The bank staff suggested that customers should go to the nearest bank counter as soon as possible after discovering the wrong account, and check with the bank staff whether the other party's account exists with the printed receipt issued on the day of ATM transfer. If the opposite account does not exist or is invalid, the money will be automatically returned to the sender's account within a certain period of time. However, if the other party's account is true and valid, then the remitter can ask the bank staff to provide the other party's contact information.
If the bank is unwilling to provide the personal information of the other party, the remitter should report the case to the public security organ and ask the public security organ to intervene in the investigation. First of all, the public security organ will ask the bank to verify the identity of the other party, and then communicate with the other party whether it is willing to return the money. If the other party refuses to return the money, the remitter can bring a civil lawsuit to the court with the money order, and the court can use the legal provisions of unjust enrichment to help the remitter recover the money.
Unjust enrichment means that there is no legal basis, so that others suffer losses and gain benefits by themselves.
According to Article 985 of China's Civil Code, "if there is no legal basis to obtain improper benefits and cause losses to others, the obtained improper benefits shall be returned to the person who suffered losses". Because unjust enrichment has no legal basis, even a fait accompli cannot be protected by law, the beneficiary should return the unjust enrichment to the injured person. This relationship of rights and obligations is the debt of unjust enrichment. The person who obtains unjust enrichment is called the beneficiary, is the debtor of the unjust enrichment debt, and has the obligation to return the debt. The person who loses his property is called the victim, and the creditor who unjustly gains the debt has the right to claim the creditor's right.
