Second, the relevant provisions of the permanent population
According to the "Regulations of People's Republic of China (PRC) Municipality on Household Registration", "Regulations of Fujian Province on the Administration of Household Registration of Public Security Organs" and relevant laws, regulations, rules and policies, combined with the actual situation of our city, the relevant matters concerning standardizing household registration file inquiry are hereby notified as follows:
1, query service permission
The function of providing public security population information services to the outside world is undertaken by the Ministry, provincial and municipal public security information centers.
Providing citizens with personal household registration information is the responsibility of the public security police station where the household registration of the inquired object is located.
2. Relevant legal personnel inquire about files.
Legal personnel who need to inquire about household registration information in criminal cases or other cases that have entered the litigation stage shall go to the local police station where the household registration object is inquired.
(1) When handling criminal cases, legal personnel can make direct inquiries with legal documents of relevant judicial departments, special certificates for investigation, agency agreements and legal personnel's practice certificates.
(two) legal personnel to handle other cases, the case has entered the litigation stage, with the relevant legal documents of the judicial organs, special investigation certificate, agency agreement and legal personnel's practice certificate for inquiry; Because the court has filed a case before entering the litigation stage, it is necessary to inquire about the identity information of the other party, and the inquiry shall be made with the inquiry identity introduction letter, special investigation certificate, agency agreement and relevant legal personnel's practice certificate issued by the court.
(3) Legal related personnel act as an agent to arbitrate cases. If the case has entered the arbitration stage, the inquiry shall be made by the Notice of Case Acceptance, Special Certificate for Investigation, Agency Agreement and Practice Certificate of Legal Related Personnel of the Arbitration Commission; Before entering the arbitration stage, if it is necessary to inquire about the identity information of the other party because of the filing of the case by the Arbitration Commission, the inquiry shall be made by the identity inquiry letter issued by the Arbitration Commission, the special certificate for investigation, the agency agreement and the practice certificate of relevant legal personnel.
When accepting the application of legal personnel to inquire about household registration information, the police handling the case at the police station shall carefully verify the relevant documents submitted by legal personnel and keep the relevant materials (or copies) for the record. When a legal person applies to inquire about the household registration information of the party concerned, the police in charge of the police station can ask the legal person to provide the relevant information of the inquired person as much as possible to ensure the accuracy of the household registration information of the inquired person. When inquiring about household registration information, if the information system retrieves information of two or more people (including two people) with the same name and surname, the police handling the case at the police station should carefully verify the information clues of the inquired person provided by the relevant legal personnel to ensure the correctness of the inquiry results. If it cannot be confirmed, the household registration certificate will be issued after further verification of relevant clues.
When inquiring about household registration information, legal personnel can only inquire about the situation related to the parties involved in the agency case. The police station can provide the name, gender, date of birth, detailed address of household registration and citizenship number of the relevant parties.
3, political and legal institutions to query files
Public security, procuratorates, courts, state security organs and other political and legal departments, as well as discipline inspection and supervision departments, shall submit the following materials to the police station where the household registration of the inquired object is located: an Investigation Letter of Introduction stamped with the official seal and indicating the reasons and the inquired object; Interviewer's work certificate.
The police station can provide the names, genders, ages, home addresses, nationalities and citizenship numbers of the inquired objects and their indoor members if the political and legal departments and discipline inspection and supervision departments need to make inquiries due to investigation.
The organization department inquired about the files in accordance with the Notice of the Organization Department of Fujian Provincial Party Committee and Fujian Provincial Public Security Department on Doing a Good Job in the Investigation and Verification of the Date of Birth of Cadres (No.33 [2015]).
If the household registration of the person under investigation is not in the jurisdiction of the Institute, the name of the police station where the household registration is located may be informed. The household registration certificate (stamped with the special seal for household registration) issued by the Institute belongs to the jurisdiction of the Institute, but no electronic documents may be provided to the outside world.
4. Personal survey
(a) citizens can submit the "identity card" or "household registration book" to the local police station to inquire about household registration information. The householder can inquire about the household registration information of himself and indoor members.
If a citizen needs to issue a certificate of relationship and a certificate of historical migration, he can verify the regular copy of the form, issue relevant certificates according to the contents of the copy, and affix the special seal for the account. The Registration Form of Permanent Population is an internal book and may not be provided to the outside world.
(2) When naming a newborn baby, a citizen may submit a birth certificate or relevant certification procedures of a hospital at or above the county level, or a marriage certificate and his/her resident identity card, and apply to the police station where the household registration is located for duplicate name inquiry. The police station shall give feedback to the masses on the spot on the statistics of duplicate names, but shall not provide the identity information of the duplicate names.
