"Engineering design" as mentioned in these Regulations refers to the comprehensive design and technical and economic analysis of engineering construction projects, as well as the activities of providing design documents. Fourth engineering survey and design shall abide by the relevant laws and regulations of the state, and implement the national and provincial standards, norms and regulations on engineering construction to ensure the quality of survey and design.
Engineering design should actively adopt mature new technologies, new processes, new materials and new equipment, which not only meets the requirements of environmental protection, but also helps to save resources and improve the comprehensive benefits of construction projects. Article 5 The construction administrative departments of the people's governments at or above the county level shall be responsible for the unified management of the engineering survey and design industry within their respective administrative areas.
Transportation, water and electricity, electric power and other departments shall, in accordance with the provisions of the duties, assist the construction administrative departments to do a good job in the supervision and management of the professional engineering survey and design activities. Chapter II Qualification of Engineering Survey and Design Article 6 An engineering survey and design unit shall apply to the administrative department of construction for the qualification certificate of engineering survey and design and to the administrative department for industry and commerce for a business license before engaging in engineering survey and design business. Units that have not obtained the qualification certificate of engineering survey and design shall not engage in engineering survey and design business. Article 7 When applying for qualification certificate, an engineering survey and design unit shall submit relevant materials in accordance with regulations, which shall be audited by the local municipal (prefectural) construction administrative department and the relevant provincial industry departments, and then reported to the provincial construction administrative department for examination according to the prescribed procedures. Provincial units by the relevant provincial departments in charge of industry audit, according to the prescribed procedures submitted to the provincial construction administrative departments for review.
The qualification of engineering survey and design units is divided into four grades: A, B, C and D according to the standards stipulated by the state. Grade A and Grade B qualification shall be submitted to the national construction administrative department for examination and approval by the provincial construction administrative department according to the prescribed procedures; Grade C and Grade D qualification grades shall be examined and approved by the provincial construction administrative department according to the prescribed procedures. Eighth engineering survey and design units shall undertake business in accordance with the approved qualification grade and the prescribed business scope.
Due to the needs of engineering survey and design business, two or more engineering survey and design units with the same qualification level can carry out joint design. The joint design shall comply with the relevant provisions of the state and the province. Ninth units engaged in engineering survey and design business, should be required to apply for engineering survey and design fees qualification certificate. No fee qualification certificate of the unit shall not charge the owner for engineering survey and design fees. Tenth engineering survey and design personnel engaged in engineering survey and design business, should have the corresponding professional conditions.
Engineering survey and design personnel can only be employed by an engineering survey and design unit to engage in business.
Engineering survey and design units shall abide by the relevant provisions of the state and province when hiring retired engineering survey and design personnel. Eleventh engineering survey and design units to borrow engineering survey and design personnel from other units, shall obtain the consent of the borrowed personnel unit, and sign a written contract. Seconded personnel shall not engage in engineering survey and design business in the original unit at the same time during the secondment period. Twelfth engineering survey and design personnel can provide advice on technical problems of engineering survey and design of other units, but they may not engage in engineering survey and design business in the name of technical consultation. Thirteenth engineering survey and design units shall not accept other units and individuals to engage in engineering survey and design business in the name of the unit.
Engineering survey and design units shall not transfer, lease or lend qualification certificates, drawings and seals, nor shall they affix drawings and seals to engineering survey and design documents compiled by other units and individuals. Chapter III Entrustment and Undertaking of Engineering Survey and Design Business Article 14 An engineering survey and design project entrusted by an owner shall be conducted through bidding.
Engineering survey and design projects with small investment may not be subject to tender. The specific standard of its investment amount shall be stipulated by the municipal (prefectural) people's government and reported to the provincial construction administrative department for the record.
Construction engineering design projects that implement scheme competition may not be subject to bidding.
The people's governments at or above the county level shall not invite tenders for engineering survey and design projects such as confidentiality, emergency rescue and disaster relief.
Wholly foreign-funded and domestic private-invested engineering survey and design projects may not be subject to tender.
For engineering survey and design projects that are not subject to tender, the engineering survey and design unit can be determined by direct entrustment. Fifteenth owners should entrust engineering survey and design projects to engineering survey and design units with corresponding qualification grades, and may not entrust them to individuals or units without corresponding qualification grades.
Engineering survey and design personnel shall not undertake engineering survey and design business in their own names. Sixteenth engineering survey and design units in this province can undertake engineering survey and design business across cities and counties, but they should go through the registration formalities with the construction administrative department where the project is located in advance. No fees shall be charged for registration.
No region or department may, in violation of the provisions of the preceding paragraph, set special conditions for overseas engineering survey and design units to restrict them from undertaking engineering survey and design business locally.
