Measures of Zhejiang Province for the Administration of Local Standards

Chapter I General Provisions Article 1 In order to standardize the management of local standards, ensure the quality of products, projects, services and the environment, and promote the sustainable development of economy and society, these measures are formulated in accordance with the provisions of the Standardization Law of People's Republic of China (PRC), the Regulations for the Implementation of the Standardization Law of People's Republic of China (PRC), the Regulations for the Administration of Standardization of Zhejiang Province and other laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the formulation, implementation, supervision and management of local standards within the administrative region of this province.

Where laws and regulations provide otherwise, such provisions shall prevail. Article 3 The people's governments at or above the county level shall strengthen their leadership over the work of local standards, and support the research, formulation and implementation of local standards related to the protection of human health, environmental protection, energy conservation and the quality of engineering construction. Fourth provincial quality and technical supervision administrative departments unified management of local standards in this province. City, county (city, district) quality and technical supervision administrative department is responsible for the relevant work of local standard management within their respective administrative areas.

The administrative departments of health, science and technology, environmental protection, economy and informatization, agriculture, housing and urban and rural construction shall, according to their respective duties, do a good job in the management of local standards.

Professional standardization technical committees, trade associations and other organizations carry out work related to local standards in accordance with the provisions of laws, regulations and articles of association. Fifth provincial administrative departments of quality and technical supervision should strengthen the research on standardization issues at home and abroad, learn from international successful practices, and timely organize the formulation or revision of relevant local standards; In conjunction with the provincial intellectual property administrative department, the independent innovation achievements will be transformed into local standards in a timely manner. Article 6 Enterprises and institutions, scientific and technological research institutions, institutions of higher learning, professional societies and standardization academic organizations are encouraged to actively undertake or participate in the research, formulation, consultation and popularization of local standards.

Encourage product producers to give priority to foreign advanced standards or international standards that are stricter than national standards, industry standards and local standards. Chapter II Scope of Formulation Article 7 Local standards (including the preparation of standard samples, the same below) may be formulated if the technical and management requirements of industry, agriculture (including forestry, animal husbandry and fishery), service industry, engineering construction and environmental protection need to be unified in the province. Article 8 Local standards are divided into mandatory standards and recommended standards. Mandatory local standards include full-text mandatory and provision mandatory. Article 9 Compulsory local standards mainly include the following technical and management requirements:

(1) Requirements for safeguarding human health and personal and property safety;

(2) Safety and hygiene requirements for products and their production, storage, transportation and use;

(3) Food safety and hygiene requirements;

(four) the quality and safety requirements of engineering construction and other engineering construction requirements that need to be controlled in this province;

(five) pollutant emission limits and environmental quality requirements;

(six) energy and resource conservation requirements;

(seven) other technical and management requirements that must be implemented in accordance with laws and regulations. Chapter III Project Establishment and Drafting Article 10 The administrative department of quality and technical supervision of the province shall, in accordance with the needs of the economic and social development of the province and the relevant provisions of the state, jointly with the relevant administrative departments of the province, put forward plans for formulating local standards. Eleventh relevant units or individuals may, according to the needs, put forward suggestions to the provincial and municipal administrative departments of quality and technical supervision and the relevant administrative departments of the province or the provincial professional standardization technical committee.

Encourage scientific and technological research institutions, universities, enterprises and institutions to put forward suggestions on transforming independent innovation achievements into local standards. Twelfth provincial administrative departments of quality and technical supervision shall, jointly with the relevant administrative departments of the province, conduct expert evaluation and demonstration on the necessity, feasibility and implementation impact of formulating local standard project proposals, and determine the local standard planned projects. Thirteenth projects included in the local standard formulation plan shall specify the standard drafting unit and completion time; Local standard-setting projects supported by financial funds shall determine the standard drafting unit through bidding in accordance with the relevant provisions of the province. Fourteenth standard drafting units shall formulate norms and organize the drafting of local standards according to the relevant national standards, and solicit opinions from producers, operators, users and other relevant parties. Where local standards need to be compared with standard physical samples, corresponding standard physical samples shall be made. Fifteenth local standards involve quantitative provisions such as limit and composition requirements, and the standard drafting unit shall conduct experimental verification; The drafting unit of local standards involving test methods shall conduct laboratory comparison and verification. The standard drafting unit shall be responsible for verifying the authenticity of the data. Chapter IV Examination and Approval Article 16 Local standards shall be examined and approved by the Local Standards Review Committee (hereinafter referred to as the Review Committee). The evaluation committee is composed of experts from the provincial administrative department of quality and technical supervision or the relevant administrative departments of the province to organize relevant professional standardization technical committees, trade associations, professional societies, scientific and technological research institutions and other units. The members of the review committee are generally not less than 7; When necessary, representatives of consumers and users may be invited to participate. Article 17 The review committee shall review whether the submitted local standard texts conform to the provisions of laws, regulations and rules, whether they are in harmony with relevant national standards and industry standards, the scientific, reasonable and operable main technical contents, and the implementation impact of mandatory provisions.

Where the local standard text submitted for review involves quantitative provisions such as limit and composition requirements, the review committee shall review and evaluate the verification materials.

If the review committee cannot reach an agreement on the review conclusion and needs to vote, it shall be approved by not less than 3/4 members.

The relevant contents of the review, the opinions of the reviewers and the review conclusions shall be recorded in written form and filed for future reference after being signed by the reviewers.
