The number of paid days per month stipulated in the Notice of the Ministry of Labor and Social Security [2008] No.3 on the Average Working Hours and Wage Conversion of Employees throughout the Year = (365 days-104 days) ÷ 65438+February = 2 1.75 days, and the calculation of this time is to exclude legal holidays (annual working days: 365 days)
I suggest you read the Notice on the Annual Average Working Hours and Wage Conversion of Employees, and then refer to the Labor Law. You can search online.
Chapter IV Article 36 of the Labor Law
The state practices a working-hour system in which workers work no more than 8 hours a day and 44 hours a week on average.
In other words, you can work at least 174 hours a month.
Secondly, I would like to remind you that Article 40 of Chapter 4 of the Labor Law stipulates that
During the following festivals, the employer shall arrange employees' vacations according to law:
(1) New Year's Day;
(2) Spring Festival;
(3) International Labor Day;
(4) National Day;
(five) other holidays as prescribed by laws and regulations.
That is to say, arranging overtime at this time is overtime time, and overtime time is also stipulated in Article 41:
Due to the needs of production and operation, the employer may extend the working hours after consultation with the trade unions and workers, generally not exceeding one hour per day; If it is necessary to extend the working hours for special reasons, the extended working hours shall not exceed three hours a day and thirty-six hours a month under the condition of ensuring the health of the workers.
There are only a few exceptions, namely:
Article 42
Under any of the following circumstances, the extension of working hours shall not be restricted by the provisions of Article 41 of this Law:
(a) the occurrence of natural disasters, accidents or other reasons, threatening the life and health of employees and property safety, and requiring emergency treatment;
(two) production equipment, transportation lines, public facilities failure, affecting production and public interests, must be repaired in time;
(3) Other circumstances stipulated by laws and administrative regulations.
One more thing: in fact, not many people can really implement this regulation. Civil servants and state-owned enterprises can do it, but some private enterprises abroad and at home give you eight hours' work. If you can't finish it, it's your own business. It is your business to go home and work overtime. So ... . . Hehe, think it out for yourself.
