In order to further rationalize the province's transportation administrative law enforcement system, strengthen the management of transportation administrative law enforcement, and improve the management and service level of the province's transportation industry, we now put forward the following opinions on the reform of the province's transportation administrative law enforcement system, please conscientiously implement it.
I. General requirements
(1) guiding ideology. Guided by the spirit of the 18th National Congress of the Communist Party of China and the Third Plenary Session of the 18th Central Committee, and in accordance with the principle of "separating government from enterprise", we should straighten out the management system, standardize the institutional setup, improve the security mechanism, optimize the structure of law enforcement team, and strive to solve the problems existing in the current transportation administrative law enforcement, such as poor system and overlapping institutions. Cross-functional, multi-headed law enforcement, serious overcrowding, ineffective supervision, clear establishment of powers and responsibilities, unified system and effective supervision.
(2) Basic principles. First, government-led, second, streamlined and efficient, third, the focus of law enforcement moved down, and fourth, active and steady.
Second, the main content
(1) Integrate law enforcement functions. The functions of administrative punishment, administrative law enforcement, supervision and inspection scattered in transportation management, highway management, rural highway management, road transportation management and expressway provincial administrative departments will be integrated and undertaken by newly established transportation administrative law enforcement agencies at all levels. The administrative law enforcement work of expressway, which is directly under the jurisdiction of counties (cities), is still undertaken by the newly established transportation administrative law enforcement agencies in the former provincial cities. The road property personnel of expressway management unit will continue to undertake road traffic security, traffic accident rescue, road property protection and other businesses, and will no longer undertake administrative enforcement and administrative punishment.
The focus of law enforcement was shifted to the county level. The provincial level is mainly responsible for the formulation of policies and standards and business guidance, supervision and coordination. The scope of law enforcement in provincial cities is limited to expressway and urban built-up areas. The overrun detection station approved by the provincial government is an ordinary highway overrun detection station managed by a city under the provincial jurisdiction, and it is managed by the newly established transportation administrative law enforcement agency where the county (city) is located; Belong to the provincial city built-up area overrun detection station and expressway overrun detection station, to be managed by the newly established transportation administrative law enforcement agencies in the provincial city.
(2) streamline law enforcement agencies. According to the principle of simplification, unification and efficiency, the existing highway law enforcement agencies and road transport law enforcement agencies at all levels should be integrated. In principle, only one transportation administrative law enforcement agency shall be established at the provincial, city and county levels, and the name of the agency shall be unified, the establishment of the agency shall be standardized, and the responsibilities and tasks shall be defined. Municipal districts do not set up transportation administrative law enforcement agencies.
(3) Strictly verify the preparation. According to the principle of no breakthrough in organization, hierarchical management is implemented, and the staffing of municipal and county-level transportation administrative law enforcement agencies is approved by the municipal and county-level organization departments according to the staffing standards within the total amount issued by the provincial organization department.
(4) Improve the financial guarantee mechanism. The province's transportation administrative law enforcement agencies to implement the grading burden of funds, by the finance at the same level in accordance with local funding standards into the budget. For the personnel and public funds of the county-level transportation administrative law enforcement agencies, the provincial finance will incorporate the number of county-level personnel approved into the county-level basic financial security mechanism to ensure it. The provincial level arranges a certain amount of law enforcement funds from the central transfer payment for the reform of refined oil prices and taxes and fees as a one-time subsidy to the cities and counties (cities) under the provincial jurisdiction. It is strictly forbidden to link the incomes from fines and confiscations with the funds of transportation administrative law enforcement agencies.
(5) Do a good job in personnel placement. Governments at all levels are responsible for personnel placement in the reform of traffic administrative law enforcement system. On the original registration of road administration, transportation law enforcement personnel, in accordance with the principles of fairness, impartiality and openness, take the examination method, competition for posts, merit-based employment; Those who are not employed should be properly placed in line with the principle of people-oriented, harmony and stability. Institutions and human resources and social security departments shall dismiss or expel those who have not gone through formal procedures.
The third is the supporting measures for job transfer and resettlement.

(II) The job transfer of unemployed persons in the reform of road transport management system has been carried out in accordance with the spirit of Opinions of the General Office of the People's Government of Henan Province on the Reform of Road Transport Management System (No.2011]140).
(3) Contract personnel, after the expiration of the contract, terminate the labor contract according to the Labor Contract Law of People's Republic of China (PRC); Temporary employees will retire.
(4) As of 20 14 12 3 1, those who have reached the statutory retirement age or have completely lost their working ability due to illness shall go through retirement and resignation procedures in time; If I have been away from the statutory retirement age for less than 5 years (including 5 years) and have worked for 20 or 30 years, I will apply voluntarily and can go through the formalities of early retirement upon approval. Those who have already participated in the basic old-age insurance, the old-age insurance premiums that should be paid and received during the early retirement procedures to the legal retirement age shall be paid from the transfer payment funds of the central government's refined oil price and tax and fee reform, and allocated to the old-age insurance agencies.
(5) If the original registered personnel are transferred to the enterprise to work or seek self-employment, they will be included in the basic old-age insurance for enterprise employees. The continuous length of service before 20 14 12 3 1 is regarded as the payment period, and the basic old-age insurance premium is no longer paid. When retiring, the pension is paid according to the basic pension plan for enterprise employees. Before the diversion, those who participated in the endowment insurance of government agencies and institutions will be incorporated into their personal accounts of enterprise endowment insurance during the period of participating in the endowment insurance of government agencies and institutions. In order to ensure the smooth convergence of pension benefits for triage personnel after retirement, for those who retired before 20 14 12 3 1, if the pension calculated according to the basic pension of enterprise employees is lower than the retirement fee calculated according to the employees of public institutions, subsidies will be increased, and the required expenses will be paid from the enterprise basic old-age insurance pooling fund. The subsidy base is the difference between the average standard of basic pension for employees of local enterprises in February 2065438+2003 and the retirement fee calculated and paid by government agencies and institutions in February 2065438+2003. Once approved, the subsidy base will remain unchanged. The subsidy measures shall be implemented in accordance with the relevant provisions of the Notice of the General Office of the People's Government of Henan Province on Forwarding the Implementation Opinions of the Provincial Construction Department and other departments on the System Reform of Engineering Survey and Design Units in Henan Province (Yu Zhengban [2003]110).
(VI) The old-age insurance premiums owed to retirees shall be settled by the central transfer payment funds and financial resources at the same level at one time with reference to the document of Henan Zhengban 1 140, and the reform of refined oil prices and taxes and fees shall be coordinated.
(seven) the social insurance policies for medical care, unemployment, work injury and maternity of the formal personnel transferred in the reform shall be implemented in accordance with the relevant provisions of the state, provinces and municipalities directly under the central government.
(eight) through the government to buy services, expand the service network, promote institutional innovation and other ways to transfer employment and placement of surplus personnel.
(9) Relevant policies and measures that have been promulgated by provincial, municipal and county (city, district) governments and are beneficial to the reform of transportation and other industries are applicable to this reform.
Fourth, organize the implementation.
(1) Strengthen organizational leadership. The reform of the transportation administrative law enforcement system in the province is carried out under the unified leadership of the provincial government, and the municipal and county (city, district) governments under the provincial jurisdiction are specifically responsible for organizing the implementation. The governments of cities and counties (cities, districts) under the jurisdiction of all provinces should fully understand the importance and urgency of the reform of the transportation administrative law enforcement system, earnestly strengthen leadership, strictly implement responsibilities, and ensure the smooth progress of the reform and achieve practical results.
(2) Clear division of responsibilities. Provincial transportation authorities should strengthen supervision over the reform of the province's transportation administrative law enforcement system, timely study and solve various problems encountered in the reform, and report major problems to the provincial government. The governments of cities and counties (cities, districts) under the jurisdiction of all provinces should pay close attention to formulating local reform implementation plans and actively promote reforms. The establishment departments at all levels shall, jointly with the transportation departments at the same level, study and determine the transportation administrative law enforcement agencies and staffing. The financial department should straighten out the channels of fund management, ensure the funds for traffic administrative law enforcement and strengthen the supervision of funds. The human resources and social security department should guide the transportation administrative law enforcement agencies to strengthen personnel management, and do a good job in the implementation of social security policies and measures for fixed-post personnel and retired and demobilized personnel in the reform. Transportation, organization, finance, human resources and social security departments at all levels should cooperate closely to ensure that all work is implemented.
(3) serious work discipline. Seriously organize discipline, financial discipline and personnel discipline, correctly guide public opinion, strengthen policy propaganda, take various forms to do a good job in the ideological and political work of personnel involved in the reform, properly arrange the transfer of surplus personnel, correctly handle the relationship between reform, development and stability, and ensure the overall stability of the industry.
(4) Actively and steadily advance. At the provincial level, the reform will be completed before 20 14, 12 and 3 1; At the provincial level, cities and counties (cities) directly under the jurisdiction of the province will be completed before June 30, 20 15; And other counties (cities, districts) except those directly under the jurisdiction of the province will be completed before 20 15.
