Article 1 In order to regulate the production and business activities of food workshops, small restaurants and food stalls, ensure food safety, and safeguard public health and life safety, these Regulations are formulated in accordance with the Food Safety Law of People's Republic of China (PRC) and other laws and administrative regulations, combined with the actual situation of this province.
Article 2 These Regulations shall apply to the production, management, supervision and service of small food workshops, restaurants and food stalls within the administrative area of this province.
The term "small food workshops" as mentioned in these Regulations refers to operators engaged in food production and processing with fixed production sites, few employees, small scale of production and processing, simple production conditions and technological processes, but does not include primary processors of edible agricultural products.
The term "small-scale catering" as mentioned in these Regulations refers to small restaurants, snack bars, small beverage shops and other operators with business premises below 50 square meters, fixed stores and few employees engaged in catering services.
The term "food stalls" as mentioned in these Regulations refers to operators who engage in food sales or produce and sell food on the spot without fixed stores.
Article 3 Small food workshops, restaurants and food stalls shall engage in food production and marketing activities according to law, ensure that food is hygienic, non-toxic and harmless, be responsible for its food production and marketing safety, accept social supervision and assume social responsibilities.
Article 4 The people's governments at or above the county level shall be responsible for the food safety supervision, management and service of small food workshops, small restaurants and food stalls within their respective administrative areas, include the working funds in the fiscal budget at the corresponding level, strengthen the supervision, management and service capacity building, and provide guarantee for the food safety work.
County (city, district) people's government unified leadership, organization and coordination within their respective administrative areas of food safety supervision and management and service work, the implementation of food safety supervision and management responsibilities.
Township people's governments and sub-district offices shall, in accordance with the responsibilities determined by these regulations and the people's governments at higher levels, do a good job in the supervision, management and service of small food workshops, restaurants and food stalls.
Villagers' committees and residents' committees shall assist township people's governments, sub-district offices and relevant departments to do a good job in the supervision, management and service of food workshops, restaurants and food stalls.
Article 5 The food and drug supervision and administration department of the people's government of a province or a city divided into districts shall strengthen the supervision and guidance on the food safety supervision and management of small food workshops, restaurants and food stalls.
The food and drug supervision and administration department of the county (city, district) people's government is specifically responsible for the supervision and management of food production and business activities in small food workshops, restaurants and food stalls within their respective administrative areas.
Education, public security, urban and rural planning, housing and urban construction, urban management, environmental sanitation, agriculture, health and family planning, environmental protection, industrial and commercial administration, quality and technical supervision and other departments of the people's government at or above the county level shall be responsible for the supervision and management of food workshops, small restaurants and food stalls according to their respective functions and duties.
Article 6 Small food workshops, restaurants and food stalls are encouraged to form or join relevant trade associations and chambers of commerce.
Industry associations and chambers of commerce shall strengthen industry self-discipline, ensure fair competition in the industry, promote the construction of industry integrity, provide training, consultation, rights protection and other services in accordance with the articles of association, and guide and supervise the legal production and operation of small food workshops, restaurants and food stalls.
Seventh county (city, district) people's government shall establish and improve the food safety reporting and reward system of small food workshops, restaurants and food stalls.
Any organization or individual has the right to complain and report illegal acts in the production and operation of small food workshops, small restaurants and food stalls, obtain food safety information from the food and drug supervision and administration department according to law, and put forward opinions and suggestions on supervision, management and service.
Chapter II General Provisions
Article 8 Small food workshops, restaurants and food stalls engaged in production and operation shall meet the following requirements:
(1) Food raw materials and food additives meet food safety standards and relevant state regulations;
(2) Having corresponding dust-proof, fly-proof, rat-proof and insect-proof equipment or facilities;
(3) The packaging materials in contact with food are non-toxic and clean;
(4) The water used meets the hygienic standard for drinking water stipulated by the state;
(5) Containers, tools and equipment for processing, storing, transporting, loading and unloading and selling food are safe and harmless, kept clean and meet the special requirements of food safety, and food shall not be mixed with toxic and harmful substances for storage and transportation;
(six) the use of food additives in line with national standards and regulations;
(7) Employees should maintain personal hygiene and wear clean work clothes and working caps;
(8) The detergents and disinfectants used are safe and harmless to human body;
(nine) the production and business premises are clean and tidy, and keep a safe and harmless distance from the pollution sources;
(ten) abide by the laws, regulations and rules of city appearance and environmental sanitation management.
Small food workshops, restaurants and food stalls engaged in production and operation shall not violate the relevant provisions of Article 34 of the Food Safety Law of People's Republic of China (PRC).
Article 9 Small food workshops, restaurants and food stalls shall regularly conduct self-examination on production and operation conditions. If there are potential safety hazards in food or food raw materials, corrective measures shall be taken immediately.
Tenth this province implements the registration system of small food workshops and restaurants and the filing system of food stalls. There is no charge for registration and filing.
No organization or individual may forge, alter, falsely use, lease, lend, buy or sell registration or filing vouchers.
Food workshops and restaurants applying for food production and business licenses shall be handled by the food and drug supervision and administration department in accordance with the Food Safety Law of People's Republic of China (PRC) and other laws and regulations.
Article 11 Employees in small food workshops, restaurants and food stalls shall have annual health check-ups and obtain valid health certificates before engaging in food production and business activities.
Persons suffering from diseases that hinder food safety as stipulated by the administrative department of health of the State Council shall not engage in direct contact with imported food.
Article 12 Small food workshops, restaurants and food stalls shall examine the licenses or registration certificates and product conformity certificates of suppliers of food raw materials, food additives and food-related products, and keep the purchase vouchers. The storage period of purchase documents shall not be less than six months.
Article 13 Small food workshops, restaurants and food stalls shall post or hang registration vouchers and employees' health certificates in a prominent position in the production and business premises, and publicize information such as the use of food additives and food safety commitments.
Article 14 Centralized trading market operators, counter lessors, exhibition organizers and scenic spot operators shall establish management systems and files for small food workshops, small restaurants and food stalls, check registration and filing certificates, and regularly check the production and operation environment and conditions; If an illegal act is found, it shall be stopped in time and immediately reported to the local food and drug supervision and administration department.
Chapter III Small Food Workshop
Fifteenth small food workshops engaged in food production and processing activities shall meet the following requirements in addition to the provisions of Chapter II of these Regulations:
(a) there is a place suitable for the variety, quantity and quality requirements of the processed food, and the production and processing area is separated from the living area;
(2) Having production and processing equipment or facilities suitable for ensuring food safety;
(3) It has a reasonable equipment layout and technological process, and the utensils and containers for processing raw and cooked foods are used separately, so as to avoid cross-contamination between the foods to be processed and the directly imported foods, raw materials and finished products.
Sixteenth small food workshops to the local county (city, district) people's government food and drug supervision and management departments to apply for registration, shall submit the following materials:
(1) Registration form;
(2) A copy of the business license;
(3) A copy of the applicant's identity certificate;
(4) process flow chart or description;
(5) Health certificates of employees.
Seventeenth county (city, district) food and drug supervision and management departments of the people's government shall review the application materials and conduct on-site inspections when necessary. To meet the requirements, it shall issue the registration certificate of the small food workshop within fifteen days from the date of receiving the application materials, and inform the township people's government or sub-district office where the small food workshop is located of the registration information; If it does not meet the requirements, it shall not be registered and the reasons shall be explained in writing.
The registration certificate for small food workshops is valid for three years. If it is really necessary to extend the validity period, it shall apply to the original registration authority for extension 30 days before the expiration of the validity period.
Article 18 The registration certificate of a small food workshop shall specify the name of the small food workshop, the name of the operator, the registration certificate number, the address of production and processing, the varieties of production and processing, etc.
Where the registered contents of food workshops are changed, it shall apply to the original registration authority for change within 10 days from the date of change, and the registration authority shall complete the formalities within 10 days.
Article 19 Small food workshops shall not produce and process the following products:
(1) Dairy products, canned products, jellies, frozen drinks, alcoholic beverages, beverages (including bottled and barreled drinking water), soy sauce, vinegar and prepackaged meat products;
(2) Health food, infant formula food, formula food for special medical purposes, and other main and supplementary foods specially targeted at specific groups;
(3) Food additives;
(4) Other foods whose production and processing are prohibited by the state, provinces and cities divided into districts.
Article 20 Small food workshops shall truthfully record the quantity of raw materials, the names and uses of food additives, the quantity of finished products and the production date in the production and processing process; The retention period of records shall not be less than one year.
Small food workshops selling the food they produce and process to shopping malls, supermarkets, canteens and catering service units shall provide registration certificates and food inspection certificates.
Small food workshops shall not accept the entrustment of production, processing or sub-packaging of food.
Article 21 Where a small food workshop produces and processes bulk food, it shall indicate the name, production date, shelf life and storage conditions of the food in the form of labels or lists on the food containers. In case of packaging, the name, address, contact information, registration number, food ingredients or ingredient list of the small food workshop shall also be marked on the packaging.
Chapter IV Small Catering
Twenty-second small restaurants engaged in food business activities shall meet the following requirements in addition to the provisions of Chapter II of these Regulations:
(1) Having a fixed place, equipment and facilities to ensure food safety;
(two) utensils and containers for processing raw and cooked food are clearly marked and used separately to avoid cross-contamination;
(3) Providing safe, non-toxic and clean tableware and drinking utensils.
Twenty-third small catering to the local county (city, district) people's government food and drug supervision and management departments to apply for registration, it shall submit the following materials:
(1) Registration form;
(2) A copy of the business license;
(3) A copy of the applicant's identity certificate;
(4) Health certificates of employees.
Article 24 The food and drug supervision and administration department of the county (city, district) people's government shall examine the application materials and conduct on-site inspection when necessary. To meet the requirements, it shall issue a small catering registration certificate within fifteen days from the date of receiving the application materials, and inform the township people's government or the street office where the small catering is located of the registration information; If it does not meet the requirements, it shall not be registered and the reasons shall be explained in writing.
Small catering registration certificate is valid for three years. If it is really necessary to extend the validity period, it shall apply to the original registration authority for extension 30 days before the expiration of the validity period.
Twenty-fifth small catering registration certificate shall specify the name of the small catering, the name of the operator, the registration certificate number, business address, business scope and other contents.
Where the contents of small catering registration are changed, it shall apply to the original registration authority for change within ten days from the date of change, and the registration authority shall complete the formalities within ten days.
Twenty-sixth small restaurants shall not engage in decorative cakes, raw aquatic products and other foods prohibited by the state, provinces and cities divided into districts.
Chapter 5 food stall
Article 27 Township people's governments, neighborhood offices or urban management departments shall, in accordance with the responsibilities determined by the county (city, district) people's governments and the principles of scientific planning, rational layout and convenience for the public, delimit the operating areas and operating periods of food stalls, determine the areas around kindergartens, primary and secondary schools where food stalls are prohibited, and announce them to the public.
Outside the designated area, Township People's governments, sub-district offices or urban management departments may, according to public needs and without affecting safety, traffic, city appearance and environmental sanitation, temporarily designate road sections and time slots on both sides of urban non-main roads for catering stalls to operate.
Twenty-eighth food stalls shall be filed with the local township people's government and street offices, and provide identification, address, business varieties, health certificates and contact information.
Township people's governments and sub-district offices shall make and distribute food stall information publicity boards on the spot according to the filing information, and inform the food and drug supervision and administration department and urban management department of the county (city, district) people's government of the filing information in a timely manner. The information bulletin board shall specify the name of the operator, the variety of business, the place of business, the term of business, etc.
Township People's governments and sub-district offices shall promptly inform food stalls that have not applied for food stall information publicity cards.
Twenty-ninth food stalls engaged in food business activities shall meet the following requirements in addition to the provisions of Chapter II of these Regulations:
(a) there are rain-proof facilities and closed waste containers;
(two) the sale of bulk food, the use of non-toxic and clean packaging materials;
(3) utensils and containers for processing raw and cooked foods should be used separately to avoid cross-contamination;
(4) Providing safe, non-toxic and clean tableware and drinking utensils. If there are no special cleaning and disinfection facilities for tableware and drinking utensils, centralized disinfection or disposable tableware and drinking utensils that meet the requirements shall be used;
(five) shall not interfere with road traffic safety and the normal life of residents;
(6) Clean up the site in time to keep the environment clean and tidy.
Thirtieth food stalls shall not operate the following foods:
(1) Health food, infant formula food, formula food for special medical purposes and other main and auxiliary foods specially targeted at specific groups;
(2) Decorative cakes, raw aquatic products, bulk wine, ready-made dairy products, bulk vinegar, bulk soy sauce and bulk edible oil;
