The planned port area refers to the reserved waters and land areas with clear boundaries defined for the further development and construction of the port according to the overall layout plan of Xiamen Port. Article 4 The Municipal People's Government shall incorporate the port industry into the national economic and social development plan and organize its implementation.
The Municipal People's Government exercises macro-control over the port development, and the port development adopts a combination of government investment and social investment. Article 5 The municipal port administrative department shall manage the port industry of this Municipality according to law and organize the specific implementation of these Regulations.
The relevant administrative departments and organizations authorized by laws and regulations shall do a good job in port management according to their respective responsibilities. Chapter II Port Planning Article 6 The overall layout planning of Xiamen Port shall conform to the port layout planning of the State and Fujian Province, as well as the overall urban planning and sea area functional zoning of this Municipality.
The overall layout planning of Xiamen Port includes: port scale, nature, function, throughput development level, port boundary, planned port division, port scope, water area layout, land area layout, land and water area utilization, shoreline utilization, environmental protection, land allocation for various facilities construction and phased construction plan. Article 7 The overall layout plan of Xiamen Port shall be compiled by the municipal port administrative department, and after comprehensive balance by the municipal planning department, it shall be submitted to the Municipal People's Government for examination and approval in accordance with the relevant provisions of the state. Article 8 The planning of each port area of Xiamen Port shall be organized and compiled by the municipal port administrative department according to the overall layout planning of Xiamen Port, reviewed by the municipal planning department and reported to the Municipal People's Government for approval.
The main contents of port planning include: the scope and scale of port operation, the layout of land and water functional areas, supporting auxiliary production facilities, environmental protection and phased construction plan. Article 10 The overall layout planning and port area planning of Xiamen Port shall be organized and implemented by the municipal port administrative department. Article 14 The design, construction and supervision bidding of port infrastructure projects shall be supervised by the municipal port administrative department within the scope of duties according to law, and shall be subject to the supervision and management of the municipal construction administrative department. Fifteenth port facilities construction engineering quality supervision in accordance with the relevant provisions of the state by the port engineering quality supervision institutions. Sixteenth port facilities construction project completion acceptance, organized or participated by the municipal port administrative department according to legal procedures. Chapter IV Port Management Article 17 Whoever engages in loading and unloading, warehousing, ship tally and barge towing business in the port area shall meet the conditions stipulated by the state, and go through the formalities with the relevant departments according to law after being examined and approved by the municipal port administrative department.
Enterprises applying for the establishment of waterway transportation or road transportation business in the port area shall go through the formalities with the relevant administrative departments in accordance with the provisions. Article 18 The operator or agent of a commercial ship shall, before the ship arrives in Hong Kong, report the ship's dynamic, berthing and berthing plan to the municipal port administrative department in accordance with regulations and apply for pilotage, subject to the management and supervision of the municipal port administrative department.
For the materials and goods that need to be transported first, such as the blockade of ports by the state and ships, emergency rescue and disaster relief, the municipal port administrative department may implement unified arrangements, organize priority operations, and take necessary dispatching measures. Enterprises, units, individuals, ships and vehicles engaged in port business shall be subject to management. Nineteenth municipal port administrative departments shall be responsible for the supervision and inspection of port production and operation, supervise the safety, quality and hygiene of port operation, and maintain the order of port production and operation. Twentieth port special operations personnel to implement the system of certificates. The municipal port administrative department shall cooperate with the municipal comprehensive management department of production safety to train the port special operators, and the municipal comprehensive management department of production safety shall conduct assessment and issue certificates. Twenty-first municipal port administrative departments shall collect and regularly publish domestic and foreign port information, and provide necessary domestic and foreign port production and operation information consulting services for enterprises engaged in port business.
Enterprises engaged in port business shall submit statistical statements and materials to the municipal port administrative department in accordance with relevant regulations.
