Regulations of Dezhou Municipality on Pension Services

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly, the Regulations of Shandong Province on the Protection of the Rights and Interests of the Elderly and other laws and regulations, combined with the actual situation of this Municipality, in order to actively respond to the aging population, improve the old-age service system, standardize the old-age service and promote the healthy development of the old-age service. Article 2 These Regulations shall apply to the old-age service and its supervision and management within the administrative area of this Municipality.

The term "aged care service" as mentioned in these Regulations refers to the services provided by the government and society for the elderly, such as life care, domestic service, medical care, rehabilitation care, spiritual comfort, leisure and entertainment, psychological consultation, emergency assistance and hospice care, based on the maintenance obligations of family members. Article 3 Old-age care services should adapt to the level of economic and social development in this region, adhere to the requirements of people-oriented and building * *, adhere to the principles of government-led, social participation, market operation and overall development, ensure basic and moderate universal benefits, give priority to the elderly and disabled elderly, and promote the construction of a multi-level old-age care service system based on home, supported by communities, supplemented by institutions and combined with medical care. Article 4 The people's governments of cities and counties (cities, districts) shall incorporate the work of providing for the aged into the national economic and social development plan of their respective regions, and formulate special plans and annual plans for providing for the aged.

The people's governments of cities and counties (cities, districts) shall incorporate the funds for aged care services into the fiscal budget at the same level, establish a fund guarantee mechanism that is suitable for the needs of aged care services, and improve the social security system related to aged care services.

The people's governments of cities and counties (cities, districts) shall establish a coordination mechanism for aged care services, regularly analyze the development of aged care services, and coordinate and solve the difficulties and problems in the development of aged care services.

Township people's governments and sub-district offices are responsible for the old-age services within their respective jurisdictions. Article 5 The civil affairs departments of cities and counties (cities, districts) shall be responsible for the promotion, supervision, guidance and supervision and management of pension services within their respective administrative areas.

The health department is responsible for promoting the construction of the health service system for the elderly and the combination of medical care and nursing.

Departments of development and reform, education and sports, industry and informatization, public security, finance, human resources and social security, natural resources, ecological environment, housing and urban-rural construction, transportation, agriculture and rural areas, culture and tourism, emergency response, auditing, market supervision, medical insurance, local financial supervision, big data, taxation, etc. shall, according to their respective responsibilities, do a good job in providing aged care services. Article 6 Citizens, legal persons and other organizations are encouraged to participate in or support pension services in various forms.

Trade unions, youth league committees, women's federations, disabled persons' federations, the Red Cross and other people's organizations and social organizations such as pension service industry associations, elderly organizations, charitable organizations and voluntary service organizations participate in pension services according to their duties or articles of association.

Residents' committees and villagers' committees should give full play to the role and advantages of grassroots mass autonomous organizations and help provide services for the elderly. Article 7 The people's governments of cities and counties (cities, districts) shall establish and improve the system for assessing the ability of the elderly and the demand for aged care services for the elderly, and scientifically determine the demand type and nursing level of aged care services for the elderly as the basis for the elderly to enjoy relevant subsidies and accept different types of aged care services. Article 8 The people's governments of cities and counties (cities, districts) shall establish an information sharing mechanism for aged care services, rely on the unified exchange platform of government information resources in the whole city, and promote the docking of aged care service information with information resources such as household registration, medical care, social insurance and social assistance, so as to realize cross-departmental and cross-regional cooperation and information sharing.

The civil affairs departments of cities and counties (cities, districts) shall guide the township people's governments and sub-district offices to collect and input data such as the basic information of the elderly, pension service facilities and pension service institutions in the region, and disclose relevant resource information to the public, accept social inquiries, realize the docking of supply and demand of pension services, and provide efficient and convenient socialized pension services for the elderly. Article 9 The people's governments of cities and counties (cities, districts) and their relevant departments, news media and all walks of life should practice socialist core values, strengthen publicity and education for the elderly, carry forward traditional virtues, and create a social environment of respecting, filial piety and helping the elderly. Units and individuals that have made outstanding contributions to the aged care service shall be commended and rewarded in accordance with the relevant provisions of the state and the province. Chapter II Planning and Construction of Old-age Service Facilities Article 10 The people's governments of cities and counties (cities, districts) shall incorporate the land for the construction of old-age service facilities into the national spatial planning, and plan and set up old-age service facilities by districts and levels according to the standard that the per capita land is not less than 0.2 square meters. When making the annual land use plan, give priority to the protection of land for the aged service facilities.

The civil affairs departments of cities and counties (cities, districts) shall, jointly with the departments of development and reform, natural resources, housing, urban and rural construction, health and other departments, formulate plans for the facilities for the aged care according to the local economic and social development level, the aging population and its development trend and the demand for the aged care service, and report them to the people's government at the same level for approval before implementation.

Township people's governments shall, when organizing the preparation of township land and space planning, implement specific arrangements such as land layout and construction requirements of rural old-age service facilities according to local actual conditions, and guide rural communities and central villages to plan and build old-age service facilities according to local old-age service needs.
