The term "green building" as mentioned in these Regulations refers to a building that saves land, energy, water and materials to the greatest extent, protects the environment and reduces pollution, and provides people with safe, healthy, applicable, livable and efficient use space, and is in harmony with nature.
According to national standards, green buildings are divided into three grades: one star, two stars and three stars. Article 3 The development of green buildings shall adhere to the principles of overall planning, government promotion, market guidance, all-round promotion and highlighting key points. Article 4 The people's governments at or above the county level shall promote the development of green buildings, incorporate them into the national economic and social development plan, and take them as the content of the government's target responsibility assessment system. Fifth people's governments at or above the county level shall be responsible for the guidance, supervision and management of green building activities within their respective administrative areas.
The development and reform, finance, urban and rural planning, natural resources and other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the work related to green buildings. Article 6 People's governments at or above the county level shall increase investment in promoting the development of green buildings, and encourage and guide social capital to invest and operate green buildings.
Encourage and support the research, development, demonstration and promotion training of green building technology, cultivate a market-oriented green building technology innovation system, and promote the progress and innovation of green building technology.
Units and individuals that have made remarkable achievements in the development of green buildings shall be commended and rewarded in accordance with the relevant provisions of the state. Seventh people's governments at or above the county level and their relevant departments should take various forms to carry out the publicity of laws and regulations related to green building, popularize the scientific knowledge of green building and enhance the public's awareness of green development. Chapter II Planning, Design and Construction Article 8 The competent department of housing and urban and rural construction of the provincial people's government is responsible for formulating the guidelines for the preparation of special planning for green buildings in this province.
The competent department of housing and urban-rural construction of the people's government at the city or county level divided into districts shall, jointly with urban-rural planning and other relevant departments, organize the preparation of special planning for green buildings, which shall be linked with the overall planning of cities and towns and announced to the public after approval by the people's government at the same level.
The green building special planning shall determine the green building grade and layout requirements of new civil buildings, including development objectives, key development areas, prefabricated buildings, ultra-low energy consumption building requirements and green transformation of existing civil buildings, and clarify the application ratio of prefabricated buildings, ultra-low energy consumption buildings and green building materials. Article 9 The competent department of housing and urban and rural construction of the provincial people's government shall, jointly with relevant departments, formulate local standards related to green buildings according to national standards and the level of economic development of this province, actively cultivate and develop group standards, and guide enterprises to formulate higher enterprise standards.
Promote the collaborative work with local standards for green buildings in Beijing and Tianjin, strengthen information exchange, and promote the coordinated development of green building industry in Beijing, Tianjin and Hebei. Tenth new civil buildings within the scope of urban construction land determined by the overall planning of cities and towns shall be built in accordance with the green building standards of more than one star. The following buildings shall be built in accordance with the green building standards of two or more stars:
(a) government investment or government-invested buildings;
(two) a large public building with a construction area of more than twenty thousand square meters;
(3) Residential quarters with a construction area of 10 million square meters or more.
The municipal people's government with districts can improve the development requirements of green buildings according to local conditions, promote the large-scale development of green buildings, and promote the creation of green ecological cities, blocks and residential quarters in new urban areas and functional parks. Article 11 The competent department of housing and urban and rural construction of the provincial people's government shall compile the design code for rural residential buildings in this province, guide rural public buildings and residential quarters to apply prefabricated building technology, wall insulation technology, high-performance door and window technology and renewable energy application technologies such as solar energy and biomass energy, and carry out construction and transformation in accordance with green building standards.
Encourage rural individuals to build their own houses and other new buildings with reference to green building standards. Article 12 The competent department of urban and rural planning of the people's government at the city or county level divided into districts shall incorporate the relevant contents of the special planning of green buildings into the regulatory detailed planning, and make clear the grade requirements and control indicators of green buildings in the construction land planning according to the regulatory detailed planning, and incorporate them into the planning review and planning verification of construction projects. Thirteenth land administrative departments of the people's governments at or above the county level shall, when transferring or allocating land, incorporate the green building grade requirements determined by the construction land planning into the contract for transferring the right to use state-owned land or the decision on allocating state-owned land. Fourteenth construction units in the feasibility study report or project application report of new civil buildings, should be clear about the grade requirements of green buildings and the selected technology; In consultation, design, construction, supervision, materials and equipment procurement and related bidding activities, the green building grade requirements of construction projects shall be clearly explained to the relevant units and organized for implementation.
