Provisions on the management of construction project supervision and related service charges

Excerpted from the Notice of the Ministry of Construction of the National Development and Reform Commission on Printing and Distributing the Development and Reform Price No.670 [2007].

In order to standardize the charging behavior of construction project supervision and related services, safeguard the legitimate rights and interests of both entrusting parties, and promote the healthy development of the engineering supervision industry, the National Development and Reform Commission and the Ministry of Construction jointly issued the Regulations on the Management of Construction Project Supervision and Related Services Charges, which came into effect on May 1 2007. Provisions on the management of construction project supervision and related service charges (full text)

Article 1 These Provisions are formulated in accordance with the Price Law of People's Republic of China (PRC) and other relevant laws and regulations in order to standardize the charging behavior of construction project supervision and related services, and safeguard the legitimate rights and interests of the employer and the supervisor.

Article 2 Construction project supervision and related services shall follow the principles of openness, fairness, impartiality, voluntariness, honesty and credibility. For a construction project that must be subject to tender according to law, the supervision unit shall be determined through tender. Technical factors such as the reputation of the supervision unit and the advantages and disadvantages of the supervision scheme should be given priority in the bidding of supervision services.

Article 3 The employer and the supervisor shall abide by the provisions of the relevant state laws and regulations on price and accept the supervision and management of the competent price department of the government.

Article 4 According to the different nature of construction projects, construction project supervision and related service charges shall be subject to government-guided prices or market-regulated prices respectively. The supervision fee for the construction stage of a construction project that must be supervised according to law shall be subject to government guidance price; Supervision fees in other construction stages and supervision and related service fees in other stages shall be subject to market adjustment prices.

Article 5 The benchmark price of supervision fee in the construction stage of a construction project subject to government guidance price shall be calculated according to the construction project supervision and related service standards, with a floating range of 20%. The employer and the supervisor shall, according to the actual situation of the construction project, negotiate and determine the amount of expenses within the prescribed floating range. Construction project supervision and related service fees shall be subject to market adjustment price, which shall be determined by the employer and the supervisor through consultation.

Sixth construction project supervision and related service charges, should reflect the principle of high quality and good price. On the premise of ensuring the quality of the project, if the supervision and related services provided by the supervisor save investment, shorten the construction period and achieve remarkable economic benefits, the employer may reward the supervisor in accordance with the contract.

Article 7 Supervisors shall inform the employing units of the service items, service contents, service quality, charging basis and charging standards in accordance with the provisions of clearly marked prices for goods and services.

Article 8 The contents, quality requirements, corresponding expenses and payment methods of construction project supervision and related services shall be agreed by the employer and the supervisor in the supervision and related service contract.

Article 9 The supervision and related services provided by the supervisor shall conform to the relevant national laws, regulations and standards, and meet the service content and quality requirements agreed in the contract. Supervisors shall not violate the standards, norms or the provisions of the contract, and engage in vicious competition by lowering the service quality and service content, thus disrupting the normal market order.

Article 10 If the workload of construction project supervision and related services increases or decreases due to reasons other than the supervisor, the employer shall negotiate with the supervisor to pay or deduct the corresponding supervision and related service fees according to the contract.

Article 11 If the workload of supervision and related services increases due to the supervisor's reasons, the employer will not pay the supervision and related service fees separately.

If the supervision and related services provided by the supervisor do not conform to the relevant national laws, regulations and standards, and the supervision service personnel, professional level and service time provided do not meet the requirements of supervision work and the service content and quality requirements agreed in the contract, the employer may deduct the corresponding supervision and related service fees according to the contract.

If the supervisor's work mistakes cause economic losses to the employer, the supervisor shall bear the corresponding liability for compensation as agreed in the contract.

Twelfth in violation of these provisions and the provisions of the relevant state laws and regulations on price, the competent price department of the government shall be punished according to the "People's Republic of China (PRC) Price Law" and the "Provisions on Administrative Punishment of Price Violations".

Thirteenth the provisions and the attached "construction project supervision and related service charges", by the National Development and Reform Commission in conjunction with the Ministry of construction is responsible for the interpretation of.

Article 14 These Provisions shall come into force as of May 1 2007, and the service contracts signed before the implementation of these Provisions and the related expenses of the projects under construction shall not be adjusted. The Notice of the former State Price Bureau and the Ministry of Construction on Issuing the Relevant Provisions on Engineering Construction Supervision Fees ([1992] No.479) shall be abolished at the same time. Where the relevant provisions formulated by relevant departments and localities in the State Council are in conflict with these Provisions, these Provisions shall prevail.

Charging Standards for Construction Project Supervision and Related Services (Abstract)

1 general rules

1.0. 1 Construction project supervision and related services refer to the services that the supervisor accepts from the employer to provide quality, schedule and cost control and coordination management services in the aspects of safety production supervision and management, contracts and information, as well as related services in the stages of survey, design and warranty. See Main Work Contents of Construction Engineering Supervision and Related Services (attached table 1) for the work contents of each stage.

1.0.2 the cost of construction project supervision and related services includes the cost of project supervision in the construction stage of the construction project (hereinafter referred to as "construction supervision") and the cost of related services such as survey, design and warranty (hereinafter referred to as "related services in other stages").

1.0.3 The construction supervision service fees for railway, waterway, highway, hydropower and reservoir projects shall be calculated according to the fixed charging method for construction and installation engineering fees. The construction supervision service fee of other projects is calculated according to the investment quota charging method of construction project budget estimate.

1.0.4 related service fees at other stages are generally charged according to the man-days required for related service work and the daily expense standard for employees of construction project supervision and related service providers (Table 4).

1.0.5 The construction supervision service fee is calculated according to the following formula:

(1) construction supervision service fee = benchmark price of construction supervision service fee × (1 floating range value)

(2) benchmark price of construction supervision service fee = benchmark price of construction supervision service × professional adjustment coefficient × engineering complexity adjustment coefficient × elevation adjustment coefficient.

1.0.6 base price of construction supervision service fee

The basic price of construction supervision service fee is the price to complete the basic service content of construction supervision stipulated by national laws, regulations and norms. The basic price of construction supervision service fee is determined according to the Basic Price Table of Construction Supervision Service Fee (Attached Table 2). If the charge amount is within two numerical ranges, the base price of the project supervision service fee is determined by linear interpolation method.

1.0.7 benchmark price of construction supervision service fee

The benchmark price of construction supervision service charge is the benchmark charge amount of construction supervision service calculated according to the benchmark price specified in this charging standard and 1.0.5(2). According to the actual situation of the project, the employer and the supervisor negotiate to determine the contract amount of the project supervision service fee within the specified floating range.

1.0.8 Billing amount of construction supervision service fee

If the construction supervision service fee adopts the method of charging the construction project budget investment quota, the amount of charging is the sum of the construction and installation project fee, equipment purchase fee and joint debugging fee in the project budget investment, which is the project budget investment. For projects where the equipment purchase fee and joint debugging fee account for more than 40% of the estimated investment, the construction and installation fees are all included in the invoiced amount. However, the invoiced amount shall not be less than the invoiced amount of projects with the same construction and installation costs, equipment purchase costs and joint debugging costs equal to 40% of the estimated investment of the project.

If the original equipment is used in the project and installation and commissioning services are carried out, the current price of similar equipment at the time of signing the project supervision contract shall be taken as the charging amount of the project supervision service; If there is delayed equipment in the project, it should be deducted from similar equipment when signing the project supervision contract, and converted into RMB according to the FOB price of the purchased equipment as the billing amount of the project supervision service fee.

If the engineering supervision service fee is charged according to the construction and installation engineering fee quota, the charging amount is the construction and installation engineering fee in the project budget.

The estimated investment amount of construction project or construction and installation project fee as the charging amount of construction supervision service refers to the charging amount of the project scope agreed in each supervision contract.

1.0.9 Adjustment coefficient of construction supervision service fee

The adjustment coefficient of construction supervision service fee includes: professional adjustment coefficient, engineering complexity adjustment coefficient and elevation adjustment coefficient.

(1) Professional adjustment coefficient is a coefficient to adjust the complexity and workload difference of construction supervision of different professional construction projects. When calculating the construction supervision service fee, the professional adjustment coefficient is shown in the Table of Professional Adjustment Coefficient of Construction Supervision Service Fee (Annex III).

(2) The adjustment coefficient of engineering complexity is the coefficient to adjust the complexity and workload difference of construction supervision of the same professional construction project. The complexity of the project is divided into three levels: general, complex and complex, and the adjustment coefficient is: general (level 1) 0.85; More complex (level 2)1.0; Complex (level 3) 1. 15. When calculating the construction supervision service fee, the complexity of the project should be found in the table of engineering complexity in the corresponding chapter.

(3) The elevation adjustment coefficient is as follows:

The elevation below 200 1m is 1.

1. 1 at an altitude of 200/~ 3000m.

The altitude of 300 1~3500m is 1.2.

The altitude of 350 1~4000m is 1.3.

When the elevation is above 400 1m, the elevation adjustment coefficient shall be determined by the employer and the supervisor through consultation.

1.0. 10 The employer subcontracts part of the construction supervision service to the supervisor separately, and calculates the construction supervision service fee according to its proportion in the construction supervision service workload, in which the service fee for quality control and safety production supervision and management shall not be less than 70% of the construction supervision service fee.

1.0. 1 1 If the construction supervision service of a construction project is undertaken by more than two supervision units, each supervision unit shall calculate the construction supervision service fee according to the proportion of the workload of the construction supervision service. If the Employer entrusts one of the supervisors to be responsible for the construction supervision service of the construction project, the supervisor shall charge the Employer the overall coordination fee according to 4%~6% of the total supervision service fee of each supervisor.

1.0. 12 This charging standard does not include other service charges other than these General Conditions. Other service charges, if stipulated by the state, shall be subject to its provisions; If there is no provision in the state, it shall be determined by the employer and the supervisor through consultation.
