In order to continuously deepen the reform of government procurement, closely focus on the reform goal of "simplifying administration and decentralization, strengthening supervision and improving services" and promote the high-quality development of financial work, the relevant work on optimizing the filing of government procurement contracts is hereby notified as follows:

First, improve ideological understanding and strengthen the main responsibility.

The purchaser should fully realize that the management of government procurement contract is an important part and key link of government procurement activities, an important guarantee to achieve "value for money" in government procurement, and it is of great significance to improve the efficiency of the use of financial funds, enhance procurement efficiency and safeguard the legitimate rights and interests of procurement parties. The purchaser is the executive subject of the government procurement contract management of the unit, and should earnestly perform the main responsibility, strictly implement the relevant laws and regulations on government procurement, and seriously standardize the signing, filing, publicity and change of government procurement contracts.

Second, optimize the main contents of contract filing.

The way of contract filing is changed from examination and approval to announcement and publicity. The announcement, publicity and filing of government procurement contracts are carried out simultaneously, and the contract filing can be completed by submitting the contract.

(A) the scope of the contract for the record

Government procurement contracts above the centralized procurement quota standard need to be filed. The parties to a government procurement contract shall not alter, suspend or terminate the contract without authorization. If it is really necessary to change due to special circumstances, it is necessary to handle the change contract for the record.

There is no need to file a government procurement contract for the engineering projects organized by the construction project bidding business branch of Shenzhen Trading Group, the procurement projects directly placed in the electronic mall of Shenzhen Trading Group and the self-procurement projects.

(II) Contract filing platform

Click the "Contract Management" function on the Shenzhen Municipal Government Procurement Smart Platform (zfcg.szggzy.com) to complete the contract filing operation (see Annex 1 for the operation guide of Shenzhen Municipal Government Procurement Smart Platform contract filing). The former Shenzhen Municipal Government Procurement System (www.szzfcg.cn) stopped accepting contract filing and reserved the inquiry function.

(three) the process and information of contract filing

1. Announcement and filing of the contract

Check against the purchaser's government procurement contract self-inspection form (see Annex 2 for details) to confirm that it meets the relevant requirements, fill in the contract information according to the system prompt, upload and scan the contract, confirm the submission, and the system will automatically announce and complete the contract filing.

2. Publicity and filing of change contract.

Contract changes shall be handled in accordance with the Notice on Further Strengthening the Management of Municipal Contract Filing (Purchase [2019] No.43).

Check against the purchaser's government procurement contract self-inspection form to confirm that it meets the relevant requirements, fill in the change publicity information according to the system prompt, upload the change certification materials and the scanned copy of the change contract, confirm the submission, and the system will automatically publicize it. If no objection is received after 5 working days, the contract shall be changed for the record.

Confidentiality contracts should follow a separate filing procedure.

Three. Work requirements for contract filing

(1) Establish and improve the internal control mechanism and strengthen the management of procurement contracts.

The purchaser shall, in accordance with the requirements of the Notice of Shenzhen Municipal Bureau of Finance on Printing and Distributing the Measures for the Administration of Responsibility System for Government Procurement of Buyers at the Same Level in Shenzhen (No.27 [2019]), establish and improve the internal control system of government procurement of the unit, define the responsible departments and persons of government procurement, standardize the operation of each link, implement internal audit of procurement contracts and strengthen process control.

(2) Sign contracts according to laws and regulations, and standardize contract filing.

The purchaser shall sign the procurement contract according to the Civil Law of People's Republic of China (PRC), the requirements of relevant laws and regulations on government procurement and the provisions of the bidding documents. The substantive contents of a procurement contract shall conform to the provisions of the tender documents.

According to the Regulations of Shenzhen Special Economic Zone on Government Procurement, the purchaser shall sign the government procurement contract within 10 working days from the date of issuing the bid-winning notice; According to the Notice of the Ministry of Finance on the Disclosure of Government Procurement Information (Caiku [2065 438+05] 135), the contract shall be announced and filed within 2 working days from the date of signing.

(3) Fill in relevant information carefully to ensure the quality of contract filing.

The purchaser shall carefully fill in the relevant contract information, check the integrity of the uploaded contract information, and ensure the truthfulness, accuracy and completeness of the contract filing information. The contract amount and information of the payee shall comply with the provisions of the Audit Rules for Centralized Payment by the State Treasury of Shenzhen (Fu [2022] 1No.).

Four, the supervision and management of contract filing and supporting guarantee

The Municipal Finance Bureau will supervise and manage the contract filing work. Establish a spot check mechanism for contract filing, conduct spot checks on registered contracts, and establish a spot check ledger. The problems found, according to the situation in accordance with the law; If the contract is not announced, publicized or filed in accordance with the law, it shall be handled in accordance with the Notice on Further Strengthening the Management of Municipal Contract Filing (Shencaigou [2019] No.43).
