Article 1 In order to meet the needs of community construction in the new era, build a professional and professional community work team with good political quality, strong professional ability and high service level, and improve the level of community management and service, these measures are formulated in accordance with the spirit of relevant national laws, regulations and policies and combined with the actual situation of this Municipality.
Article 2 The term "community workers" as mentioned in these Measures refers to the staff who are engaged in community management and services in community party organizations, community neighborhood committees and community service stations and have signed service agreements with streets (towns).
Article 3 The basic duties of community workers.
(a) to implement the party's line, principles, policies and national laws and regulations, educate and guide residents to abide by the law, and consciously fulfill their obligations according to law.
(two) to implement the decisions and resolutions of the party organizations and the decisions and opinions of the community residents' meeting, to handle the public affairs and public welfare undertakings of the residents in this community, and to safeguard the legitimate rights and interests of the residents.
(III) Organize and coordinate community units to carry out regional * * * construction activities, unite and lead community residents to carry out spiritual civilization creation activities, actively cultivate social organizations, mobilize social forces to carry out community service activities for the convenience and benefit of the people, and build a new type of community with orderly management, perfect service, civilization and peace.
(four) listen carefully and actively reflect the opinions and suggestions of community residents, and do a good job in the ideological guidance of community residents.
(five) to assist the government and relevant departments to do a good job in social security, public health, social security, employment services, relief and other work related to the interests of community residents.
Districts (counties) and streets (towns) may formulate detailed regulations on the post responsibilities of community workers according to the different positions of community workers and the principle of unity of responsibilities, rights and obligations.
Article 4 The number of community workers shall be determined by each district (county) according to the relevant provisions of the state and Beijing Municipality, combined with the needs of work and the size of the community, and reported to the competent department of the municipal government for the record.
(1) Selection of community workers.
1. Full-time workers of community party organizations. In accordance with the Articles of Association of China * * * Production Party, Provisional Regulations on Grass-roots Organization Election of China * * * Production Party, and Several Provisions on the Work of Community Party Organizations in Beijing (for Trial Implementation), the full-time staff who participated in the election or were appointed as members of community party organizations signed service agreements with the streets (towns), went through relevant procedures and were included in the management of community workers.
2. Full-time workers in community neighborhood committees. In accordance with the Organic Law of People's Republic of China (PRC) Urban Residents' Committee and the relevant provisions of this Municipality, the full-time staff who participated in the election and were elected as members of community residents' committees signed service agreements with streets (towns), went through relevant formalities and were included in the management of community workers.
(2) About recruiting community workers.
In addition to the community workers selected by the above-mentioned community party organizations and community neighborhood committees, the full-time staff of community service stations are also included in the management of community workers. Full-time staff of community service stations are recruited through open recruitment according to the requirements of specialization and professionalism. Candidates should meet the following basic requirements: (1) exemplary compliance with national laws and regulations, good political quality and strong sense of responsibility. (4) College degree or above (recent graduates have bachelor degree or above). (5) Have an urban hukou in this city.
Article 5 Treatment of community workers.
(a) the basic treatment of community workers, including basic salary, seniority allowance, bonuses and other benefits.
1. basic salary. The basic salary of community workers is divided into three grades, namely, the monthly salary of the principal in 720 yuan, the monthly salary of the deputy in 640 yuan and the monthly salary of the ordinary staff in 590 yuan.
2. Length of service allowance. Community workers enjoy seniority allowance according to their posts and actual years of working in the community. The starting post annual allowance for each post is: 960 yuan per person per month for the principal, 845 yuan per person per month for the deputy and 740 yuan per person per month for the general staff. On the basis of the annual assessment, those who pass the assessment and above will be given a regular subsidy every year, with an increase of 50 yuan per person per month. Those who have worked in the community for less than one year will only enjoy the subsidy for the initial post years. If the post changes, the subsidy standard for the service years of the new post shall be set, and the service years shall be calculated cumulatively based on the actual working hours in the community. Eight districts in the city began to count from the month when the fourth community neighborhood committee was elected in 2000, and other districts (counties) began to count from the month when the fifth community neighborhood committee was elected in 2003.
3. Bonus. The bonus is lump sum, and the total amount is approved according to the standard of 3600 yuan per person per year. Bonuses are distributed by streets (towns) according to the posts and assessment of community workers. Each district (county) may also appropriately raise the bonus standard for community workers according to the actual situation of the district (county).
4. Other treatments. According to the relevant regulations of our city, community workers participate in social insurance such as basic pension, medical care, unemployment, work injury and maternity, and enjoy the one-child fee and housing provident fund. Districts (counties) can also increase other benefits appropriately according to the local economic and social development level and the actual community work, and report specific projects and standards to the competent department of the municipal government for the record.
Among the community workers, the secretary of the community party organization, the director of the community neighborhood Committee and the stationmaster of the community service station enjoy full-time treatment; Deputy secretary of the community party organization, deputy director of the community neighborhood Committee and deputy stationmaster of the community service station enjoy deputy treatment; Other staff, enjoy the treatment of ordinary staff. (two) community workers through the national professional level examination of social workers, social workers to obtain professional level certificate, since the completion of the registration month, each person will increase the professional level subsidies to 80 yuan; Obtain the professional level certificate of assistant social worker, and increase the professional level subsidy to 50 yuan every month from the month when registration is completed. Each district (county) may, according to the actual situation, appropriately raise the professional level subsidy standard on this basis.
(three) retirees engaged in community work in community party organizations and community neighborhood committees shall enjoy the corresponding living allowance, and the standard shall be implemented with reference to the seniority allowance and bonus stipulated in the first paragraph of this article.
(4) Recruited community workers who have reached the age of 60 for men and 55 for women shall go through retirement procedures; The appointed community workers may, according to the needs of their work, go through retirement procedures after the expiration of this term. After retirement, community workers will be brought into socialized management, which will be implemented in accordance with the Provisions of Beijing Municipality on Basic Endowment Insurance (Beijing Decree No.2004). Article 6 Management of community workers.
(a) the implementation of service agreement system. According to the "Regulations on the Implementation of the Labor Contract Law of the People's Republic of China" and other laws and regulations, streets (towns) will sign service agreements with qualified community workers. Members of community party organizations and community neighborhood committees sign for one term; The term of service agreement for full-time staff of community service stations shall be determined by each district (county). The text of "Beijing Community Worker Service Agreement" is unified in the whole city, and all districts (counties) can make supplementary provisions in the text of the agreement as needed.
(2) Establish an assessment system. During the service period of community workers, the annual assessment system is implemented. By the street (township) to guide the establishment of representatives of residents, representatives of community units, street (township) functional departments to participate in the assessment committee, at the end of each year to conduct an annual assessment of community workers. The assessment results are divided into four grades: excellent, qualified, basically qualified and unqualified. The assessment should be based on the completion of the annual tasks of community workers and the satisfaction rate of community residents. According to the annual assessment results, rewards and punishments will be given to community workers in accordance with relevant regulations.
(3) Improve the education and training system. According to the principle of professional training and graded responsibility, establish and improve the education and training mechanism of community workers. The relevant departments of the city are responsible for formulating training plans and training plans, and organizing the preparation of training materials and teacher training. According to the unified arrangement of the whole city, the district (county) organizes community workers to participate in a centralized training every year, and the training results are included in the work files of community workers as one of the annual assessment basis.
(4) Improve the file management system. Streets (townships) should improve the work files of community workers and establish a database. The contents of the file include: basic information of community workers themselves, starting time of community work, post change, assessment, training and commendation, etc. The work files of community workers in eight districts of the city began to be established when the fourth community neighborhood Committee was elected in 2000, and the work files of community workers in other districts (counties) began to be established when the fifth community neighborhood Committee was elected in 2003.
The file relationship of community workers is represented by the service organization designated by the district (county).
(five) the implementation of flexible working hours system. In order to facilitate residents to handle related affairs in the community during work breaks, community neighborhood committees and community service stations can implement flexible working hours. On the premise of meeting the service needs of the masses and working hours not less than 40 hours per week, we can determine the relatively flexible commuting time and the number of workers in each shift according to the actual situation, and arrange rest time and duty on holidays.
(6) Explore the vocational qualification system. Adapt to the professional and professional needs of community work, and gradually establish and improve the professional qualification system. Community workers, especially the newly recruited community service station staff, generally hold the professional grade certificate of national social workers (social workers and assistant social workers) or the professional qualification certificate of Beijing community full-time workers (within the validity period); Those who have worked in community workers' posts but have not obtained professional level certificates should be encouraged to obtain professional level certificates through on-the-job training and academic education.
Seventh community workers in recognition and reward. City, district (county) Party committees and governments shall commend and reward outstanding community workers who have made remarkable achievements in community construction. According to the performance of community workers and the evaluation of the masses, community workers with outstanding performance and high satisfaction of residents are selected and commended in a hierarchical and systematic manner to fully mobilize the enthusiasm of the majority of community workers.
Article 8 Full-time staff who have been engaged in community management and service in community party organizations and community neighborhood committees, if their employment contracts are still valid, can enjoy corresponding treatment in accordance with the relevant provisions of these Measures (their treatment will be adjusted from June 65438+ 10/day, 2008). After the next general election, those who meet the relevant provisions of these Measures shall implement the service agreement system in a unified manner and enjoy the treatment as stipulated in these Measures.
At present, relevant personnel who have worked in community service stations can participate in open recruitment in accordance with the relevant provisions of the second paragraph of Article 4 of these Measures. Those who meet the requirements will be hired as community workers, and sign a service agreement with the street (town) to enjoy the corresponding treatment; Those who do not meet the recruitment requirements are either trained on the job to gradually meet the requirements, or properly placed through job transfer. Each district (county) should formulate specific transitional measures according to the actual situation.
Ninth people engaged in community work in community party organizations and community neighborhood committees should also be given certain subsidies. Its treatment and related management regulations are determined by each district (county) according to the specific situation.
Tenth community workers treatment funds by the district (county) financial burden.
Eleventh districts (counties) can formulate specific implementation rules according to these measures. After the implementation of these measures, if it is otherwise stipulated by the state, it shall be implemented in accordance with the relevant provisions.
Article 12 These Measures shall be tried out as of the date of promulgation. The Management Opinions of Beijing Community Full-time Workers (No.89 [2002] of Beijing Municipality) and the Guiding Opinions on Further Strengthening the Construction of Community Full-time Workers (No.298 [2005] of Beijing Municipality) shall be automatically abolished as of the trial date of these Measures.
Responsibilities of community workers
