Article 16 of the Regulations on Road Freight Transportation and Station Management stipulates that operators engaged in freight-related services such as freight forwarders (agents) shall go through the relevant registration formalities at the administrative department for industry and commerce according to law, and hold relevant registration certificates to the road transport management institution established by them for the record.

The business of the "freight department" you mentioned is not very clear. "Comprehensive freight station (field), LTL freight station, container transfer station, logistics center and other business places" that do not belong to warehousing, storage, stowage and other freight businesses, and only engage in freight-related businesses such as freight forwarding (agency), only need to ask the operators to file with the road transport management institution where they are established.

Before the promulgation of the State Council Regulations, the scope and classification of road transport management were more extensive and specific. For example, in the old Shaanxi Provincial Regulations on Road Transport Management, which has expired, "handling" and "transport services" are defined as road transport projects, and the regulations specifically regulate the business behaviors and legal responsibilities of transport information operators, warehousing tally operators, passenger and freight transport agents and intermodal service operators. After the promulgation of the the State Council Regulations, the original definitions of "handling" and "transport service" have been excluded from the scope of road transport, and no specific provisions are made for transport information operators, storage tally operators, passenger and freight transport agents and intermodal service operators. However, in the current Regulations on Road Transportation Management in Shaanxi Province, Chapter III Road Transportation Related Business and Chapter V Legal Liability also stipulate the business requirements and legal liabilities of road freight transport agents.

Article 28 of the current Regulations on Road Transport Management in Shaanxi Province stipulates: "Road freight transport operators shall hand over the accepted freight transport business to freight operators with business qualifications." Article 47 stipulates: "In violation of the provisions of Article 28 of these regulations, if a road cargo transport operator entrusts the cargo transport business it accepts to a carrier without business qualification, the road transport management institution at or above the county level shall confiscate the illegal income and may impose a fine of not less than 500 yuan but not more than 3,000 yuan."

The so-called "road freight forwarder" refers to an independent freight forwarder? Or when engaged in road freight forwarding business, it is called "road freight transport operator" or "road freight transport station (field) operator"? It is not clear in the regulations. In this regard, I suggest you consult the freight management office of the Transportation Management Bureau of Shaanxi Provincial Communications Department and ask them to clearly define "freight forwarding" and make it clear whether the project is an administrative licensing project or an industry filing project.
