(a) a legal person established in People's Republic of China (PRC) for more than 3 years according to law, with no criminal record;
(2) Undertaking or intending to undertake scientific research and production of weapons and equipment, and the products involve state secrets;
(3) Foreign investors and their concerted actions have no overseas (including Hong Kong, Macao and Taiwan) holding or direct investment, and the proportion of indirect investment ultimately does not exceed 20%;
(4) The legal representative, principal responsible person, actual controller, directors (supervisors), senior managers and personnel who undertake or intend to undertake the scientific research and production tasks of classified weapons and equipment have China nationality, have no permanent residence or long-term residence permit abroad, and have no marriage relationship with overseas personnel (including Hong Kong, Macao and Taiwan);
(5) Having a fixed place for scientific research, production and office, and having the ability to undertake scientific research and production tasks of classified weapons and equipment;
(six) a sound security system, a specialized agency or personnel responsible for security work, security sites, facilities and equipment in line with national security laws and standards;
(7) 1 year without leakage;
(eight) other conditions stipulated by laws, administrative regulations and the state secrecy administrative department.
A listed company applying for confidentiality qualification shall meet the following conditions in addition to the above conditions:
(1) It has not been subject to administrative punishment by the securities regulatory agency in the last three years;
(2) Perfect internal control and information disclosure system;
(3) The actual controller promises to keep the control position unchanged during the application period and the validity period of confidentiality qualification.
