The term "green building" as mentioned in these Regulations refers to high-quality civil buildings that save resources, protect the environment, reduce pollution, provide people with healthy, applicable and efficient use space, and achieve harmony between man and nature. Article 3 The development of green buildings shall implement the new development concept and follow the principles of government guidance, market promotion, all-round promotion and local conditions. Article 4 The people's governments at or above the county level shall incorporate the development of green buildings into the national economic and social development plan, improve supporting policies such as finance, finance, land, planning and construction, and incorporate the completion of green building development goals into the performance appraisal of government target management. Fifth people's governments at or above the county level shall be responsible for the guidance, supervision and management of green building activities within their respective administrative areas.
The development and reform, economy and informatization, natural resources, ecological environment, agriculture and rural areas, water administration, transportation, science and technology, finance, market supervision and management, urban management and other departments of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in the development of green buildings. Article 6 People's governments at or above the county level and their relevant departments shall publicize green building laws, regulations and related knowledge in various forms, guide the public to establish green development awareness, and promote the formation of green ecological development mode and lifestyle. Seventh people's governments at or above the county level shall encourage and support the research, development, demonstration and popularization of green building technology, and promote the progress and innovation of green building technology.
Strengthen the professional and technical training of employees in the field of green building and continuously improve their professional and technical level.
Units and individuals that have made remarkable achievements in the development of green buildings shall be commended and rewarded by the people's governments at or above the county level in accordance with the relevant provisions of the state and the province. Chapter II Planning and Construction Article 8 Green buildings are divided into basic, one-star, two-star and three-star standard grades according to state regulations.
New civil buildings shall be built within the scope of construction land determined by the land and space planning of cities, counties (cities) and towns with districts, and shall be built according to the standard grade of not less than basic green buildings.
Large-scale public buildings and public buildings invested by the government should be built according to the standard grade of green buildings above one star.
The municipal people's government with districts may stipulate the implementation of higher green building standards. Article 9 The competent departments of housing and urban and rural construction of the people's governments at or above the county level shall organize the preparation of special plans for the development of green buildings, which shall be announced to the public after being approved by the people's governments at the corresponding levels.
The special plan for the development of green buildings shall specify the development objectives, key development areas and industrialization requirements of new buildings, and determine the standard grade requirements of green buildings for all kinds of new civil buildings.
The special planning for the development of green buildings shall conform to the national spatial planning, and be connected with the special planning of energy, water resources, comprehensive utilization of solid waste, green transportation, development and utilization of underground space, etc. Article 10 The detailed planning prepared by the competent department of natural resources of the people's government of a city or county (city) divided into districts shall reflect the requirements of green building development.
The contract for the assignment of the right to use state-owned construction land or the decision on the allocation of state-owned construction land, as well as the construction project planning permit, shall indicate the requirements for the grade of green building standards determined by the planning conditions of construction land. Eleventh the feasibility study report or project application report of new civil construction projects compiled by the construction unit shall include the requirements of green building standards.
When carrying out consultation, design, construction, supervision, inspection and testing, procurement of materials and equipment and related bidding activities, the construction unit shall clearly indicate the green building standard grade or parameter requirements of the construction project to the relevant units. Twelfth design units should be in accordance with the requirements of the standard grade of green building engineering design and construction drawing design. Construction drawing design documents shall include the contents of green building design. Thirteenth construction drawing design documents review institutions shall, in accordance with the requirements of green building standards, review the construction drawing design documents. Without examination or examination does not meet the requirements, shall not issue a certificate of examination of construction drawing design documents.
If the construction drawing design document changes the standard grade of green building, it shall be re-examined. Fourteenth construction units shall, in accordance with the construction drawing design documents that have passed the examination, prepare a construction plan that meets the standard grade of green buildings, and publicize the standard grade and main technical indicators of green buildings on the construction site.
The construction unit shall inspect the wall materials, insulation materials, energy-saving doors and windows, heating and refrigeration systems, lighting equipment, non-traditional water facilities, water-saving appliances and other building materials, building components and facilities and equipment entering the construction site; Do not meet the requirements of the construction drawing design documents, shall not be used.
