The term "enterprise credit information" as mentioned in these Measures refers to the information formed by enterprises in their production, operation and service activities, which can be used to analyze and judge the credit status of enterprises. Article 3 These Measures shall apply to the collection, processing, use, supervision and management of enterprise credit information within the administrative area of this province. Fourth provincial people's government credit management agencies responsible for guiding and supervising the province's enterprise credit work. The credit management institution of the Municipal People's Government with districts shall be responsible for the guidance, supervision and management of the credit investigation work of enterprises within its jurisdiction.
Other relevant departments of the people's governments of provinces and districts shall, in accordance with their respective responsibilities, coordinate in the guidance, supervision and management of enterprise credit investigation. Article 5 Enterprise credit investigation shall be franchised. The measures for granting franchise rights shall be formulated by the provincial credit management institutions and submitted to the provincial people's government for approval. Article 6 Credit reporting institutions shall collect enterprise credit information through legal channels, objectively record the credit information, and make enterprise credit products scientifically and fairly. Chapter II Collection of Enterprise Credit Information Article 7 Enterprise credit information mainly includes the following contents:
(1) Identity information: mainly refers to name, address, economic category, legal representative, registered capital, shareholder information, foreign investment, business scope, franchised products, etc. Enterprise-oriented;
(2) Credit information: mainly refers to the performance information formed by the credit relationship between enterprises and financial institutions;
(3) Public information: mainly refers to the records related to enterprise credit, such as financial operation, tax payment, quality and safety, import and export, social insurance, employment, wage payment, safe production, environmental protection, public service payment, etc., held by administrative organs, judicial organs or organizations exercising public management functions;
(4) Other information related to enterprise credit. Article 8 Provinces and cities divided into districts shall set up public credit information centers, which shall be responsible for establishing the basic credit information database and information system of enterprises in the whole province, collecting, processing and publishing enterprise credit information, realizing information exchange and sharing among government departments, and providing information inquiry services. Article 9 Administrative organs, judicial organs, organizations exercising public management functions, public utilities and trade organizations shall provide enterprise credit information to the public credit information center in a timely, accurate and complete manner, except those involving state secrets and commercial secrets.
The scope, time, mode and format of specific information shall be determined by the provincial credit management institution after consulting relevant information providers.
Information and data can be exchanged between the enterprise basic credit information database and other databases, and the use of the exchanged data shall comply with the relevant provisions of the state. Tenth credit institutions can obtain enterprise credit information from the public credit information center.
Credit institutions can collect enterprise credit information by themselves.
It is forbidden to collect enterprise credit information by deception, theft, coercion, computer network intrusion or other improper means.
Credit institutions shall update and maintain information in a timely manner, and shall not fabricate or tamper with enterprise credit information.
The information provider shall ensure that the information provided is objective, true and accurate. Chapter III Processing and Use of Enterprise Credit Information Article 11 Credit reporting institutions shall process and issue enterprise credit reports or enterprise credit evaluation reports based on enterprise credit information.
When making a credit evaluation report, a credit reporting agency should take a scientific and reasonable evaluation index system and standards as the basis to ensure the fairness of the evaluation results. Article 12 The provision and use of enterprise credit information, enterprise credit report and enterprise credit evaluation report by a credit reporting institution shall be subject to the consent of the enterprise under credit reporting. Where laws, regulations and rules provide otherwise, such provisions shall prevail.
Credit institutions shall not disclose enterprise credit information, provide enterprise credit reports and enterprise credit evaluation reports to any other unit or individual without authorization. Article 13 The enterprise credit report and enterprise credit evaluation report provided by credit reporting institutions shall be used as a reference for users to judge the credit status of credit reporting enterprises. Article 14 Credit reporting institutions shall provide the following information inquiry services to credit reporting enterprises according to their requirements:
(1) Enterprise credit information and its sources;
(2) Users who have obtained enterprise credit reports or credit evaluation reports. Fifteenth enterprise credit investigation to implement paid services.
The charging standards for providing enterprise credit reports and enterprise credit evaluation reports by credit reporting institutions shall be determined by the provincial price department in conjunction with the provincial credit management institutions.
Judicial organs and administrative organs need to use enterprise credit information in the process of handling cases and administrative management, and can make free inquiries to credit reporting agencies.
