Materials to be submitted:
1, applicant's ID card (domestic residents need to provide ID cards and household registration books, Hong Kong, Macao and Taiwan residents need to provide ID cards and passports, and foreigners need to provide passports);
2. Where an agent is entrusted to apply on his behalf, a power of attorney and the identity certificate of the agent shall be provided, and the legal agent or other agent shall submit a power of attorney;
3. Proof of applying for birth notarization (with the opinions of the personnel department of the unit where the applicant's file is located and stamped with the official seal); If the above certificates cannot be provided, corresponding certificates issued by other authorities can be provided. If the household registration book directly reflects the relationship between parents and children in the same book, this certificate is not needed;
4. Identity documents of the applicant's parents (domestic residents need to provide ID cards and household registration books, Hong Kong, Macao and Taiwan residents need to provide ID cards and passes, and foreigners need to provide passports such as ID cards, household registration books or passports). If one or both parents die, a death certificate shall be provided;
5. Marriage certificate of the applicant's parents (divorce certificate, divorce agreement or effective court judgment documents are required if the parents are divorced);
6. If the applicant has moved abroad, provide the personal information form of permanent residents or the certificate of cancellation of household registration issued by the local police station where the original household registration is located (indicate the applicant's birthplace);
7. Birth certificate or birth medical certificate; If there is no birth certificate, other supporting materials reflecting the birth facts shall be provided as appropriate, such as the one-child certificate, hospital delivery materials, personnel files issued by the personnel file management department (stamped with the seal of the file storage unit), family planning service certificate, etc. ;
8. If the notarial deed is used overseas, the applicant shall provide the recent one-inch photos of the notarial deed (No.:number of notarial deeds required+1), and the photos provided shall be consistent with the photos attached to the application form. If the notarial certificate is sent to the United States, South Korea, Austria and other countries for use, 4 photos will be provided, with an increase of 1 photo, and a corresponding increase of 1 photo;
9. Other supporting materials related to the application for notarization.
Remarks: If a child born out of wedlock applies for birth notarization, it shall be handled in accordance with the provisions of the Ministry of Justice. Please consult a specific notary.
The parties concerned shall apply to the foreign-related notary office of their domicile or birthplace for birth notarization. A party who has been abroad shall apply to the notary office of his last residence in China. Generally speaking, notarial certificates are handled in notary offices, but not all notary offices can handle birth notarization. The following is the specific location for birth notarization.
1. Birth notarization can be done in a notary office, but it must be a notary office recognized by the embassy. Because birth notarization belongs to foreign notarization, it is a notarial certificate obtained from abroad, so additional recognition certificate is needed. Notary offices in big cities can handle it.
2. Embassies and consulates can also handle notarial certificates, and many notarial certificates need to be certified, which means that double certification must be handled in these two museums. But there are many people waiting in line at the embassy, which is complicated and expensive.
Notices for notarization of birth certificate are as follows:
1. The names of the parties in the notarial certificate shall be true. If there are special requirements, it must be carefully examined and verified before it can be proved. The names of the parties should be simplified. In foreign language translation, Chinese Pinyin should be used. In order to facilitate the parties to use the notarial certificate, if there is a previous name, it should be proved on the notarial certificate at the same time after the valid certificate.
2. The date of birth of the parties in the notarial certificate is one of the core contents of the notarial certificate. It must be accurate, true and have conclusive evidence. The date of birth is based on the identity card; If there is no identity card, the household registration certificate or birth certificate shall prevail; If there is no such certificate, refer to other certificates (such as files and passports) and adopt the Gregorian calendar. The date of birth of the lunar calendar may be indicated in brackets if the notarized parties require otherwise.
3. The birthplace of the parties in the notarial certificate shall be clear and specific, and the full name of the place name shall be written. The address of birth should be written in the city or county, and according to the requirements of the place of use (country), it can also be written in the township, village or town street. If the place name of the party concerned changes at birth, the full name of the place name shall be indicated in brackets after the current place name.
4. The parents of the parties to the birth certificate should indicate the names of their biological parents. If parents die, it should be indicated in brackets. If the party concerned has been adopted by others, the names of the adoptive parents shall be indicated. The birth certificate of a child born out of wedlock may omit the name of the biological father at the request of the parties concerned.
5. If the date of the identity documents provided by the parties is inconsistent with the date on the overseas documents (such as passports and passes), and the change is proposed, if the inconsistency is caused by the work error of the original issuing authority, the parties shall go to the issuing authority for notarization after correction. If the notary lied about his age in order to go abroad at that time, he should be notarized according to his real age after finding out.
6. If a party who has gone abroad has obtained a birth certificate, and the notary office has not found any clues after investigation, it may issue a "notarial certificate without records" for the party concerned. In the United States and other countries, this notarial certificate can be used as supporting evidence.
7. The notary office can only handle birth certificates for China citizens or foreigners born in China. People born abroad should obtain birth certificates from local authorities if they need such certificates.
