Prevention and control measures of diesel motor vehicle exhaust pollution in Shaoxing city

Article 1 In order to prevent and control the exhaust pollution of diesel motor vehicles, protect and improve the atmospheric environment, safeguard public health, and promote the construction of ecological civilization, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations of Zhejiang Province on the Prevention and Control of Air Pollution, the Regulations of Zhejiang Province on the Prevention and Control of Motor Vehicle Exhaust Pollution and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the prevention and control of exhaust pollution of diesel motor vehicles within the administrative area of this Municipality.

The term "diesel power mobile source" as mentioned in these Measures refers to heavy-duty diesel vehicles, off-road mobile machinery and ships powered by diesel.

The term "off-road mobile machinery" as mentioned in these Measures refers to mobile machinery and transportable industrial equipment that are not running on the road and equipped with engines, mainly including construction machinery, agricultural machinery, forestry machinery, material handling machinery, airport ground handling equipment, generator sets and other mechanical equipment. Article 3 The people's governments of cities and counties (cities, districts) shall incorporate the prevention and control of diesel motor vehicle exhaust pollution into the environmental protection planning and environmental protection target responsibility system, ensure capital investment, improve the supervision and management system, and urge relevant departments to perform their supervision and management duties according to law.

City and county (city, district) people's governments shall establish a coordination mechanism to study and solve major problems in the prevention and control of diesel motor source exhaust pollution. Article 4 The Ministry of Ecology and Environment shall exercise unified supervision and management over the prevention and control of exhaust pollution of diesel motor vehicles within its jurisdiction.

Other departments responsible for the supervision and management of atmospheric environmental protection shall supervise and manage the prevention and control of diesel motor source exhaust pollution in related industries and fields according to law.

Township people's governments and sub-district offices shall strengthen the prevention and control of diesel motor vehicle exhaust pollution within their respective jurisdictions, and cooperate with relevant departments to do a good job in relevant supervision and management. Article 5 The municipal competent department of ecological environment shall, jointly with relevant departments, establish an information management system for prevention and control of diesel vehicle mobile source exhaust pollution based on the government data sharing platform, and integrate information resources such as prevention and control policies, emission standards, registration, regular inspection, supervision and sampling inspection, maintenance management, hierarchical management and administrative punishment to realize information sharing and real-time update. Article 6 This Municipality implements the classification management system of diesel mobile sources, and classifies the diesel mobile sources in use into four emission levels: low, medium, high and exceeding the standard according to the emission status of air pollutants. The specific grading scheme is formulated by the municipal ecological environment department according to the national and provincial emission standards and announced to the public.

The municipal ecological and environmental protection department shall, jointly with the relevant departments, formulate the classification management catalogue and classification management implementation plan of diesel motor sources in use. Article 7 The classified management catalogue shall determine the emission level of diesel-powered mobile sources in use according to the results of regular exhaust pollution detection or supervision and sampling inspection, and update and adjust them in real time. For the first time, the non-road mobile machinery in use is classified. If there is no exhaust pollution detection information, it can be classified according to the emission stage set by the factory.

The municipal ecological and environmental department shall promptly inform the owners or users of diesel power mobile sources of the information first included in the classified management list or updated and adjusted. If the owner or user of diesel power mobile source thinks that the classification result is inconsistent with the actual emission situation, he may apply for exhaust pollution detection for verification.

The competent departments of relevant industries shall urge the owners or users of diesel-powered mobile sources to take the initiative to apply for pollutant emission testing. Article 8 The people's governments of cities and counties (cities, districts) and their relevant departments shall take measures such as finance, taxation and government procurement to promote the application of low-emission mobile sources, restrict the development of high-fuel consumption and high-emission mobile sources, promote the elimination, substitution or tail gas treatment and transformation of high-emission mobile sources according to law, and reduce the consumption of fossil energy.

Relevant departments should strengthen the supervision of diesel-powered mobile sources with high emissions and excessive emissions, and increase the frequency of supervision and sampling. Article 9 The people's governments of cities and counties (cities, districts) and their relevant departments shall put forward specific requirements for realizing low emission of diesel-powered mobile sources when promoting cleaner production and carrying out activities such as selecting outstanding civilized construction sites and green units.

City and county (city, district) people's government and its subordinate departments, state-owned enterprises and institutions to purchase goods, projects or services, involving diesel power mobile source, the mobile source should meet the requirements of low emissions; If the purchased diesel-powered mobile source is not low-emission, it should be reformed; If the mobile source used in the procurement project or service is non-low-emission, the supplier should be encouraged to carry out governance and transformation.

Government-invested construction projects should use low-emission mobile sources. Tenth diesel mobile sources shall not exceed the emission standards of atmospheric pollutants.

Heavy-duty diesel vehicles in use shall be regularly tested for exhaust pollution in accordance with the relevant provisions of the state and the province. Only those who pass the inspection can drive on the road. Without passing the inspection, the traffic administrative department of the public security organ shall not issue the safety technical inspection mark.

Motor vehicles and vessels in use whose air pollutant emissions exceed the standard shall be maintained or pollution control technologies shall be adopted; After maintenance or adoption of pollution control technology, it still does not meet the prescribed emission standards, and may not operate. Article 11 The people's governments of cities and counties (cities, districts) shall, according to the needs of the prevention and control of air pollution in their respective administrative areas, delimit and adjust areas where high-emission heavy-duty diesel vehicles are prohibited from passing and areas where high-emission off-road mobile machinery is prohibited from using, and make an announcement to the public.

Roads, urban roads and other road management departments shall, jointly with the traffic management and ecological environment departments of public security organs, set up no-go signs and markings on the no-go sections of high-emission heavy-duty diesel vehicles.

The construction unit shall set up relevant warning signs on the construction site in the forbidden area of high-emission non-road mobile machinery.
