The term "road transport of dangerous chemicals" as mentioned in these Regulations refers to the whole process of using special vehicles to transport dangerous chemicals by road.
The term "special vehicles" as mentioned in these Regulations refers to trucks that meet specific technical conditions and requirements and are engaged in road transport of dangerous chemicals.
The term "hazardous chemicals" as mentioned in these Regulations refers to the articles in the catalogue of hazardous chemicals determined and published by the relevant departments of the State Council according to law.
Where laws and regulations provide otherwise for road transportation of highly toxic chemicals and civil explosives, such provisions shall prevail. Article 3 The road transport management of hazardous chemicals shall adhere to the principles of safety first, prevention first, comprehensive management and convenient transportation, and vigorously popularize modern information technology management means to ensure the safe and orderly road transport of hazardous chemicals. Article 4 The municipal, district (county-level city) people's governments shall strengthen the management of road transportation of dangerous chemicals, and establish a management coordination mechanism composed of transportation, emergency management, public security, natural resources, ecological environment, housing and urban construction, health and hygiene, market supervision, urban management and law enforcement, fire rescue and other departments to coordinate major issues in management and emergency rescue work.
According to the authorization or entrustment, the management institutions of economic functional zones shall do a good job in the management of road transportation of dangerous chemicals according to law. Article 5 The competent transportation department shall be responsible for organizing and implementing the management of road transportation of dangerous chemicals.
Emergency management, public security, natural resources, ecological environment, housing and urban construction, health, market supervision, urban management and law enforcement departments are responsible for the safety supervision and management of road transport of dangerous chemicals within their respective responsibilities. Article 6 The municipal and district (county-level city) people's governments shall include the funds needed for the management of road transport of dangerous chemicals into the annual financial budget at the corresponding level. Article 7 The Municipal People's Government shall be responsible for the construction, management and maintenance of the road transport supervision information system for dangerous chemicals.
Transportation, emergency management, public security, natural resources, ecological environment, housing and urban construction, health and hygiene, market supervision, urban management and law enforcement departments and fire rescue agencies shall, within their respective functions and duties, do a good job in the collection and application of relevant information according to law. Article 8 An enterprise or unit engaged in road transport of hazardous chemicals is the main body responsible for the safety of road transport of hazardous chemicals, and its main person in charge is fully responsible for the safety of road transport of hazardous chemicals of the enterprise or unit. Article 9 Trade associations related to road transport of dangerous chemicals shall provide members with safety knowledge training, technical consultation and guidance services in accordance with laws, regulations and articles of association, strengthen industry self-discipline and industry management, and assist in emergency handling of road transport accidents of dangerous chemicals. Chapter II Management of Business Units Article 10 An enterprise or unit engaged in road transport of dangerous chemicals shall meet the conditions prescribed by laws and regulations and obtain a license for road transport of dangerous goods according to law.
Where dangerous chemicals are transported by road, the shipper shall entrust an enterprise that has obtained the road transport license of the corresponding category of dangerous goods according to law to carry them. Article 11 Road transport enterprises or units of hazardous chemicals shall establish and improve the safety production management system and occupational health management system, such as the responsibility system for safety production, the management system for employees, the education and training system, the vehicle management and vehicle dynamic monitoring system, the parking lot management system, the emergency rescue plan system, the safety production operation rules, the safety accident reporting and handling system. Twelfth drivers, loading and unloading management personnel, escorts and other employees engaged in road transport of dangerous chemicals employed by enterprises or units shall obtain corresponding qualification certificates according to law. Article 13 Road transport enterprises or units of dangerous chemicals shall provide pre-job safety education and training and regular safety education to the drivers of special vehicles, loading and unloading managers, escorts and other employees closely related to road transport activities of dangerous chemicals. Those who have not passed the pre-job safety education and training examination shall not be allowed to work at their posts.
Records of pre-job safety education and training shall be kept for at least 12 months after relevant personnel leave their posts; The retention period of regular safety education records shall not be less than twelve months.
Road transport enterprises or units of dangerous chemicals may entrust third-party institutions to carry out education and training. Encourage the use of modern information technology and carry out various forms of education and training. Article 14 Enterprises or units that transport dangerous chemicals by road shall use special vehicles and equipment that have been produced according to national standards and passed the inspection, and ensure that the special vehicles and equipment used match the nature and weight of the dangerous chemicals transported.
Road transport enterprises or units of hazardous chemicals shall maintain and manage special vehicles in accordance with relevant state regulations, and ensure that the technical conditions of special vehicles meet the requirements of national standards.
Enterprises or units engaged in road transport of dangerous chemicals by using special tankers shall keep the tanks intact and shall not illegally replace, modify or install them, and conduct regular inspection of the tanks in accordance with regulations.
If there are serious defects or accidental damage to the tank body of the atmospheric tank special vehicle, it shall be repaired by qualified enterprises in accordance with national standards and technical conditions, and passed the inspection by qualified inspection and testing institutions.
