The Prison Law stipulates: Article 55 If a prisoner dies while serving his sentence, the prison shall immediately notify the prisoner's family, the people's procuratorate and the people's court. If a prisoner dies of illness, the prison shall conduct medical appraisal. If the people's procuratorate has doubts about the medical appraisal of a prison, it may conduct a new appraisal of the cause of death. If the family members of criminals have questions, they may raise them with the people's procuratorate. If a criminal dies abnormally, the people's procuratorate shall immediately examine him and make an appraisal of the cause of death.
According to the above provisions, although the interception law does not clearly stipulate whether it can be retrieved, according to the principles of civil law, family members can submit it to the procuratorate or directly to the prison, and the prison will identify the interception with the procuratorate and family members. Providing these materials is also the duty of the prison police to perform their duties and confirm whether the prison is conscientious in the process of handling and disposal.
Otherwise, family members can complain to the higher authorities or bring a lawsuit to the court.
