure that the pre-sale area data entered into the filing system of the Housing Authority is consistent with the data in the pre-sale area report. If the area data are inconsistent, 500 yuan will be fined each time. Article 29 This system shall be implemented as of May 6, 2007. Note: 1.
