How did Lao Lai judge?

Lao Lai's judgment is generally: a debtor who has the ability to repay due debts, but refuses to repay all or part of the debts. Lao Lai, legally known as the person subject to breach of trust, made the following judgment:

If the person subjected to execution fails to fulfill the obligations specified in the effective legal documents and has one of the following circumstances, it may be included in the list of the person subjected to dishonesty:

1, refusing to perform the obligations specified in the effective legal documents when it has the ability to perform;

2. Obstructing or resisting execution by forging evidence, violence or threats;

3. Evading execution by false litigation, false arbitration or concealing or transferring property;

4. Violating the property reporting system;

5. Violating the consumption restriction order;

6. Refusing to perform the settlement agreement without justifiable reasons.

The person subject to breach of trust refers to the person subject to execution who has the ability to perform but fails to perform the obligations specified in the effective legal documents.

In any of the following circumstances, the people's court shall not include the person subjected to execution in the list of persons subjected to dishonesty:

1, providing sufficient and effective guarantee;

2, has taken measures such as sealing up, seizure, freezing property enough to pay off the effective legal documents to determine the debt;

3. The person subjected to execution should not be enforced according to law after performing the order;

4. Other circumstances that do not belong to the ability to perform and refuse to perform the obligations specified in the effective legal documents.

The ways to cancel the untrustworthy list are as follows:

1. If the person subjected to execution has any objection to the untrustworthy list, he may apply to the relevant department for correction. The relevant departments will review the application within 15 working days, and cancel the untrustworthy executor within 3 working days after the application is successful.

2. If the person subjected to execution has fulfilled the obligations specified in the effective legal documents or the people's court has completed the execution, it shall be deleted within three working days.

3, in line with the statutory situation, the people's court shall delete the information of dishonesty within three working days.
