How long does it take for the first offender to help the information network crime?

The term of imprisonment for the crime of helping information network criminal activities is generally less than three years.

Those who commit the following acts for others to commit crimes by using information networks can be identified as "helping" acts:

(1) Buying, selling or renting credit cards, bank accounts, non-bank payment accounts, Internet account passwords with payment and settlement functions, online payment interfaces and online banking digital certificates;

(2) Buying, selling or leasing other people's mobile phone cards, mobile cards and Internet of Things cards.

If it is determined that the actor specified in Article 287 bis of the Criminal Law knows that others use the information network to commit crimes, it shall provide technical support or help according to the number of times, the number of cards, bank accounts, non-bank payment accounts, Internet account passwords with payment and settlement functions, online payment interfaces, online banking digital certificates, or other people's mobile phone cards, mobile cards, Internet of Things cards, etc., in combination with the actor's cognitive ability, past experience, transaction objects, and relationship with the actor who commits information network crimes.

Buying, selling, or leasing the bank settlement account of a company or the unit payment account of a non-bank payment institution, or illegally opening, selling, or leasing other people's mobile phone cards, credit cards, bank accounts, and non-bank payment accounts by employees in industries such as telecommunications, banking, and online payment. By performing duties or providing service facilities, it can be recognized as Article 11 of the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Laws in Handling Criminal Cases of Illegal Use of Information Networks and Helping Information Networks, unless there is evidence to the contrary.

Remind the general public to pay attention to their financial accounts, don't lend them to others easily, and avoid touching the bottom line of the law without knowing it.

Relevant laws and regulations:

Article 287 bis of the Criminal Law knowingly provides technical support such as Internet access, server hosting, network storage and communication transmission for others. Commit crimes for them, or provide assistance in advertising promotion, payment and settlement. If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also or only be fined.

If a unit commits the crime mentioned in the preceding paragraph, it shall be fined, and the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the provisions of the first paragraph.

Whoever commits the acts mentioned in the preceding two paragraphs and constitutes other crimes at the same time shall be convicted and punished in accordance with the provisions of heavier punishment.
