Regulations of Jiangsu Province on Social Credit

Chapter I General Provisions Article 1 In order to strengthen social credit management, standardize social credit services, improve the social credit system, protect the legitimate rights and interests of credit subjects, improve the level of social credit, and promote the modernization of governance system and governance capacity, these Regulations are formulated in accordance with relevant laws and administrative regulations and combined with the actual situation of this province. Article 2 These Regulations shall apply to activities such as the construction of social credit system, the determination of credit status, credit management and service, credit incentive and restraint, and the protection of the rights and interests of credit subjects within the administrative area of this province.

Where there are other provisions in laws and administrative regulations on credit investigation and enterprise information publicity, those provisions shall prevail. Article 3 The term "social credit" as mentioned in these Regulations refers to the state that natural persons, legal persons and unincorporated organizations with full capacity for civil conduct (hereinafter referred to as credit subjects) abide by legal obligations and perform agreed obligations in social and economic activities. Article 4 The term "credit information" as mentioned in these Regulations refers to objective data and materials that can be used to identify, analyze and judge the credit status of credit subjects, including public credit information and market credit information.

Public credit information refers to the credit information generated and obtained by state organs, organizations and people's organizations authorized by laws and regulations to manage public affairs (hereinafter referred to as public credit information providers) in the process of performing their duties and providing public services according to law, including basic information, untrustworthy information and other information.

Market credit information refers to the credit information generated and obtained by credit service institutions, trade associations, chambers of commerce and other enterprises and institutions that implement credit management for trading customers in production and operation or industry self-discipline management activities. Article 5 The construction of social credit system shall follow the principles of government promotion, social construction, compliance with laws and regulations, protection of rights and interests, fairness and openness, and combination of rewards and punishments. Article 6 The local people's governments at or above the county level shall strengthen their leadership over the construction of social credit system, incorporate the construction of social credit system into the national economic and social development plan, organize the preparation of the construction plan of social credit system, strengthen the guarantee of institutions, personnel and funds, and establish and improve the coordinated promotion mechanism.

The leading group for the construction of social credit system established by local people's governments at or above the county level is responsible for promoting the construction of social credit system as a whole and studying and deciding on major issues in the construction of social credit system. The comprehensive management department of social credit determined by the local people's governments at or above the county level shall undertake the daily work of the leading group.

Other departments of local people's governments at or above the county level shall, according to their respective responsibilities, do a good job in the construction of social credit system. Seventh social credit system construction should give full play to the role of trade associations, chambers of commerce and other social organizations, encourage and guide social forces to participate in credit management, service and supervision. Eighth units and individuals that have made outstanding contributions in the construction of social credit system shall be commended and rewarded in accordance with the relevant provisions of the state and the province. Chapter II Construction of Social Credit System Article 9 This province shall establish and improve the social credit system, and strengthen the integrity construction in key areas such as government integrity, business integrity, social integrity and judicial public trust. Tenth people's governments at all levels, relevant departments and their staff should perform their duties according to law, honest administration, improve the transparency of decision-making, enhance the credibility of the government, and play an exemplary role in the construction of social credit system.

People's governments at all levels and relevant departments shall fulfill the policy commitments made to market players according to law and all kinds of contracts concluded according to law, and shall not break the contract on the grounds of adjustment of administrative divisions, change of government, adjustment of institutions or functions, and replacement of relevant responsible persons. If the policy commitment or contract agreement needs to be changed due to the interests of the state and society, it shall be carried out in accordance with the statutory authority and procedures, and the market participants shall be compensated according to law.

The province has established an accountability system for government dishonesty. If people's governments at all levels and relevant departments violate laws and regulations in the process of performing their duties and are held accountable according to law, relevant information shall be included in the record of government dishonesty.

The province has established a monitoring, management and evaluation system of government integrity to prevent and resolve the risk of government dishonesty and improve the level of government integrity. Article 11 Market participants should enhance their awareness of the rule of law and the spirit of contract, abide by laws, regulations and trade conventions, perform their duties in good faith and compete fairly.

Encourage market players to establish and improve the internal credit management system, improve credit management capabilities, guard against credit risks, and participate in credit management demonstration activities.

The local people's governments at or above the county level and their relevant departments shall establish and improve the life-cycle credit management system of market participants, and strengthen credit management and services in the fields of safety production, product quality, trade circulation, finance, taxation, engineering construction, transportation, e-commerce, intermediary services and off-campus training. Twelfth members of society should follow the principle of good faith, practice socialist core values, abide by laws and regulations, and adhere to honesty and trustworthiness.

Members of society should establish credit awareness, pay attention to their own credit status and safeguard their good credit.

The local people's governments at or above the county level and their relevant departments should strengthen the construction of social integrity, promote the innovation of credit management methods in social governance, and strengthen credit management and services in the fields of labor protection, social security, education and scientific research, medical and health care, cultural tourism, ecological environment and Internet application services.

The local people's governments at or above the county level and their relevant departments shall strengthen the construction of professional credit for key groups, popularize the use of professional credit reports, and guide the construction of professional ethics and codes of conduct.
