These Provisions shall apply to the cost management of safety protection and civilized construction measures for all kinds of new, expanded and rebuilt housing construction projects (including supporting lines, pipelines and equipment installation projects, decoration projects), municipal infrastructure projects, landscaping projects and demolition projects within the administrative area of Nanning City.
Article 3 The expenses for safety protection and civilized construction measures mentioned in these Provisions refer to the expenses required for purchasing and updating construction safety protection appliances and facilities, improving safe production conditions and working environment, improving management level, and strengthening the protection of the rights and interests of construction personnel and preventing risks, including environmental protection expenses, civilized construction measures expenses, safe construction expenses, temporary facilities expenses and accidental injury insurance expenses for dangerous operations. The cost of safety protection and civilized construction measures is an integral part of the project cost. It is calculated according to the Guangxi Zhuang Autonomous Region Building Decoration and Landscaping Project Cost Quota and the Guangxi Zhuang Autonomous Region Building Safety Protection and Civilized Construction Measures Fee and Management Rules (hereinafter referred to as the Management Rules). The "Nanning Construction Site Remote Video Monitoring System" should be installed and used as required, and the construction unit should protect the safety of the construction project.
Article 4 For a project subject to project bidding according to law, the tenderee or a qualified intermediary agency (a project directly contracted by the employer) shall, in combination with the actual project and in accordance with the requirements of Article 3 of these Provisions, independently prepare a list of safety protection and civilized construction measures.
The bidder (or contractor) shall formulate corresponding safety protection and civilized construction measures in the construction organization design documents in combination with the engineering characteristics, construction progress and working environment requirements, and protect the engineering safety in accordance with the requirements of the bidding documents in combination with its own construction technical level and safety management requirements. The cost of civilized construction measures shall be quoted separately according to the cost quota, and the quotation shall be priced according to the rate in Annex II of the management rules plus the accident insurance rate for dangerous operations in the cost quota. Among them, the value of the rate interval in Annex II is:
A, housing construction project
(1) Installation and use of "Nanning Construction Site Remote Video Monitoring System" project: the project with a unit construction area of less than 30,000 square meters (including 30,000 square meters) takes the highest value, and the project with a unit construction area of more than 30,000 square meters takes the middle value.
(II) The project that "Nanning Construction Site Remote Video Monitoring System" cannot be installed and used due to objective factors: the project with unit construction area less than 6.5438+0.000 square meters takes the high value, the project with unit construction area of 6.5438+0.130,000 square meters (including 6.5438+0,000 and 30,000 square meters) takes the median value, and the project with unit construction area of 30,000 square meters.

Installation and use of "Nanning construction site remote video monitoring system" project, its value shall not be lower than the median value. Projects that are not equipped with "Nanning Construction Site Remote Video Monitoring System" shall be valued according to the actual situation of the project, but shall not be lower than the minimum value.
Article 5 The cost of safety protection and civilized construction measures shall be listed as uncompetitive expenses separately, and the bid shall not be invited again after being quoted according to the provisions of Article 4.
Article 6 The cost of safety protection and civilized construction measures shall be paid by the construction unit to the construction unit. The construction unit and the construction unit shall clearly stipulate the total cost of safety protection and civilized construction measures in the construction contract, and stipulate the use requirements and adjustment methods of the cost.
Article 7 The construction unit shall deposit the safety protection fee and civilized construction measures fee into the special account of the designated fund supervision bank at one time, and provide valid vouchers deposited into the special account when going through the formalities of construction project quality supervision and registration and safety measures filing with the construction safety supervision institution. If the fee for safety protection and civilized construction measures is not deposited, the construction safety supervision institution shall not handle the registration of construction project quality supervision and the filing procedures for safety measures.
Article 8 The fees for safety protection and civilized construction measures deposited in the special account shall be specially managed, and the tripartite monitoring agreement shall be signed by the construction unit, the fund monitoring bank and the safety supervision institution, and shall be paid by stages and in a fixed amount during the construction process.
(a) single building project:
1. After the enclosure, gate, flushing platform, drainage system and temporary facilities on the construction site are completed, the down payment will be paid, and 70% of the total cost will be paid after the quality supervision and registration of the construction project and the implementation of safety measures;
2. For the second payment, 30% of the total cost will be paid when 70% of the building capping and decoration projects are completed;
(two) housing construction group project:
1. After the enclosure, gate, flushing platform, drainage system and temporary facilities on the construction site are completed, the down payment will be paid, and 70% of the total cost will be paid after the quality supervision and registration of the construction project and the implementation of safety measures;
2. For the second payment, 30% of the total cost will be paid when the capping rate of the main body of the group housing construction project reaches 50%;
(3) Municipal infrastructure projects
1, payment first, then enclosure, gate, flushing platform, drainage system, temporary facilities, etc. 70% of the total cost shall be paid for the completion of the construction site, the quality supervision and registration of the construction project and the filing of safety measures;
2. For the second payment, 30% of the total cost will be paid when 50% of the total engineering quantity of the contract section is completed;
After the completion of the project, the construction unit shall, when handling the record of the completion acceptance of the construction project, provide valid documents and materials for the payment of the project (including the settlement of safety protection and civilized construction measures) before handling the record formalities of the completion acceptance of the construction project.
Article 9 If the construction unit is responsible for implementing the management system of safety production and civilized construction standards on the construction site and reaches the safety production and civilized construction standards stipulated by the municipal construction administrative department, the construction unit shall apply for payment from the construction unit in accordance with the payment method in Article 8, and only after the construction unit signs and approves the implementation of the safety production and civilized construction standards can it apply for payment from the construction safety supervision institution and the opening bank, and the opening bank will transfer the cost of safety protection and civilized construction measures to the construction unit on the basis of the payment confirmation opinions issued by the construction safety supervision institution.
Tenth in the process of engineering construction, the payment management of safety protection and civilized construction measures is based on the daily supervision and management assessment of the construction site by the construction safety supervision institution.
The construction unit shall conscientiously implement the safety protection and civilized construction standards of the construction site, as well as the relevant provisions of the municipal construction administrative department and the construction safety supervision institution on the informatization of construction projects, party building, labor market management, etc. For projects that do not meet the relevant requirements, the municipal construction administrative department and the safety supervision institution will order the construction unit to rectify and investigate in accordance with the provisions of relevant laws and regulations. Only after the construction unit has passed the rectification as required and accepted the punishment, can it go through the confirmation procedures for the payment of safety protection and civilized construction measures.
In line with the requirements, the construction safety supervision institution shall, within 5 working days, go through the formalities for confirming the payment of safety protection and civilized construction measures.
Eleventh the implementation of general contracting projects, safety protection, civilized construction measures by the general contractor unified management and timely payment to subcontractors according to the provisions of the subcontract. Subcontractors should put forward special safety protection measures and construction plans, and extract the required expenses after approval by the general contractor. The subcontract shall specify the safety protection, total cost of civilized construction measures, payment method and use requirements of the subcontracted project.
Twelfth engineering supervision units shall conduct on-site supervision on the implementation of safety protection and civilized construction measures by construction units. For the safety protection and civilized construction measures implemented by the construction unit, the chief supervision engineer shall timely review and sign the expenses incurred. If the supervision unit finds that the construction unit fails to implement the safety protection and civilized construction measures in the construction organization design and special construction plan, it shall order it to make immediate rectification; If the construction unit refuses to rectify or fails to complete the rectification within the time limit, the supervision unit shall order it to suspend the construction and report to the construction unit in time, and report to the construction administrative department when necessary.
Article 13 The construction unit shall ensure that the expenses of safety protection and civilized construction measures are earmarked, and make a separate list of income and expenditure of safety protection and civilized construction measures on a project basis in financial management for future reference. The safety production management organization and full-time safety production management personnel of the construction unit are responsible for on-site inspection of the organization and implementation of safety protection and civilized construction measures for construction projects, and relevant inspection records will serve as an important basis for the construction safety supervision organization to handle payment confirmation.
The general contractor shall be fully responsible for the safety protection and civilized construction measures of the construction project. The general contractor shall promptly pay the subcontractor the cost of safety protection and civilized construction measures in accordance with these measures and the contract. If the general contractor fails to pay the fees according to these measures and the contract, resulting in the subcontractors failing to implement safety protection measures in time, resulting in accidents, the general contractor shall bear the main responsibility.
Fourteenth construction units fail to pay the cost of safety protection and civilized construction measures in time according to the regulations, and the construction administrative department shall order it to make corrections within a time limit according to the Regulations on the Administration of Construction Project Safety Production.
Fifteenth construction units misappropriate the cost of safety protection and civilized construction measures, and shall be punished by the construction administrative department in accordance with the provisions of the Regulations on the Administration of Work Safety in Construction Projects.
Article 16 If the construction unit fails to apply for the payment and implementation of safety protection and civilized construction measures in time according to the regulations, the supervision institution will suspend the acceptance of the testing business of related projects.
Seventeenth construction administrative departments and construction safety supervision institutions staff have one of the following acts, by their units or higher authorities in accordance with the relevant provisions shall be dealt with severely:
(1) Handling safety supervision procedures for construction projects that fail to deposit safety protection and civilized construction measures as required;
(two) failing to check the application materials for the payment of construction safety protection and civilized construction measures;
(three) in the construction project safety protection, civilized construction measures fee supervision process, the use of authority for personal gain.
Eighteenth approach by the Nanning Municipal Construction Committee is responsible for the interpretation of.
Nineteenth these Measures shall come into force as of the date of issuance. The original Regulations on the Management of Safety Protection and Civilized Construction Measures in Nanning (Trial) (N.J.Zi. [2009] 1 1No.) shall be abolished at the same time.
