Regulations of Hangzhou Municipality on Funeral Management

Chapter I General Provisions Article 1 In order to strengthen funeral management, promote funeral reform, protect and save land resources, and promote the construction of socialist material civilization and spiritual civilization, these Regulations are formulated in accordance with the relevant provisions of the state and the province and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to all units and individuals within the administrative area of Hangzhou (including counties and cities under its jurisdiction). Article 3 Funeral management should vigorously advocate cremation, reform burial, get rid of feudal superstitions, change customs, and advocate civilized and thrifty funeral management. Article 4 People's governments at all levels shall earnestly strengthen their leadership over funeral management, mobilize and organize all social forces, and promote funeral reform. Fifth civil affairs departments at all levels are the administrative departments in charge of funeral management, and the municipal and county (city) funeral management institutions are specifically responsible for funeral management under the leadership of the civil affairs departments at the same level. Its main responsibilities are:

(a) to publicize and implement the regulations and policies of the national funeral reform;

(two) to formulate plans and measures for funeral reform;

(three) the leadership and management of funeral homes (including crematoriums, the same below), cemeteries and other funeral service units;

(four) in conjunction with the relevant departments to stop and deal with violations of funeral regulations.

Industrial and commercial administration, health, planning, land management, public security, city appearance and sanitation, urban construction and other departments. All levels shall, according to their respective responsibilities, assist the civil affairs departments to do a good job in funeral management. Article 6 State organs, public organizations, armed forces, enterprises and institutions, and urban and rural grass-roots organizations shall publicize and educate the personnel in their own units or areas under their jurisdiction to ensure that the personnel in their own units or areas under their jurisdiction abide by the relevant provisions on funeral management. Seventh people's governments at all levels should include the construction of funeral facilities (including funeral homes, crematoriums, cemeteries, etc.) in the planning. ) into the local economic and social development plan, and arrange land and funds to meet the needs of funeral reform. Chapter II Management of Cremation Article 8 Municipalities and counties (cities) shall establish funeral parlours and actively promote cremation. Where there is a funeral home or the area adjacent to the funeral home, it should be designated as a cremation area (hereinafter referred to as the cremation area).

All urban areas in Hangzhou are designated as cremation areas. The specific scope of the county (city) cremation area is delineated by the county (city) people's government according to the principles of population density, traffic conditions and cremation conditions, and reported to the Municipal Civil Affairs Bureau for the record.

Areas that are designated as cremation areas and have not yet established funeral homes should actively build funeral homes. Before the funeral home was established, the cremation task was temporarily undertaken by the neighboring funeral home. Article 9 Cremation shall be carried out under any of the following circumstances (except as otherwise provided by these Regulations):

(a) the death of a resident in the cremation area;

(two) the permanent residents of the cremation area died in other places;

(three) the death of state cadres, workers and people who enjoy regular and long-term relief in non-cremation areas;

(4) Aliens who died in the cremation area. Article 10 After the death of a person who should be cremated, the funeral home or the unit where the deceased belongs shall promptly notify the funeral home to pick up the body and go through the cremation procedures. Infectious or rotting corpses should be tightly wrapped and cremated by funeral homes within 24 hours. Eleventh in the hospital (including the hospital, the same below), the hospital promptly informed the funeral home to pick up the body; Without the approval of the funeral management institution, the hospital shall not transport the body of the deceased out of the hospital or acquiesce in the funeral owner to transport the body of the deceased out of the hospital. If the undertaker transports the remains without authorization, the hospital shall report to the funeral management institution in time.

Unknown or ownerless body, the public security department shall notify the funeral home to pick up the body. Twelfth for cremation procedures, the following documents are required:

(a) the death of urban residents, with the death notice issued by the hospital or the certificate issued by the residents' committee;

(two) the death of rural villagers, with the death notice issued by the hospital or the certificate issued by the villagers' committee;

(three) the death of foreign personnel, with the death notice issued by the hospital or the certificate issued by the unit;

(four) abnormal death and nameless bodies, with the certificate issued by the public security department at the place of death or the death notice issued by the hospital;

(5) The death of overseas Chinese, compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and foreigners shall be based on a written application from the family of the deceased or a certificate issued by the embassy or consulate of the host country. Thirteenth bodies moved to the funeral home need to be frozen, generally not more than 10 days; If the storage period needs to be extended for some reason, it shall not exceed 30 days. Special circumstances may be appropriately extended with the approval of the funeral management institution. Fourteenth dead bodies in different places should be cremated on the spot. Where the mourner or the unit where the deceased belongs needs to transport the body back to the place where the permanent residence is located for cremation, it shall be transported by the funeral home special vehicle with the approval of the funeral management institution at or above the county level where the permanent residence of the deceased is located. Fifteenth overseas Chinese, compatriots from Hong Kong, Macao and Taiwan, foreign Chinese and foreigners who die during their stay in Hangzhou shall be cremated on the spot. If their relatives request that the bodies be transported back to their original places, the funeral parlour shall provide convenience in accordance with the relevant provisions of the state, except for the bodies of infectious diseases, rotting bodies and bodies that cannot be preserved. Sixteenth corpse transportation fees, corpse storage fees and cremation fees are charged according to the standards approved by the price department.

Cities and towns to enjoy the national regular pension martyrs and long-term relief objects die, with valid documents or certificates issued by the township (town) people's government, neighborhood offices, body transport fees, cremation fees are free; Rural martyr's family member, disabled soldiers, old demobilized soldiers (refers to 1954, 10, 3 1 recently enlisted) died, and the cremation fee can be reduced or exempted with valid certificates and proof of living difficulties issued by the township people's government.

The transportation fee and cremation fee for the nameless and unowned remains are free.
