The industrial land mentioned in these Provisions includes ordinary industrial land, new industrial land and logistics storage land, and does not include the above-mentioned land in the village collective reserve. Article 4 The industrial land control line is an integral part of the overall land space planning of this Municipality and the basis for the planning, construction and management of industrial land in this Municipality. Article 5 The control line management of industrial land shall follow the principles of total amount control, strict adherence to the bottom line, classified policies, quality improvement and efficiency improvement. Sixth city natural resources department is responsible for the overall planning and management of the city's industrial land control line.
The competent departments of industry and information technology, commerce and investment promotion are responsible for industrial access, industrial withdrawal and industrial development within the control line of industrial land.
Development and reform, ecological environment, housing and urban and rural construction, urban management and comprehensive law enforcement departments should do a good job in relevant supervision and service according to their respective responsibilities.
The District People's Government (hereinafter referred to as the District Government) is responsible for the daily maintenance and management, project introduction and industry supervision of the industrial land control line within its jurisdiction.
The management institutions of economic functional zones shall perform the corresponding duties of the control line management of industrial land in the district government. Article 7 The control lines of industrial land in this Municipality are divided into primary control lines and secondary control lines.
The first-level control line is the industrial land range line that conforms to the overall planning of municipal land space, including the industrial land supplied and the industrial land used in the planned new industrial land.
The secondary control line is a regional line with industry as the leading function, including all industrial land that has been supplied by the whole city, new industrial land that is not supplied in line with the overall planning of municipal land and space, public services in industrial parks, municipal public facilities, environmental protection, road traffic facilities, green space, square land and so on.
The secondary control line includes the primary control line. Article 8 The total amount of industrial land shall conform to the industrial development plan. The total land area within the industrial land control line of the whole city shall not be less than 30% of the total planned construction land area of the whole city, of which the industrial land area shall not be less than 75% of the total land area within the industrial land control line. Ninth industrial land control line is delineated by the Municipal People's Government (hereinafter referred to as the municipal government), and the municipal natural resources department is responsible for the specific work, following the following procedures:
(a) in conjunction with the municipal competent department of industry and information technology, the municipal competent department of commerce and the municipal competent department of investment promotion, according to the requirements of the city's overall land and space planning and the city's industrial economic development planning, put forward demarcation suggestions and solicit opinions from the district governments;
(two) to organize the preparation of the city's industrial land control line planning;
(three) organize experts to scientifically demonstrate the plan of industrial land control line in the whole city, and form a draft of industrial land control line;
(four) to solicit opinions from the public, and the publicity period shall not be less than 30 days;
(five) to study the opinions of experts and the public and give timely feedback.
The industrial land control line was promulgated and implemented after being approved by the municipal government.
According to the requirements of national economic and social development and the overall planning of national land and space, combined with the actual industrial development of the whole city, the municipal government shall, in principle, conduct an overall assessment of the industrial land control line every five years, and only after it is really necessary and after strict examination and approval can the delineation of the industrial land control line be revised. Article 10 The industrial land within the first-level control line shall be specially protected and strictly managed, and the land use shall not be changed or the regional scope of the first-level control line shall not be transferred, except under the circumstances specified in Article 13 of these Provisions.
Except in the case of Item (4) of Article 14 of the present Provisions, land units that have supplied industrial land within the control line of industrial land shall not apply for changing the land use or transferring the area within the control line.
Urban renewal projects within the industrial land control line prohibit changing industrial land into commercial land or residential land. Eleventh support in the secondary control line, the first control line outside the centralized supporting construction of various service facilities, land use should give priority to the protection of industrial parks supporting public services, municipal utilities, environmental protection, road traffic facilities, green spaces and squares. Twelfth industrial land should be scientifically distributed, concentrated in large industrial parks, small industrial clusters and other diversified industrial space carriers, and promote the multi-level integration of production and city. Thirteenth in addition to the following circumstances, the grade control line shall not be adjusted:
(a) the overall planning of municipal land space has changed;
(two) the needs of major infrastructure construction at or above the municipal level;
(3) Land incorporated into the government reserve according to law.
If adjustments are made in accordance with the provisions of the preceding paragraph, the total scale shall be balanced and the land quality shall be improved. Fourteenth in any of the following circumstances, the secondary control line can be adjusted according to law:
(a) the overall planning of municipal land space has changed;
(two) the needs of major infrastructure construction at or above the municipal level;
(3) Land incorporated into the government reserve according to law;
(four) in accordance with the policies and regulations of the state and Guangdong Province on people's livelihood security, it is used for public service facilities and affordable rental housing, and has been approved for reconstruction according to law.
