Regulations of Dalian Municipality on Promoting the Development of Sci-tech Intermediary Services

Article 1 In order to promote the development of science and technology intermediary services, enhance the ability of independent innovation, accelerate the transformation of scientific and technological achievements, and promote scientific and technological progress and economic growth, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Scientific and Technological Progress, the Law of People's Republic of China (PRC) on Promoting the Transformation of Scientific and Technological Achievements and other relevant laws, combined with the actual situation in Dalian. Article 2 The term "intermediary service of science and technology" as mentioned in these Regulations refers to activities such as trading, brokerage, consultation, evaluation, agency, incubation of science and technology enterprises and entrepreneurial services directly related to scientific research, technological development and transformation of scientific and technological achievements.

These Regulations shall apply to units and individuals engaged in science and technology intermediary services within the administrative area of Dalian. Article 3 Dalian implements the principles of actively supporting, strengthening guidance, liberalizing, invigorating and improving services for science and technology intermediary services. Article 4 The municipal, district (city) and county administrative departments of science and technology shall be responsible for the overall planning, coordination, guidance and service of the development of science and technology intermediary services within their respective administrative areas.

Industrial and commercial administration, civil affairs, taxation, finance, small and medium-sized enterprise management and agriculture and other relevant departments shall be responsible for the development of science and technology intermediary services in accordance with the division of responsibilities. Fifth to encourage and support units and individuals to set up or introduce various kinds of science and technology intermediary service institutions.

Encourage and support units and individuals to set up joint-stock or partnership technology intermediary service institutions with independent intellectual property rights and proprietary technology according to law. Article 6 Institutions of higher learning and non-enterprise scientific research institutions shall encourage teaching staff and scientific and technological personnel to engage in intermediary services of science and technology on the premise of completing their own jobs. Seventh units and individuals engaged in science and technology intermediary services shall be registered and filed with the municipal administrative department of science and technology. Article 8 Units and individuals engaged in science and technology intermediary services shall abide by laws and regulations, conduct business in accordance with the principles of fair competition, equality and voluntariness, mutual benefit and compensation, honesty and credibility, and shall not harm the interests of the state and society or infringe upon the legitimate rights and interests of others. Article 9 Science and technology intermediary service institutions that meet the relevant requirements of the state and engage in scientific and technological achievements transformation consulting and scientific and technological information services shall enjoy preferential policies for non-profit scientific research institutions in accordance with regulations. Article 10 The municipal, district (city) and county people's governments shall arrange not less than 15% of applied technology and R&D funds from the finance at the same level every year as special funds for the development of science and technology intermediary services to promote innovation incubation, achievement popularization, science and technology evaluation and other science and technology intermediary service activities. Measures for the use of special funds shall be formulated by the municipal administrative department of science and technology jointly with the financial department. Eleventh units and individuals engaged in science and technology intermediary services, in line with the conditions, can apply for special funds for the development of private and small and medium-sized enterprises in Dalian in accordance with the provisions. Twelfth science and technology intermediary service units that are difficult to obtain corresponding economic returns and aim at service can operate and manage according to non-profit organizations. Thirteenth qualified technology business incubators shall be exempted from business tax, income tax, property tax and urban land use tax in accordance with state regulations from the date of identification.

The term "incubator" as mentioned in these Regulations refers to a specialized agency that provides venues, equipment, funds, information and other services for the cultivation and growth of small and medium-sized enterprises in the initial stage and reduces the risks of entrepreneurs. Fourteenth qualified technology business incubators should be recognized as high-tech enterprises and enjoy preferential policies for high-tech enterprises.

Private science and technology business incubators that incubate major high-tech projects meet the conditions stipulated by the state and enjoy preferential policies for private non-enterprise science and technology units. Fifteenth technology business incubator can establish a clear property right relationship with the incubating enterprise, and the incubator can occupy a certain proportion of shares in the incubating enterprise through services. Sixteenth science and technology intermediary service charges under the control and guidance of the national price policy, mainly by the market to form a price system. Seventeenth science and technology intermediary service fees can be paid in one lump sum or in installments, and those belonging to institutions can be charged in the expenditure of business expenses. Article 18 After undertaking, introducing and applying scientific and technological achievements, enterprises and institutions may, in accordance with relevant regulations, draw remuneration and reward those who have made achievements in promoting the transformation of scientific and technological achievements. Nineteenth science and technology intermediary services to implement industry self-discipline management.

Units and individuals engaged in science and technology intermediary services may establish science and technology intermediary service industry associations according to the industry or mode of operation, business contacts and service functions. Twentieth science and technology intermediary service industry association shall exercise the following functions:

(a) to carry out investigation and analysis related to the industry, collect and publish relevant information;

(two) to formulate industry norms, service standards and codes of practice for employees, and organize their implementation;

(three) the establishment of industry reputation files, regularly publish the reputation;

(four) to demonstrate the decisions involving the interests of the government and industry, and put forward opinions and suggestions;

(five) organize personnel training, peer exchanges, cross-industry cooperation, market development and international cooperation and other activities;

(six) to supervise the business of members, and to stop and correct acts that violate the articles of association and rules and regulations and harm the interests of the industry and members;

(seven) other functions stipulated by laws and regulations or entrusted by the government. Twenty-first municipal administrative department of science and technology in conjunction with the relevant departments and industry associations to evaluate the credibility of science and technology intermediary service institutions, and regularly publish.
