2. Conduct labor ability appraisal. After it is recognized as a work-related injury, it is necessary to compensate for the work-related injury. The amount of compensation is calculated according to the degree of work-related injury and related compensation items. The appraisal of the degree of industrial injury and disability also involves the appraisal of labor ability. If the laborer loses the ability to work, even if the laborer is not dead, the employer still has to bear the compensation for the living expenses of the dependents.
3. Conciliation, arbitration or litigation. After the work-related injury is identified and the amount of work-related injury compensation is calculated, both parties can negotiate on the compensation method and amount. If it can be resolved through consultation, it is the best. If negotiation fails, workers can only resort to arbitration and litigation to safeguard their rights and interests.
