Article 35 An entrusted lawyer may, according to the needs of a case, apply to a people's procuratorate or a people's court to collect and obtain evidence, or apply to a people's court to notify witnesses to testify in court.
If a lawyer investigates and collects evidence by himself, he may, with the lawyer's practice certificate and the certificate of the law firm, investigate the situation related to undertaking legal affairs with the relevant units or individuals.
Extended Information According to the Archives Law of People's Republic of China (PRC) and its implementation measures and the Measures for Inquiring Enterprise Registration Archives of the State Administration for Industry and Commerce, the following procedures shall be provided for inquiring enterprise registration archives:
(a) public security organs at all levels, procuratorial organs, judicial organs, state security organs, discipline inspection and supervision organs, auditing organs and other party, government and military organs can refer to the enterprise registration files related to the investigation and handling of matters with the letter of introduction (official letter) and the work certificates of the inquirers.
(2) Employees of an enterprise may consult the enterprise registration files with their business licenses (originals and photocopies), letters of introduction from the enterprise and their ID cards (work permits); The legal representative and shareholders can refer to the enterprise's registration files with their ID cards.
(3) Entrusted by the client, the lawyer can inquire about the enterprise registration files related to the agency matters with the original and photocopy of the court filing certificate, the original and photocopy of the power of attorney, the letter of introduction from the law firm and the lawyer's practice certificate.
(4) If other enterprises, institutions and individuals need to consult the enterprise registration files due to litigation or arbitration, they can consult the relevant enterprise registration files with a letter of introduction from the unit, their ID card (work permit) and relevant certificates from the court or arbitration institution.
