What procedures and materials are needed for marriage registration?

The marriage registration procedure is mainly composed of application, examination and registration.

(1) application

Those who meet the conditions for marriage registration shall apply for marriage registration at the marriage registration office where one party is located with relevant documents, certificates and three registration photos, and both parties shall fill in the documents for marriage registration on the spot.

Different people have different requirements on the documents and supporting materials for applying for marriage registration. For example, China citizens applying for marriage registration in China (except Hong Kong, Macao and Taiwan) must hold their valid ID card, household registration book, proof of premarital examination, proof that they are single and have no spouse, and a signed statement that they are not related to each other. For the divorced party, he/she must also carry divorce documents.

Foreigners (including foreigners residing or temporarily residing in China, China people and foreigners residing in China) applying for marriage in Chinese mainland must hold their valid passports or nationality certificates, valid residence permits for foreigners, and marriage status certificates issued by embassies and consulates in China.

(2) Review

The marriage registration office will examine the application of the parties to find out whether the documents and certificates meet the conditions for marriage. If there is any ambiguity, the marriage registration authority shall ask the parties concerned and ask them to provide relevant certification materials when necessary.

(3) Registration and licensing

The marriage registration authority will register eligible couples and issue marriage certificates to the parties; For divorced parties, the marriage registration authority will cancel their divorce certificates; The marriage registration authority shall, at the request of the parties concerned, issue a written statement stating the reasons why the marriage registration cannot be handled.

What procedures and documents do you need for divorce?

The process of divorce registration is roughly as follows:

(1) application

If a husband and wife voluntarily divorce in the Mainland, they need to sign a divorce agreement in accordance with the regulations, jointly apply to the marriage registration office with jurisdiction, and provide the following application materials in accordance with the regulations:

1. Marriage certificate issued by the Mainland Marriage Registry or Chinese embassies and consulates abroad;

2. Relevant valid identity documents that meet the requirements, such as household registration book, identity card, pass or passport;

3. An application for divorce registration filled in at the marriage registration office.

(2) Accept

The staff will conduct a preliminary examination of the materials provided by the parties in accordance with the regulations. After the documents and certification materials submitted by the parties are correct after the first trial, they will send a receipt for accepting the divorce registration application to the parties. Divorce will not be accepted if it does not meet the requirements for divorce registration. If a party requests to issue a notice of rejecting the application for divorce registration, it shall issue it.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues a receipt for accepting the application for divorce registration to the parties concerned, if either party disagrees with the divorce, it can show its valid identity certificate and the receipt for accepting the application for divorce registration (if the receipt is lost, it can be omitted, but a written explanation is required), go to the marriage registration office that accepts the application for divorce registration, and fill in the Application for Cancellation of Divorce Registration and other relevant documents in person. After verifying the information, the marriage registration authority shall issue a confirmation form for withdrawing the application for divorce registration. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply to the marriage registration authority for issuing a divorce certificate, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday is the expiration date of the period), both parties shall bring relevant documents and materials as required, such as recent bareheaded photos of both parties, divorce agreement, marriage certificate, ID card, passport or pass, etc. And * * * go to the marriage registration office to apply for a divorce certificate. The marriage registration authority shall implement and examine the marriage registration in accordance with the provisions of the Code for Marriage Registration. If the divorce registration conditions are not met, the divorce registration formalities shall not be handled, and if necessary, a notice of divorce registration shall be issued at the request of the parties concerned.

(5) Registration and issuance of divorce certificates
