Provisions of Chongqing Municipality on the Construction and Management of Barrier-free Environment

Chapter I General Principles

Article 1 These Provisions are formulated in accordance with the Law of the People's Republic of China on the Protection of Disabled Persons, the Regulations on the Construction of Barrier-free Environment and relevant laws and regulations, and in light of the actual situation of this Municipality, in order to create a barrier-free environment and ensure the equal participation of disabled persons, the elderly and other social members.

Article 2 These Provisions shall apply to the construction and management of barrier-free environment within the administrative area of this Municipality.

The term "barrier-free environment" as mentioned in these Provisions refers to an environment that facilitates the disabled, the elderly and other members of society in need to independently and safely access roads, relevant buildings, take public transport, exchange information and obtain social services.

Article 3 The construction of barrier-free environment shall follow the principles of practicality, simplicity and extensive benefits, meet the needs of relevant social members for independent travel, convenient communication and access to services, and reflect humanistic care and social support.

Article 4 The people's governments of cities, districts and counties (autonomous counties) shall strengthen their leadership in the construction and management of barrier-free environment, establish and improve a comprehensive coordination mechanism, increase investment in the construction and management of barrier-free environment for public facilities and public services, and incorporate relevant expenditures into the fiscal budget.

Township (town) people's government, street offices with the relevant departments to do a good job in the construction and management of barrier-free environment.

Fifth housing and urban construction department is responsible for the supervision and management of barrier-free facilities construction activities in housing construction and municipal infrastructure projects, and jointly with relevant departments to formulate standards for barrier-free facilities construction.

The transportation department is responsible for the supervision and management of the construction activities of barrier-free facilities of national highways, provincial highways, county roads, passenger terminals, local railways and comprehensive transportation systems, and coordinates and guides the construction, maintenance and transformation of barrier-free facilities of civil airports and national railways.

The network information department is responsible for guiding and coordinating the construction of barrier-free information exchange, supervising and guiding the construction of website barrier-free service capacity, and promoting information barrier-free service.

Departments of development and reform, education, science and technology, economic information, public security, civil affairs, finance, planning resources, urban management, cultural tourism, health and wellness, market supervision, sports, communications, postal management, local finance, press and publication, disabled persons' federations and organizations for the aged shall, according to their respective functions and duties, do a good job in the construction and management of barrier-free environment.

Article 6 The people's governments of cities, districts and counties (autonomous counties) shall organize the preparation of development plans for barrier-free environment construction. The development plan of barrier-free environment construction should be incorporated into the national economic and social development plan, and the space guarantee should also be incorporated into the national land space plan.

The relevant departments of cities, counties (autonomous counties) shall, according to the requirements of the development plan for barrier-free environment construction, prepare a special plan for barrier-free environment construction, and organize the implementation after approval in accordance with the regulations.

The establishment of barrier-free environment construction and development planning and special planning shall solicit the opinions of disabled persons' federations and organizations of the elderly.

Seventh city, county (Autonomous County) departments, disabled persons' federations and organizations of the elderly should strengthen the publicity of barrier-free environment construction, popularize the knowledge of barrier-free environment, and raise the awareness of barrier-free environment of all members of society.

Radio stations, television stations, newspapers and other news media shall, in accordance with the relevant provisions, arrange a certain period of time or layout for public welfare publicity on barrier-free environment construction.

Article 8 Enterprises, universities, scientific research institutions and other organizations are encouraged to carry out research on barrier-free environment construction, and develop, popularize and apply barrier-free new technologies and products.

Encourage citizens, legal persons and other organizations to provide donations and voluntary services for barrier-free environment construction.

Units and individuals that have made remarkable achievements in barrier-free environment construction shall be commended and rewarded in accordance with relevant regulations.

Chapter ii construction of barrier-free facilities

Article 9 The construction of barrier-free facilities for new construction, reconstruction and expansion of roads, public buildings, public transport facilities, residential buildings and residential areas in cities and towns shall conform to the national and municipal standards for barrier-free facilities construction.

Rural areas should carry out the construction of barrier-free facilities in accordance with relevant regulations.

Barrier-free facilities shall be designed, constructed, accepted and put into use simultaneously with the main project. New barrier-free facilities should be connected with the surrounding barrier-free facilities.

Article 10 The construction unit of an engineering construction project shall bear the main responsibility for the quality and safety of barrier-free facilities, and build barrier-free facilities in accordance with laws, regulations, rules, national standards and local standards, and the required funds shall be included in the budgetary estimate of the engineering construction project; In the preparation of the project feasibility study report and design task book, it should include the relevant content of barrier-free facilities construction.

The construction unit shall incorporate the completion acceptance of supporting barrier-free facilities into the project completion acceptance report. Before the completion and acceptance of the barrier-free facilities construction project, the construction unit is encouraged to invite representatives of the disabled, the elderly and other social members to try out the barrier-free facilities for supporting construction and listen to relevant opinions and suggestions.

Eleventh projects involving the following contents shall meet the national and municipal standards for the construction of barrier-free facilities:

(1) Urban roads, urban squares and other public areas;

(two) residential buildings, residential areas and other living areas;

(three) public buildings such as education, medical rehabilitation, welfare and special services, sports, commercial services, culture, public parking lots;

(four) other public places closely related to the lives of the disabled, the elderly and other members of society.

The construction drawing review institution shall review the design documents in accordance with the standards for the construction of barrier-free facilities, and shall not issue a certificate of conformity for the design documents that should be designed with barrier-free facilities or whose design does not meet the standards.

Twelfth construction units and supervision units shall carry out the construction and supervision of barrier-free facilities in accordance with the construction drawing design documents and construction technical standards that have passed the examination.

Thirteenth housing and urban and rural construction, transportation and other departments and their entrusted construction engineering quality supervision institutions shall supervise the quality behavior of barrier-free facilities construction of the construction unit, construction unit, supervision unit and other relevant units. The construction project quality supervision report submitted by the construction project quality supervision institution shall include the contents of barrier-free facilities construction.

Article 14 For roads, public buildings, public transport facilities, residential buildings and residential areas that have been built in cities and towns and do not meet the standards for the construction of barrier-free facilities, the people's governments of districts and counties (autonomous counties) shall formulate plans for the renovation of barrier-free facilities and link them with the plans for infrastructure construction and renovation.

The owner or manager is responsible for the renovation of barrier-free facilities.

Fifteenth counties (autonomous counties) people's government should give priority to the following institutions and places for barrier-free facilities transformation:

Special education, rehabilitation, support, trusteeship, social welfare and other institutions;

(2) Public service places of state organs;

(3) Public service places of cultural, sports, medical and health units;

(4) Public service places such as transportation, finance, postal services, commerce and tourism.

Article 16 Pedestrian overpasses and underpasses in urban main roads, major commercial districts and large residential areas shall be equipped with barrier-free facilities in accordance with the standards for the construction of barrier-free facilities, and sidewalk traffic signal facilities shall gradually improve the barrier-free service function to meet the needs of the disabled, the elderly and other members of society.

Seventeenth public parking lots, construction parking lots, on-street parking spots should be in accordance with the national and municipal standards for the construction of barrier-free facilities, set up barrier-free parking spaces in convenient locations, and set up prominent signs.

Barrier-free parking spaces are reserved for motor vehicles driven or taken by people with physical disabilities.

Eighteenth new civil aircraft, passenger trains, passenger ships, buses, urban rail transit vehicles and other public transport vehicles shall meet the requirements of barrier-free facilities in accordance with the relevant provisions of the state and this Municipality. Existing public transport vehicles should gradually meet the requirements of barrier-free facilities.

Urban rail transit vehicles and buses should be equipped with voice and subtitle station reporting systems, and emergency flash warning systems should be installed if conditions permit.

Nineteenth visually impaired people carrying guide dogs in and out of public places and taking public transport shall carry relevant certificates and abide by the relevant provisions of the state. Staff in public places and public transport vehicles shall provide barrier-free services in accordance with relevant state regulations.

Article 20 The owners and managers of barrier-free facilities shall protect barrier-free facilities, repair them in time if any damage or failure is found, and ensure the normal use of barrier-free facilities.

No organization or individual may damage or occupy barrier-free facilities or change the use of barrier-free facilities without authorization. If it is necessary to temporarily occupy barrier-free facilities due to special circumstances such as urban construction, relevant procedures shall be handled according to law, protective devices and warning signs shall be set up, and necessary alternative measures shall be taken. When the temporary occupation expires, barrier-free facilities shall be restored in time.

Chapter III Barrier-free Information Exchange

Twenty-first cities, districts and counties (autonomous counties) people's governments shall incorporate the construction of barrier-free information exchange into the information construction plan, and take measures to promote the construction of barrier-free information exchange.

The people's governments of cities, districts and counties (autonomous counties) shall incorporate information accessibility into the construction of digital society, digital government and smart city.

Article 22 The people's governments of cities, districts and counties (autonomous counties) and their relevant departments shall provide information exchange services such as voice and text prompts and sign language when releasing important government information, emergency information and information involving the disabled, the elderly and other social members.

Article 23 The examination organizing unit shall provide convenience for all kinds of entrance examinations, vocational qualification examinations and on-the-job examinations attended by disabled persons, and provide services such as Braille examination papers, posters examination papers, electronic examination papers, sign language, text signs, shorthand recording or voice-to-text conversion, wearing hearing AIDS or cochlear implants, extending the examination time, etc. for corresponding categories of disabled persons, and may be assisted by staff when necessary.

Twenty-fourth TV stations set up by the people's governments of cities, districts and counties (autonomous counties) should be equipped with subtitles to broadcast TV programs, and sign language news programs 1 times or more every week. If conditions permit, special programs for the disabled and the elderly should be developed.

The publicly published film and television video products shall be accompanied by subtitles.

Article 25 Public libraries established by the people's governments of cities, districts and counties (autonomous counties) shall set up barrier-free reading rooms, promote the digitalization of books, and provide Braille books, audio books and barrier-free information retrieval equipment for the disabled, the elderly and other members of society.

Encourage other qualified libraries to open reading rooms for visually impaired people and provide braille books, audio books and barrier-free information retrieval equipment.

Twenty-sixth websites of disabled people's organizations should meet the design standards of barrier-free websites, and the websites of people's governments of cities, districts and counties (autonomous counties) and government public welfare activities should gradually meet the design standards of barrier-free websites.

Encourage other qualified websites to meet the design standards of barrier-free websites.

Article 27 Public service institutions and public places such as public utilities, transportation, finance, postal services, communications, commerce, tourism, culture, sports, medical care and health should create conditions to provide information exchange services such as voice and text prompts, sign language and Braille for the disabled, the elderly and other members of society, and train their staff in barrier-free service skills.

Civil affairs, human resources and social security, township (town) people's governments, sub-district offices and other departments and units responsible for social public services should set up Braille signs, touch voice broadcasters or subtitles and other prompt devices in a prominent position, and their staff should take the initiative to provide consulting and guidance services for members of society such as the disabled and the elderly.

Government service agencies at all levels should provide necessary barrier-free services for the disabled, the elderly and other members of society, and give priority to related matters.

Twenty-eighth meetings, lectures, training, performances and other public activities, the organizer shall provide explanations, subtitles or sign language and other information exchange services.

Article 29 The relevant departments of cities, districts and counties (autonomous counties) and units providing public services shall take measures to popularize and apply intelligent information services that meet the needs of the disabled, the elderly and other social members and provide corresponding support, respect the habits of the disabled and the elderly, retain and improve the traditional service methods, and promote the integrated development and complementary advantages of online and offline services.

When providing telecommunication services, telecommunication business operators shall provide information exchange services such as voice and text prompts to the disabled, the elderly and other members of society in need.

Telecom terminal equipment manufacturers should provide technologies and products that can be connected with barrier-free information exchange services.

Encourage disabled persons' federations, organizations of the elderly and training institutions to carry out special training to help members of society such as the disabled and the elderly improve their ability to use intelligent technology.

Article 30 Relevant departments of cities, counties (autonomous counties), disabled persons' federations and organizations of the elderly shall guide and encourage relevant scientific research institutions, enterprises or individuals to carry out research on barrier-free environment construction projects, and develop, popularize and apply barrier-free maps, teaching materials, translation software and other technologies, products and services to meet the needs of barrier-free information exchange.

Chapter IV Barrier-free Social Services

Article 31 The people's governments of cities, districts and counties (autonomous counties) shall gradually improve the emergency information systems such as alarm, medical first aid and emergency evacuation, and carry out emergency sign language training to facilitate the disabled, the elderly and other social members to call for help.

Thirty-second city, county (Autonomous County) departments, township (town) people's government, street offices should promote the construction and transformation of residential and community barrier-free facilities, to create a barrier-free living environment for the disabled, the elderly and other members of society. Village (neighborhood) committees shall assist in the construction and renovation of barrier-free facilities.

In rural construction, urban renewal, transformation of old urban communities and residential community construction, the construction and transformation of barrier-free facilities should be implemented simultaneously.

Encourage and support institutions that provide centralized support and custody services for members of society such as the disabled and the elderly, and promote the construction and transformation of barrier-free facilities in the living environment.

Thirty-third support residents to transform existing residential buildings and family barrier-free facilities. The people's governments of cities, districts and counties (autonomous counties) may give appropriate subsidies to the transformation of family barrier-free facilities for the disabled, the elderly and other social members who meet the requirements.

Disabled people, the elderly and other social members to carry out the transformation of family barrier-free facilities, without affecting the safety and use of others, the housing management department, property service enterprises or other managers should provide support and convenience for their transformation.

Encourage and support social forces to carry out public welfare activities for the renovation of family barrier-free facilities, and provide support and guarantee for the renovation of family barrier-free facilities for the disabled, the elderly and other members of society.

Thirty-fourth kindergartens, primary and secondary schools, secondary vocational schools, technical colleges, universities and other schools at all levels should provide necessary barrier-free services for disabled students in barrier-free facilities, education, teaching and life.

Thirty-fifth centralized employment units for the disabled shall provide barrier-free facilities and equipment, information exchange and other services for the disabled to meet their barrier-free needs in production and life.

Thirty-sixth hospitals, community health service centers (stations), hospitals and other medical institutions shall, in accordance with the relevant provisions, open special windows or fast tracks for the disabled, the elderly and other social members to seek medical treatment, and provide convenient services such as priority registration and medical guidance.

Encourage medical institutions to set up barrier-free clinics to provide text prompts and sign language services for hearing and language disabled people.

Article 37 Public cultural facilities and tourist attractions such as museums, art galleries, science and technology museums, theaters and community cultural activity centers established by the government shall provide wheelchair, audio-visual guidance or sign language and other barrier-free services for the disabled, the elderly and other social members in accordance with relevant cultural tourism service standards.

Encourage other qualified public cultural facilities and tourist attractions to provide barrier-free services.

Thirty-eighth encourage and support organizations and individuals providing legal aid to provide services in Braille and sign language for the disabled, the elderly and other members of society.

Article 39 State organs, social organizations, grass-roots mass autonomous organizations, owners' committees and other units that organize elections shall provide convenience for the disabled, the elderly and other members of society to participate in the elections, and provide braille votes for the visually disabled and text prompts and sign language services for the hearing disabled as needed.

Chapter V Supervision and Administration

Fortieth city, county (Autonomous County) relevant departments shall establish a complaint mechanism for barrier-free environment construction and use, and connect with the municipal government service hotline. Any organization or individual has the right to complain and report the damage, occupation and change of use of barrier-free facilities. After receiving complaints and reports, the relevant departments shall timely register and handle them according to law.

Forty-first city, county (Autonomous County) relevant departments can take on-site inspection, inquiry, access to information and other ways to supervise and inspect the following contents:

(a) the implementation of the barrier-free environment construction plan and the implementation of the barrier-free facilities renovation plan;

(two) the construction, design, construction, supervision and other units and related institutions to implement the relevant provisions of barrier-free environment construction;

(3) Research and development, popularization and application of barrier-free information technologies and products;

(four) other barrier-free environment construction.

Forty-second cities, districts and counties (autonomous counties) relevant departments may entrust third-party institutions to evaluate and inspect the construction of barrier-free environment.

Forty-third disabled persons' federations and organizations of the elderly have the right to reflect the barrier-free environment needs of the disabled, the elderly and other members of society to the relevant departments, and put forward opinions and suggestions on strengthening and improving the construction and management of barrier-free environment. Relevant departments should effectively respond to reasonable demands and formulate improvement measures.

Forty-fourth units and individuals in violation of the relevant provisions of barrier-free environment construction and management, administrative penalties and other untrustworthy information, according to the law into the city's public credit information platform to be * * * to enjoy and implement the corresponding punishment.

Chapter VI Supplementary Provisions
