Chapter I General Principles
Article 1 This Law is formulated in order to carry forward the fine tradition of the Chinese nation of attaching importance to family education, guide the whole society to attach importance to family, family education and family style, enhance family happiness and social harmony, and cultivate socialist builders and successors with all-round development in morality, intelligence, physique, beauty and labor.
Article 2 Family education as mentioned in this Law refers to the cultivation, guidance and influence of parents or other guardians on minors' moral quality, physical quality, life skills, cultural accomplishment and behavior habits, so as to promote their all-round and healthy growth.
Article 3 Family education takes moral education as its fundamental task, cultivates and practices socialist core values, promotes the excellent traditional culture, revolutionary culture and advanced socialist culture of the Chinese nation, and promotes the healthy growth of minors.
Fourth parents or other guardians have the responsibility to carry out family education for minors. The state and society provide guidance, support and services for family education. State functionaries should take the lead in establishing a good family style and perform their family education duties.
Article 5 Family education shall meet the following requirements:
(a) respect for minors' physical and mental development laws and individual differences;
(2) Respecting the personal dignity of minors, protecting their privacy and personal information, and protecting their legitimate rights and interests; (3) Follow the characteristics of family education and implement scientific family education concepts and methods;
(4) Family education, school education and social education are closely combined and coordinated;
(5) Take flexible and diverse measures according to the actual situation.
Article 6 People's governments at all levels shall guide family education and establish and improve the social cooperative education mechanism of family schools. The people's governments at or above the county level shall be responsible for the work of women and children, and organize, coordinate, guide and urge the relevant departments to do a good job in family education. The administrative department of education and women's federations shall co-ordinate social resources, promote the construction of family education guidance service system covering urban and rural areas, and undertake the daily affairs of family education work according to the division of responsibilities. Departments of spiritual civilization construction at or above the county level, such as public security, civil affairs, judicial administration, human resources and social security, culture and tourism, health and sanitation, market supervision and management, radio and television, sports, press and publication, and online information, and relevant departments of people's governments at or above the county level shall do a good job in family education within their respective functions and duties.
Article 7 The people's governments at or above the county level shall formulate special plans for family education, incorporate family education guidance services into the urban and rural public service system and the catalogue of government-purchased services, incorporate relevant funds into the fiscal budget, and encourage and support the provision of family education guidance in the form of government-purchased services.
Article 8 People's courts and people's procuratorates shall play a functional role, cooperate with the people's governments at the same level and their relevant departments to establish a linkage mechanism for family education and do a good job in family education.
Article 9 Trade unions, communist youth leagues, disabled persons' federations, science and technology associations, committees for caring for the next generation, residents' committees and villagers' committees shall actively carry out family education in combination with their own work and provide social support for family education.
Article 10 The State encourages and supports enterprises, institutions, social organizations and individuals to carry out public welfare family education service activities according to law.
Article 11 The State encourages research on family education, encourages colleges and universities to offer specialized courses on family education, supports qualified normal universities to strengthen the discipline construction of family education, and trains professionals in family education services.
Article 12 The state encourages and supports natural persons, legal persons and unincorporated organizations to donate or provide voluntary services for family education, and gives tax concessions to those who meet the requirements according to law. The state shall commend and reward organizations and individuals that have made outstanding contributions to family education in accordance with relevant regulations.
Article 13 The week of International Family Day on May 15 every year is the National Family Education Publicity Week.
Chapter II Family Responsibility
Article 13 Parents or other guardians should establish a sense of responsibility that the family is the first class and the parents are the first teachers, undertake the main responsibility of family education for minors, and educate minors to develop good thoughts, conduct and habits with correct thoughts, methods and behaviors. * * * Other family members who live together and have full capacity for civil conduct shall assist and cooperate with the parents or other guardians of minors to carry out family education.
Article 14 Parents or other guardians of minors and other family members should attach importance to family building, cultivate a positive and healthy family culture, establish and inherit a fine family style, carry forward the family virtues of the Chinese nation, build a civilized and harmonious family relationship, and create a good family environment for the healthy growth of minors.
Fifteenth parents or other guardians of minors shall, according to the characteristics of physical and mental development of minors of different ages, carry out family education under the guidance of the following contents:
(1) Educate minors to love the party, patriotism, people, collectives and socialism, establish the concept of safeguarding national unity, cast a solid sense of the Chinese nation, and cultivate feelings of home and country;
(two) to educate minors to respect the old and love the young, love the family, be diligent and thrifty, unite and help each other, be honest and friendly, and abide by the law, and cultivate their good social morality, family virtues, personal moral awareness and awareness of the rule of law;
(three) to help minors establish a correct concept of success, guide them to cultivate a wide range of hobbies, healthy aesthetic pursuit and good study habits, and enhance the spirit of scientific exploration, innovative awareness and ability;
(four) to ensure that minors are balanced in nutrition, scientific in sports, adequate in sleep and happy in body and mind, guide them to develop good living habits and behavior habits, and promote their healthy physical and mental development;
(5) Pay attention to the mental health of minors, teach them to cherish their lives, educate them on safety knowledge such as transportation, healthy surfing and prevention of bullying, drowning, fraud, trafficking and sexual assault, help them master safety knowledge and skills, and enhance their awareness and ability of self-protection;
(six) to help minors to establish a correct concept of labor, to participate in the work within their ability, to improve their ability to take care of themselves and live independently, and to develop an excellent character of hard work and a good habit of loving labor.
Article 17 When carrying out family education, parents or other guardians of minors should pay attention to the physical, psychological and intellectual development of minors, respect their right to participate in related family affairs and express their opinions, and rationally use the following ways and means: (1) raising by themselves and strengthening parent-child companionship;
(two) * * * with participation, play the role of parents;
(3) Video teaching, which integrates teaching into daily life;
(4) imperceptibly, combining words and deeds with examples;
(5) Combining leniency with severity, paying equal attention to care and strict requirements;
(six) respect for differences, according to the age and personality characteristics of scientific guidance;
(seven) equal exchange, respect, understanding and encouragement;
(eight) mutual promotion, parents and children grow together;
(nine) other ways and means conducive to the all-round development and healthy growth of minors.
Article 18 Parents or other guardians of minors should establish a correct concept of family education, consciously learn family education knowledge, conduct targeted studies during pregnancy and during the important period when minors enter kindergartens, kindergartens, primary and secondary schools, master scientific family education methods, and improve their family education ability.
Nineteenth parents or other guardians of minors should closely cooperate with primary and secondary schools, kindergartens, infant care services and communities, and actively participate in the public welfare family education guidance and practical activities provided by them to promote the healthy growth of minors.
Article 20 If a minor's parents are separated or divorced, they shall cooperate with each other to fulfill their family education responsibilities, and neither party may refuse or delay the performance; Unless otherwise provided by law, the other party shall not be prevented from carrying out family education.
Article 21 If parents or other guardians entrust others to take care of minors according to law, they shall keep in touch with the clients and minors, regularly learn about their study, living conditions and psychological conditions, and jointly perform their family education responsibilities with the clients.
Twenty-second parents or other guardians of minors should reasonably arrange the time for minors to study, rest, entertain and exercise, so as to avoid increasing the learning burden of minors and prevent minors from indulging in the Internet.
Twenty-third parents or other guardians shall not discriminate against minors because of their sex, physical condition, intelligence and other reasons. No domestic violence, no coercion, inducement, instigation, connivance or use of minors to engage in activities that violate laws, regulations and social morality.
Chapter III State Support
Twenty-fourth the State Council shall organize the relevant departments to formulate, revise and timely publish the national family education guidance program. The people's governments at the provincial level or the people's governments at the municipal level with districts where conditions permit shall organize relevant departments to compile or adopt family education guidance books suitable for local conditions, and formulate corresponding work norms and evaluation norms for family education guidance services.
Twenty-fifth people's governments at or above the provincial level shall organize relevant departments to co-ordinate the construction of family education information service platform, set up public welfare online parent schools and online courses, open service hotlines, and provide online family education guidance services.
Twenty-sixth local people's governments at or above the county level shall strengthen supervision and management, reduce the burden of students' homework and off-campus training in compulsory education, smooth the communication channels between schools and families, and promote the mutual cooperation between school education and family education.
Twenty-seventh local people's governments at or above the county level and relevant departments shall organize the establishment of professional teams for family education guidance services, strengthen the training of professionals, and encourage social workers and volunteers to participate in family education guidance services.
Twenty-eighth local people's governments at or above the county level may, according to local actual conditions and needs, determine family education guidance institutions through various channels and ways. Family education guidance institutions provide guidance to community parent schools, parent schools and other family education guidance service places within their jurisdiction, and at the same time carry out family education research, service personnel construction and training, and public service product research and development.
Twenty-ninth family education guidance institutions should provide timely services to families in need. For families whose parents or other guardians have some difficulties in fulfilling their family education responsibilities, the family education guidance institution shall cooperate with relevant departments to provide targeted services according to specific circumstances.
Article 30 The people's governments at the city, county and township level divided into districts shall, in light of local conditions, take measures to set up files and set up cards for the families of left-behind minors and minors in distress, provide care services such as life assistance and entrepreneurship and employment support, and create conditions for parents or other guardians of left-behind minors and minors in distress to carry out family education. Education administrative departments and women's federations should take targeted measures to provide services for parents or other guardians of left-behind minors and minors in distress to implement family education, guide them to actively pay attention to the physical and mental health of minors, and strengthen family care.
Thirty-first family education guidance institutions to carry out family education guidance services, and shall not hold or disguised for-profit education and training.
Thirty-second marriage registration agencies and adoption registration agencies shall publicize family education knowledge, provide family education guidance and broadcast publicity and education films to the parties involved in marriage registration and adoption registration through on-site consultation and guidance.
Article 33 Child welfare institutions and institutions for the assistance and protection of minors shall provide family education guidance to foster families arranged by institutions and parents or other guardians of minors receiving assistance and protection.
Article 34 When trying divorce cases, the people's court shall give family education and guidance to both husband and wife with minor children.
Article 35 The Women's Federation shall give full play to the unique role of women in carrying forward the family virtues of the Chinese nation and establishing a good family style, publicize and popularize family education knowledge, organize and carry out family education practice activities through various channels such as family education guidance institutions, community parent schools and civilized family construction, and provide family education guidance services.
Thirty-sixth natural persons, legal persons and unincorporated organizations may establish non-profit family education service institutions according to law. The local people's governments at or above the county level and their relevant departments can take government subsidies, incentives, purchase services and other support measures to cultivate family education service institutions. Education, civil affairs, health, market supervision and management and other relevant departments shall, within the scope of their respective duties, guide and supervise family education service institutions and employees according to law.
Thirty-seventh state organs, enterprises and institutions, mass organizations and social organizations should incorporate the construction of family style into the construction of unit culture and support employees to participate in related family education service activities. Civilized cities, civilized villages and towns, civilized units, civilized communities, civilized campuses and civilized families should take family education as an important content.
Chapter IV Social Coordination
Article 38 Residents' committees and villagers' committees may rely on public service facilities in urban and rural communities to set up family education guidance service places such as community parents' schools, cooperate with family education guidance institutions to organize family education knowledge publicity for residents and villagers, and provide family education guidance services for parents or other guardians of minors.
Thirty-ninth primary and secondary schools and kindergartens should incorporate family education guidance services into their work plans as the content of teachers' professional training.
Fortieth primary and secondary schools and kindergartens can regularly organize public welfare family education guidance services and practical activities by establishing parent schools, and timely contact and urge parents or other guardians of minors to participate.
Forty-first primary and secondary schools and kindergartens shall, according to the needs of parents, invite relevant personnel to teach family education concepts, knowledge and methods, organize family education guidance services and practical activities, and promote family and school education.
Forty-second conditional primary and secondary schools and kindergartens shall, under the guidance of the administrative department of education, provide support for the family education guidance service site to carry out public welfare family education guidance service activities.
Article 43 If primary and secondary schools find minor students seriously violating school rules and disciplines, they shall promptly stop and punish them, inform their parents or other guardians, and provide targeted family education guidance services for their parents or other guardians; If underage students are found to have bad behavior or serious bad behavior, they shall be dealt with in accordance with relevant laws and regulations.
Forty-fourth infant care service institutions and early education service institutions shall provide scientific parenting guidance and other family education guidance services for parents or other guardians of minors.
Forty-fifth medical and health institutions should carry out publicity and guidance on scientific parenting knowledge and early development of infants and young children when providing services such as pre-marital health care, maternal health care, child health care and vaccination.
Article 46 Libraries, museums, cultural centers, memorial halls, art galleries, science and technology museums, stadiums, youth palaces, children's activity centers and other public cultural service institutions and patriotic education bases shall regularly carry out publicity, family education guidance services and practical activities for public welfare every year, and develop family education public cultural service products. News media such as radio, television, newspapers and the Internet should publicize correct family education knowledge, spread scientific family education concepts and methods, and create a good social atmosphere that attaches importance to family education.
Forty-seventh family education service institutions should strengthen self-discipline management, formulate family education service standards, organize training for employees, and improve the professional quality and ability of employees.
Chapter V Legal Liability
Article 48 If the residents' committee, villagers' committee, women's federation, the unit where parents or other guardians of minors work, primary and secondary schools, kindergartens and other units in close contact with minors find that parents or other guardians refuse or slowly perform their duties of family education, or illegally hinder other guardians from carrying out family education, they shall criticize and educate them, persuade them to stop, and urge them to receive family education guidance when necessary. If the parents or other guardians of minors entrust others to take care of minors according to law, and the relevant units find that the entrusted person fails to perform the duties of family education according to law, the provisions of the preceding paragraph shall apply.
Article 49 If a public security organ, a people's procuratorate or a people's court discovers that a minor has serious bad behavior or criminal behavior, or that his parents or other guardians have improperly carried out family education, thus infringing upon the legitimate rights and interests of the minor, they shall admonish his parents or other guardians according to the circumstances and may order them to receive family education guidance.
Fiftieth government departments and institutions responsible for family education are under any of the following circumstances, and their superior competent departments or competent units shall order them to make corrections within a time limit; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be punished according to law:
(a) do not perform the duties of family education;
(two) interception, misappropriation, misappropriation or false, impersonator family education funds;
(three) other circumstances of abuse of power, dereliction of duty or favoritism.
Article 51 If family education guidance institutions, primary and secondary schools, kindergartens, infant care service institutions and early education service institutions violate the provisions of this Law and fail to perform or improperly perform their duties of family education guidance services, the competent department shall order them to make corrections within a time limit; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be punished according to law.
Fifty-second family education service institutions in any of the following circumstances, the competent department shall order them to make corrections within a time limit; Refuses to correct or if the circumstances are serious, the competent department shall order it to suspend business for rectification, revoke its business license or cancel its registration:
(1) Failing to go through the establishment procedures according to law;
(two) to engage in acts beyond the permitted business scope or to carry out false and misleading propaganda, resulting in adverse consequences;
(3) Violating the lawful rights and interests of minors, their parents or other guardians.
Fifty-third parents or other guardians who commit domestic violence against minors in the process of family education shall be investigated for legal responsibility in accordance with the Law of People's Republic of China (PRC) on the Protection of Minors and the Law of People's Republic of China (PRC) on Domestic Violence.
Article 54 Anyone who violates the provisions of this Law and constitutes a violation of public security administration shall be punished by the public security organ according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter VI Supplementary Provisions
Article 55 This Law shall come into force on June 65438+1 October1day, 2022.
