Measures of Dalian Municipality on Social Stability Risk Assessment of Major Administrative Decisions

Article 1 In order to standardize the social stability risk assessment of major administrative decisions, promote the scientific and democratic decision-making of administrative organs according to law, and safeguard the fundamental interests of the people, these Measures are formulated in accordance with the relevant provisions of the state and the province and combined with the actual situation of our city. Article 2 The term "social stability risk assessment of major administrative decisions" as mentioned in these Measures (hereinafter referred to as "social stability risk assessment") refers to the behavior of administrative organs to identify, analyze and prevent social stability risk factors that may be caused by major administrative decisions by using scientific, systematic and standardized assessment methods in accordance with legal authority and procedures. Article 3 These Measures shall apply to the social stability risk assessment of the matters identified in the Catalogue of Major Administrative Decision-making Matters Published by Dalian Municipal People's Government and its departments. Except as otherwise provided by laws and regulations. Article 4 The risk assessment of social stability shall follow the principles of scientificity, legality, openness and fairness, unification of rights and responsibilities and overall consideration. Article 5 Social stability risk assessment funds and assessment funds shall be included in the budget of the assessment main department for protection.

The departments of the Municipal People's Government, the district (city) and county people's governments or other organizations specifically responsible for organizing the implementation of major administrative decisions are the main bodies of implementation. Article 7 Policymakers, evaluators and implementers shall carry out social stability risk assessment according to the division of labor stipulated in these Measures.

The relevant departments involved in major administrative decisions shall cooperate with each other to carry out social stability risk assessment according to their respective responsibilities, provide relevant information on social stability risk assessment, and truthfully explain the social stability risks that may arise during the implementation of major administrative decisions. Article 8 The evaluation subject shall, in accordance with the relevant provisions, set evaluation indicators scientifically and normatively. Article 9 The contents of social stability risk assessment:

(1) Legitimacy, mainly including whether the decision-making subject, decision-making authority, decision-making procedure and decision-making content comply with relevant laws, regulations and policies;

(2) Rationality, mainly including whether the social, economic and ecological benefits of the decision-making matters are in line with the people's practical interests, long-term interests and legitimate rights and interests;

(3) Feasibility, mainly including whether the implementation plan, material conditions and timing of the decision-making matters are mature, whether they meet the development needs of regions and industries, and whether they are supported by the majority of the people;

(4) Controllability, mainly including whether there are hidden dangers of national security and public safety, preventive measures and emergency plans for social stability risk factors. Tenth social stability risk assessment shall be carried out in accordance with the following procedures:

(a) to determine the major administrative decision-making matters that need to be evaluated;

(2) Formulating an evaluation plan;

(three) to solicit opinions from letters and visits, finance, public security, safety supervision, environmental protection, planning and other relevant departments. Make written records of decision-making matters, and solicit public opinions through the media and government websites;

(four) according to the actual situation to take access to documents, field surveys, questionnaires, seminars, hearings, demonstration meetings, written special consultation and other ways to collect relevant information;

(five) according to the collected information and feedback, identify and analyze the risk factors of social stability, and determine the risk points and sources of major administrative decisions;

(six) to formulate preventive measures and emergency plans;

(seven) according to the identified risk points, risk sources and preventive measures, according to the evaluation index, according to the three categories of high risk, medium risk and low risk, determine the risk level;

(eight) the preparation of social stability risk assessment report.

Public solicitation of social opinions shall be conducted in the mainstream media and websites of this Municipality for no less than 10 working days. The number of interested enterprises and representatives of the masses participating in symposiums and demonstration meetings shall not be less than 3/5 of the total number of participants. Experts and professional institutions participating in the demonstration shall sign or seal the opinions on the demonstration.

Information on social stability risk assessment and environmental impact assessment of major administrative decisions can be shared.

To carry out social stability risk assessment of major administrative decisions involving state secrets, we should abide by the relevant state secrecy provisions. Eleventh social stability risk assessment report shall include the following contents:

(a) the basic situation of major administrative decision-making matters;

(two) the subject, method and process of social stability risk assessment;

(three) the reflection of major administrative decisions from all walks of life and decision-making risk analysis;

(4) Risk points and sources of major administrative decisions;

(five) major administrative decision-making risk prevention and resolution measures, as well as emergency plans and other content;

(six) the risk level of major administrative decisions.

The evaluation report shall be submitted by the evaluation subject to the decision-making organ, and the filing procedures shall be performed as required.
