Article 5 Bidding and tendering for construction shall not be restricted by regions or departments, and the principles of openness, fairness, fair competition and merit selection shall be adhered to. Chapter II Bidding Article 6 The following construction projects must be subject to bidding:
(a) housing construction with a construction area of 1000 square meters and other civil construction projects with a project cost of more than 500,000 yuan;
(two) equipment installation and pipeline laying projects with a project cost of more than 500 thousand yuan;
(three) decoration engineering and earthwork engineering with a project cost of more than 300 thousand yuan.
Bidding is advocated for projects above designated size. Article 7 Whether to invite tenders for the following construction projects shall be decided by investors:
(a) wholly foreign-owned, domestic private investment and overseas donations;
(two) the people's governments at or above the county level confirm that it belongs to confidentiality, emergency rescue and disaster relief;
(3) The project shall be undertaken by a unit with corresponding construction qualification grade;
(4) Small and medium-sized water conservancy and small hydropower projects. Article 8 A construction unit shall meet the following conditions when bidding:
(a) is a legal person or other organizations established according to law;
(2) Having economic and technical management personnel suitable for the project subject to tender;
(three) the ability to organize the preparation of bidding and pre-tender estimate;
(4) Having the ability to examine the qualifications of bidders;
(5) Having the ability to organize bid opening, bid evaluation and bid selection.
Do not have the above (two) to (five) conditions of the construction unit, should be entrusted with the corresponding qualification of construction engineering consulting, supervision and other units for bidding. Article 9 A bid inviting unit shall enjoy the following rights:
(a) the preparation of tender documents and the methods of bid evaluation and calibration;
(two) to participate in the selection of qualified bidders;
(3) Organizing bidding activities;
(4) Other rights enjoyed according to law. Tenth construction project bidding shall meet the following conditions:
(a) the construction project has been approved by the competent department of planning, land and planning;
(two) has been registered for the construction project;
(3) drawings and technical data required for construction;
(four) the source of construction funds and major equipment has been implemented. Eleventh construction project bidding can be carried out through public bidding, invitation bidding and negotiation.
In case of public bidding, the bid inviting unit shall publicly issue a tender announcement and invite the bid inviting unit to issue an invitation letter to the selected construction unit, with no less than three participants. For special construction projects with strong technical and professional skills and urgent construction period, which are not suitable for public bidding or invitation to bid, two or more construction units shall be selected for negotiation after review by the bidding management institution, and reported to the construction project management department for approval. Twelfth construction project bidding in addition to basic projects, secondary decoration projects, professional equipment installation projects and other special reasons can be sub-project bidding, not dismembered project bidding. Thirteenth construction project bidding should be carried out according to the following procedures:
(a) to submit a tender application to the tender management institution;
(two) according to the provisions of the preparation of the tender, and submit it to the tender management agency for review;
(three) the tender unit issued a tender announcement or invitation;
(4) The tendering unit applies to the tendering unit for bidding;
(five) select the bidding unit, distribute the bidding documents, design drawings and technical data, and collect the bid bond;
(six) the tender unit held a tender meeting;
(seven) within the agreed time to submit the tender, the tender unit will be unified packaging and sealed in public, signed by the representatives of the tender unit, the tender unit is responsible for the confidential custody;
(eight) the tender unit to prepare the pre-tender estimate and bid evaluation and calibration methods, and report to the tender management agency for examination and approval;
(nine) the bidding management institution shall organize the bid evaluation team in conjunction with the bidding unit;
(ten) the tender unit held a bid opening meeting;
(eleven) after the composition of the evaluation team, the tender unit shall determine the winning bidder according to the opinions of the evaluation team;
(twelve) the tender unit issued a bid-winning notice approved by the tender management agency to the bid-winning unit;
(thirteen) the tenderer and the winning bidder signed a construction contract.
