Interim Measures of Jilin Municipality on the Administration of Sports Market

Article 1 In order to accelerate the formation of sports industrialization, promote the prosperity and development of sports industry, strengthen the management of sports market, and protect the legitimate rights and interests of sports operators and consumers, these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 The term "sports market" as mentioned in these Measures refers to the business activities with sports activities as the content for profit, and its management scope includes:

(1) Sports competitions and performances;

(2) Physical rehabilitation and physical training;

(three) sports intermediary services, information consulting, sports lottery;

(four) the management and development of sports intangible assets;

(five) the construction of sports facilities, the utilization and development of sports resources;

(6) Other sports business activities and projects. Article 3 All units and individuals engaged in sports business activities within the administrative area of this Municipality must abide by these measures. Article 4 The municipal and county (city) sports administrative departments shall be responsible for the supervision, inspection and management of the sports market within their respective jurisdictions, and their duties shall be:

(a) the implementation of laws and regulations on the management of sports market, establish and improve the management system of sports market;

(two) planning the layout of operating sports venues;

(three) training sports operators and business instructors, and issuing professional qualification certificates;

(4) Examining the contents and conditions of business activities and applying for a business license;

(five) supervision and inspection of sports business activities, investigate and deal with illegal acts.

Public security, industry and commerce, price, health, environmental protection and other departments shall, according to their respective responsibilities, cooperate with the sports administrative department to do a good job in the management of the sports market. Article 5 Units and individuals engaged in sports business activities shall meet the following conditions:

(1) Conforming to the development plan and layout of sports undertakings;

(2) Having the necessary funds and corresponding facilities;

(three) the stadium and sports equipment meet the standards prescribed by the state;

(4) Having managers and business guidance personnel who have obtained vocational qualification certificates through on-the-job training;

(5) It meets other conditions stipulated by relevant state laws and regulations. Article 6 Where any unit or individual with the qualification of independent legal person for sports business is engaged in sports training, competition, performance, rehabilitation, intermediary service, consultation and the utilization and development of sports resources, the operator must apply to the municipal sports administrative department for the Sports Business License with valid certificates and go through the formalities with the relevant departments before starting business.

Personnel engaged in various sports technical training, sports consulting services and sports intermediary services must pass the examination of the municipal sports administrative department and receive the qualification certificate of sports management professionals. Seventh temporary sports business activities (including self-organized sports competitions and performances in stadiums) must be applied to the sports administrative department in advance, and can only be carried out after examination and approval.

Holding international, national and inter-provincial business sports competitions and performances shall be examined by the sports administrative department and submitted for approval in accordance with relevant regulations. Article 8 The operation and sales of sports lottery tickets shall be uniformly organized and implemented by the Municipal Sports Lottery Distribution Center according to the distribution plan approved by the provincial sports administrative department and the People's Bank of China. Article 9 Units and individuals engaged in sports business activities and applying for holding temporary sports business activities shall submit the following materials when applying for sports business licenses and temporary sports business licenses:

(1) An application report;

(2) Professional certificate;

(three) the implementation plan of business activities;

(4) Description of the venue and sports facilities, equipment and equipment;

(5) A copy of the relevant contract or agreement.

Engaged in dangerous sports business activities, must also provide a detailed feasibility report. Tenth sports operators, business scope, venues and other changes, should go through the formalities of change to the original approval department. Eleventh units and individuals engaged in sports business activities shall carry out sports business activities within the approved scope, ensure the quality of service, and pay various taxes and fees according to law. Twelfth operators of sports business activities, engaged in sports business activities for more than one year, must accept the annual inspection of sports business activities. Thirteenth units and individuals engaged in sports business activities shall not have the following acts:

(a) fraud, cheating sports consumers;

(2) exaggerating violence, gambling in sports competitions or gambling in disguised form, and engaging in feudal superstitious activities;

(3) employing persons who have not obtained post certificates to engage in sports coaching, technical training, emergency rescue and other work;

(four) other acts prohibited by laws and regulations. Fourteenth sports facilities, equipment and equipment used in sports business activities should be kept in good condition to ensure normal use and safety. Fifteenth operators must accept the supervision and inspection of the sports administrative department, truthfully reflect the situation, provide the materials needed for inspection, and shall not hinder law enforcement officers from performing their official duties. Sixteenth in violation of these measures, one of the following acts shall be punished by the sports administrative department or in conjunction with other departments.

(a) in violation of the provisions of article sixth, did not apply to the sports administrative department for the "sports business license", given a warning, ordered to make corrections within a time limit, and impose a fine of 1000 yuan to 10000 yuan;

(two) in violation of the provisions of article tenth, article twelfth, not to the sports administrative department for the change of sports venues, annual inspection procedures, given a warning, ordered to make corrections within a time limit, and impose a fine of more than 5,000 yuan in 500 yuan;

(three) in violation of the provisions of article thirteenth, fraud, violence, gambling in sports competitions or in disguised form, engaging in feudal superstitious activities and other activities. , ordered to make corrections within a time limit, and imposed a fine of more than 654.38+10,000 yuan and less than 654.38+10,000 yuan.
