Public credit information refers to social credit information generated or obtained by state organs and organizations authorized by laws and regulations to manage public affairs in the process of performing their statutory duties and providing public services.
Market credit information refers to social credit information generated or obtained by enterprises and institutions such as trade associations, chambers of commerce, credit service institutions, etc. in production, operation and social service activities. Article 3 The collection, collection, disclosure, enjoyment, inquiry and application of social credit information shall be conducted according to law, and shall not endanger national security, public safety and public interests, and shall not disclose state secrets, business secrets and personal privacy to ensure information security. Article 4 The people's governments at or above the county level shall incorporate the construction of social credit system into the national economic and social development plan, establish and improve the coordination mechanism, target responsibility system and assessment system for the construction of social credit system, and promote the construction of social credit system in their respective administrative areas as a whole.
The social credit department of the people's government at or above the county level is responsible for the comprehensive coordination, planning, policy formulation, supervision and management of social credit management, and coordinating the construction, operation and management of the credit information sharing platform at the corresponding level.
The relevant departments of the people's government at or above the county level, such as natural resources and planning, tourism culture, ecological environment, commerce, education, health, public security, housing and urban and rural construction, transportation, market supervision and management, supervision committees, people's courts, people's procuratorates, etc., shall do a good job in relevant social credit work in accordance with the division of responsibilities. Article 5 State organs and organizations authorized by laws and regulations to manage public affairs shall strengthen the application of credit, establish and improve the credit supervision mechanism, and carry out graded supervision over the supervised objects. Article 6 The construction of social credit system should give full play to the role of social organizations such as trade associations and chambers of commerce, and encourage and guide social forces to participate in credit management, service and supervision. Article 7 Encourage the development of credit service industry, and support credit service institutions to provide credit products and services to the society through credit inquiry, credit consultation, credit rating, credit insurance and credit guarantee.
Encourage the inquiry of social credit information and the use of credit products such as credit reports in market transactions, enterprise management, industry self-discipline and financial services.
Encourage credit service institutions to use modern technologies such as big data, cloud computing, blockchain and artificial intelligence to develop credit products with independent intellectual property rights and expand the field of credit application services.
Encourage credit rating agencies to integrate with the international rating market, actively participate in international competition and formulate international standards, and enhance the international influence of rating agencies. Article 8 Hainan Free Trade Port shall establish and improve the social credit system, and strengthen the integrity construction in key areas such as government integrity, business integrity, social integrity and judicial public trust. Ninth people's governments at or above the county level shall strengthen the construction of honesty culture, carry out credit knowledge education, and raise public awareness of law-abiding honesty.
Credit service institutions and other enterprises and institutions shall strengthen their own credit management and guide their own units to enhance their awareness of honest management.
Television, radio, newspapers, internet and other media should carry out publicity and education on honesty culture and create a harmonious atmosphere of honesty society.
The public should be trustworthy and self-disciplined, enhance their sense of integrity, and actively participate in credit education and credit supervision activities. Tenth people's governments at or above the county level and their relevant departments can carry out cross-regional credit system construction cooperation, and promote social credit information sharing, mutual recognition of credit products, trustworthy incentives and disciplinary cooperation. Chapter II Management of Social Credit Information Article 11 Public credit information shall be managed by the directory system. Hainan Free Trade Port implements the basic catalogue of national public credit information.
The competent department of social credit of the provincial people's government shall, jointly with relevant departments, compile the credit information catalogue of Hainan Free Trade Port according to law, and submit it to the provincial people's government for approval before implementation.
The credit information catalogue of Hainan Free Trade Port shall be announced to the public and updated in time. Article 12 State organs and organizations authorized by laws and regulations to manage public affairs shall, in the process of registration, qualification examination, daily supervision and public service, record and store public credit information in accordance with the requirements of public credit information catalogue and relevant standards and norms, and collect it to the credit information sharing platform in a timely, accurate and complete manner. Thirteenth people's governments at or above the county level and relevant departments shall establish and improve the credit commitment system.
Encourage market players to make credit commitments to the society, voluntarily publicize their credit information such as registration, production and operation, contract performance and social welfare, and publish it on government portals or other channels, and make a good faith commitment to the authenticity of the disclosed information. The true, legal and complete information of credit commitment can be used as an important basis for handling administrative license, supervising afterwards, evaluating credit and generating credit report.
