Provisions on engineering projects that must be tendered:
1. Article 1 These Provisions are formulated in accordance with Article 3 of the Bidding Law of People's Republic of China (PRC) in order to determine the engineering projects that must be subject to bidding, standardize bidding activities, improve work efficiency, reduce enterprise costs and prevent corruption.
2. Article 2 Projects that use state-owned funds for investment or state financing in whole or in part include: (1) projects that use budgetary funds of more than 2 million yuan, and the funds account for more than 10% of the investment; Projects that use the funds of state-owned enterprises and institutions, and the funds account for the controlling or leading position.
3. Article 3 Projects using loans or aid funds from international organizations or foreign governments include: ① projects using loans or aid funds from international organizations such as the World Bank and the Asian Development Bank; (2) Projects using loans and aid funds from foreign governments and their institutions.
4. Article 4 For large-scale infrastructure, public utilities and other projects related to social interests and public safety that do not fall under the circumstances specified in Articles 2 and 3 of these Provisions, the specific bidding scope shall be formulated by the development and reform department of the State Council in conjunction with the relevant departments of the State Council in accordance with the principle of necessity and strict restrictions, and submitted to the State Council for approval.
5. Article 5 If the survey, design, construction, supervision and procurement of important equipment and materials related to the project construction within the scope specified in Articles 2 to 4 of these Provisions meet one of the following standards, bidding must be conducted: ① The estimated price of a single construction contract is more than 4 million yuan; ② The estimated price of a single contract for the procurement of important equipment, materials and other goods is more than 2 million yuan; (3) The estimated price of a single contract for the procurement of services such as survey, design and supervision is above 1 10,000 yuan. Survey, design, construction, supervision and procurement of important equipment and materials related to engineering construction can be combined in the same project, and if the estimated total contract price reaches the standard specified in the preceding paragraph, an invitation to tender must be conducted.
