According to the Measures for the Management of Farmers' Housing in Dongguan, villagers who do not meet the construction conditions are encouraged to recycle or transfer their homestead right and farm houses on the ground to eligible villagers (residents).
Severely crack down on illegal buying and selling of homestead, illegal construction and transfer of rural houses, "small property houses" and other illegal acts.
To apply for renovation, reconstruction or new rural housing, the following conditions shall be met:
(1) The land where it is located meets the statutory planning requirements such as land and space planning. During the transition period of land spatial planning, it should conform to the current overall land use planning and the overall urban (town) planning. In accordance with the provisions of Article 10 of these Measures, if the town street delimits the rural residential construction-forbidden area, the construction-restricted area and the construction-permitted area within its jurisdiction, it shall also be implemented in accordance with its provisions.
(two) renovation, reconstruction or new rural housing, should follow the provisions of article eighth of the "one household, one house" principle.
(three) to apply for new rural housing, one of the following conditions must be met:
1. Members of village (community) collective economic organizations.
2. Villages (communities) and residents who are not members of collective economic organizations.
3. It does not belong to the above two situations, but has obtained the right to use the homestead according to law, including obtaining the approval document for the use of the homestead or obtaining the collective land use right certificate/immovable property right certificate.
