Measures of Taizhou Municipality on the Administration of Urban Construction Waste
Article 1 In order to strengthen the management of urban construction waste and maintain the city appearance and environmental sanitation, these measures are formulated in accordance with the Regulations on the Administration of City Appearance and Environmental Sanitation, the Decision of the State Council Municipal Government on Setting Administrative License for the Administrative Examination and Approval Items that Really Need to Be Retained, the Regulations on the Administration of Urban Construction Waste and the Regulations on the Administration of City Appearance and Environmental Sanitation in Zhejiang Province, and in combination with the actual situation of our city.
Article 2 The term "construction waste" as mentioned in these Measures refers to all kinds of buildings, structures and pipe networks newly built, rebuilt, expanded and demolished by construction units, as well as wastes such as soil, materials and mud generated by residents' decoration and decoration of houses.
The term "disposal" as mentioned in these Measures refers to the dumping, transportation, transit, backfilling, consumption and utilization of construction waste.
Third units and individuals engaged in the disposal of construction waste in Taizhou city planning area shall abide by these measures.
Article 4 The municipal administrative law enforcement department of urban management is the administrative department in charge of construction waste disposal in this Municipality, and is responsible for organizing the implementation of these measures; District urban management administrative law enforcement department is responsible for the management of construction waste within its jurisdiction.
The administrative departments in charge of development and reform, public security, transportation, construction planning, water conservancy, environmental protection, maritime affairs, port and shipping, land and ocean shall, according to their respective functions and duties, coordinate in the management of construction waste.
The municipal and district people's governments shall incorporate the funds needed for the management of construction waste into the fiscal budget at the corresponding level.
Article 5 The collection, transportation and consumption of construction waste shall be supervised in the whole process.
Sixth construction waste should follow the principles of reduction, recycling, harmlessness and whoever produces it is responsible.
Support and encourage the comprehensive utilization of construction waste, and encourage construction units and construction units to give priority to the comprehensive utilization of construction waste products.
Article 7 Construction units and construction units dealing with construction waste, units engaged in construction waste transportation and setting up construction waste disposal sites shall apply to the urban management administrative law enforcement department, which shall make a written decision within 20 working days after receiving the application. If approved, an approval document shall be issued; If it is not approved, it shall notify the applicant in writing and explain the reasons.
No one may alter, resell, lease, lend or illegally transfer the approval document of construction waste disposal in other forms.
Article 8 The municipal administrative law enforcement department of urban management shall establish an information platform for comprehensive utilization of construction waste to provide classified information on the generation, transportation, consumption and utilization of construction waste.
Ninth transportation of construction waste, laws, regulations and rules shall be subject to bidding, the construction unit shall carry out bidding to determine the transportation unit. If there is no provision, the construction unit shall be encouraged to bid to determine the transportation unit.
Article 10 When issuing the construction permit, the construction planning department shall inform the construction unit in writing to apply for the construction waste disposal certificate at the urban management administrative law enforcement department before the project construction, and send a copy to the urban management administrative law enforcement department.
Eleventh construction sites shall comply with the following provisions:
(a) shall promptly clean up all kinds of construction waste, keep the construction site clean and tidy;
(two) the implementation of closed construction, in accordance with the relevant provisions of the construction of fences or hard closed enclosure;
(three) the entrance should be hardened to keep the entrance road clean and in good condition;
(four) the allocation of special waterways for vehicle cleaning, drainage facilities, sewage sedimentation facilities and high-pressure washing equipment for vehicles, and maintain effective use;
(5) All vehicles must be washed before leaving the construction site, and vehicles with mud are not allowed;
(six) it is forbidden to install pipelines and other facilities for discharging mud without authorization;
(seven) there is a person responsible for the site management, do not meet the requirements of city appearance and environmental sanitation vehicles are not allowed to drive out of the scene, truthfully record the transportation of transport vehicles, to ensure the integrity of the operating account.
Twelfth it is forbidden to dump construction waste into rivers, lakes and other water bodies.
Thirteenth it is forbidden to mix construction waste with domestic waste.
Fourteenth residents who produce sporadic construction waste due to construction, maintenance, decoration, house demolition, etc. It shall report to the residential property management company or the neighborhood (village) committee in advance and pile it in the designated place, and pay the removal and disposal fee according to the prescribed standards. The property management company or neighborhood (village) committee shall apply to the administrative law enforcement department of urban management in time and arrange transportation in time.
Fifteenth sporadic construction waste disposal point setting and management should be:
(a) convenient for residents, hidden, keep the surrounding environment clean and tidy;
(two) it is forbidden to pile up construction waste on the main roads of the city; Construction waste piled up by residents shall be removed in time.
Sixteenth construction waste transport units to apply for the qualification of construction waste management service enterprises, shall meet the following conditions:
(a) transport vehicles should be equipped with a fully enclosed transport mechanism or a closed covering device, and equipped with driving and loading and unloading recorders and corresponding construction waste classified transport equipment;
(2) Having a legal road transport business license and vehicle driving license;
(3) It has a sound management system for the operation, safety, quality and maintenance of transport vehicles and has been effectively implemented;
Seventeenth construction waste transport units shall apply for urban construction waste transport documents before transportation.
The construction waste transport license shall specify the name and location of the project, the name of the construction unit, the construction unit and the transport unit, the disposal period of the construction waste, the license plate number of the transport vehicle, the transport route, the transport time, the disposal location and other matters. Urban construction waste transport permit shall be one vehicle and one permit.
Eighteenth urban management administrative law enforcement departments to implement the management of construction waste transport enterprises and vehicles.
Measures for the administration of the scoring system shall be formulated and implemented by the administrative law enforcement department of urban management.
Nineteenth transport units shall abide by the following provisions when transporting construction waste:
(1) Loading and consumption at the designated place;
(two) the right amount of loading, tight coverage, no leakage, no flying;
(three) according to the prescribed time and route;
(four) when leaving the scene, the car body is clean, the wheels are washed clean, and mud is not allowed on the road;
(five) the vehicle carrying urban construction waste transport permit;
(6) Dump in the designated disposal site, obey the command of the site management personnel, and obtain the disposal certificate for inspection.
Twentieth construction waste disposal sites should be set up in accordance with the overall urban planning and land use planning of Taizhou City.
According to the principle of rational layout, Taizhou city has set up construction waste disposal sites in Jiaojiang, Huangyan, Luqiao and Taizhou Economic Development Zone respectively.
Twenty-first set up a construction waste disposal site shall meet the following conditions:
(1) Having sound environmental sanitation and safety facilities and corresponding management systems;
(2) There is a mud pool dedicated to absorbing mud;
(3) Perfect drainage and fire fighting facilities and roads;
(4) Necessary mechanical equipment and lighting facilities;
(5) obvious signs.
Twenty-second construction waste disposal sites shall comply with the following provisions:
(a) in accordance with the provisions of the acceptance of construction waste, and standardize the stacking, and shall not accept domestic waste, industrial waste and toxic harmful waste;
(two) timely acceptance of construction waste;
(three) keep the site and road environment clean and tidy;
(four) the construction waste disposal site shall be based on the garbage disposal capacity and shall not be overloaded;
(five) for construction waste, it shall issue a certificate of construction waste disposal to the transportation unit.
(six) record the amount of transport vehicles and construction waste received into the disposal site.
Twenty-third urban management administrative law enforcement departments shall, after the completion of construction waste disposal, check and verify the acceptance certificate issued by the acceptance site within 3 working days.
Article 24 When an administrative organ finds a case that is not under its jurisdiction, it shall promptly transfer it to an administrative organ with jurisdiction for handling.
For the transferred case, the department responsible for management shall file the case in time and handle it according to relevant laws and regulations, and the results shall be copied to the transferred department within seven working days.
Twenty-fifth urban management administrative law enforcement departments should promptly trace the responsible person who caused the road pollution by construction waste and order the responsible person to clean up the pollution.
Twenty-sixth units or individuals that dispose of construction waste, in violation of the provisions on the management of construction waste in the process of disposal, shall be given administrative punishment by the administrative law enforcement department of urban management.
Twenty-seventh city management administrative law enforcement department staff dereliction of duty, abuse of power, corruption, shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-eighth counties (cities) can refer to these measures, formulate the relevant provisions of the local construction waste management.
