Regulations of Dalian Municipality on the Administration of Sports Business Activities

Article 1 In order to standardize sports business activities, safeguard consumers' legitimate rights and interests and promote the development of sports industry, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to sports business activities and their management within the administrative area of this Municipality. Article 3 The sports business activities mentioned in these Regulations refer to the following business activities for profit:

(a) sports competitions, performances, fitness, rehabilitation, entertainment and technical training with sports as the content;

(two) sports lottery, advertising, commercial sponsorship, information consulting and brokerage;

(three) the business activities of stadiums and other sports franchise places;

(four) the use of sports organization names, sports special signs and other business activities;

(5) Other sports business activities.

The sports mentioned in the preceding paragraph are divided into high-risk sports and general sports.

High-risk sports events refer to the events in the Catalogue of High-risk Sports Events published by the state.

General sports refers to other sports except high-risk sports, and the specific scope is announced by the municipal sports department. Fourth city and district (city) county sports authorities in accordance with the division of responsibilities, responsible for the management of sports business activities.

The relevant departments of the municipal and district (city) county people's governments shall, in accordance with their respective responsibilities, do a good job in the management of sports business activities.

The agency of the Municipal People's Government with administrative functions is responsible for the management of sports business activities in this area according to the authorization. Article 5 Citizens, legal persons and other organizations are encouraged to engage in sports business activities according to law.

Encourage and support operators to carry out national fitness activities, cultivate outstanding sports talents, and commend and reward operators who have made remarkable achievements. Article 6 To operate high-risk sports, the following conditions shall be met:

(a) the relevant sports facilities meet the national standards;

(two) there are social sports instructors and rescuers who have reached the required number and obtained the national vocational qualification certificate;

(3) There are safety guarantee systems and measures such as post responsibility system for production safety, safety operation rules, emergency plan for emergencies, and safety inspection system for sports facilities, equipment and equipment;

(4) Other conditions stipulated by laws and regulations. Article 7 To operate high-risk sports events, an application for administrative license shall be made to the sports authorities. After obtaining the business license for high-risk sports, the applicant shall go through the registration formalities with the corresponding administrative department for industry and commerce with the license.

The license shall not be altered, leased, lent or traded.

Where the matters specified in the license change, the operator shall apply to the sports administrative department that made the decision on administrative license for change, and go through the registration of change with the corresponding administrative department for industry and commerce with the changed license. Article 8 To apply for operating high-risk sports, the following materials shall be submitted:

(1) An application, including the name and domicile of the applicant, the high-risk project to be operated, and the name, address and business place of the business organization to be established;

(2) Explanations that the sports facilities meet the relevant national standards;

(three) the proof of the ownership or use right of the sports ground;

(four) the professional qualifications of social sports instructors and rescuers;

(5) Safety systems and measures;

(six) other materials as prescribed by laws and regulations. Ninth general sports should be registered in the administrative department for Industry and commerce within thirty days after the registration, to the sports authorities for the record. Tenth sports competitions and performances shall meet the following conditions:

(1) Being able to bear civil liability independently;

(two) there are rules and organizational implementation plans for sports competitions and sports performances;

(3) Having organizations, managers and professional and technical personnel suitable for the scale and content of sports competitions and sports performances;

(4) Having funds commensurate with the scale of sports competitions and sports performances;

(5) Sites, facilities and equipment, etc. Adapting to the scale and content of sports competitions and sports performances;

(6) Other conditions stipulated by laws and regulations.

Operators who change the content, time and venue of sports competitions and sports performances shall go through the formalities with the relevant departments according to law. Article 11 If all kinds of comprehensive sports games, individual sports competitions and other social-oriented sports competitions held in this Municipality are named after administrative regions or synonyms, relevant procedures shall be handled in accordance with the provisions of laws and regulations. Twelfth engaged in sports lottery, advertising, commercial sponsorship, information consulting and brokerage and other sports business activities, should go through the relevant procedures in accordance with the provisions of laws and regulations. Thirteenth sports names, emblems, flags and mascots shall be protected in accordance with the relevant provisions of the state.

Those who use the above signs to engage in sports business activities shall obtain the consent of the right holder. Fourteenth operators should be equipped with and use the corresponding facilities, equipment and equipment in accordance with the provisions, and timely maintenance, to ensure their safe and normal use.

For sports events that may endanger the personal safety of consumers, operators shall explain the use methods and safety requirements of the equipment, set up eye-catching warning signs and take corresponding preventive measures.
