Can the company only be authorized as a legal person?

Legal analysis: The authorized client of a company may be a legal person, but it is not limited to a legal person.

Refers to the person who authorizes others to act as an agent, that is, the principal, and the other party is the principal or agent.

The entrustment contract is established when the two parties reach an agreement, and the delivery of the goods or the actual performance of the parties is not a necessary condition for the establishment of the contract. Therefore, the entrustment contract is a kind of commitment contract. The entrustment contract is optional, and the form of the contract is decided by both parties. Entrustment contracts, whether paid or not, are both bilateral contracts. In the gratuitous entrustment contract, although the principal has no obligation to pay remuneration, he still has other obligations such as paying fees, accepting the results of entrusted affairs, and compensating for losses. These obligations correspond to those of the trustee. Therefore, the gratuitous entrustment contract is also a bilateral contract.

Legal basis: Article 48 of the Civil Procedure Law of People's Republic of China (PRC), a legal person shall file a lawsuit by its legal representative, and other organizations shall file a lawsuit by its principal responsible person.

The legal representative has the right to directly represent his unit to the people's court to sue and respond, and his litigation behavior is the litigation behavior of his unit (or legal person), which has legal effect directly on his unit (or legal person).

There is a certain difference between a legal representative and a legal representative. The representative's behavior is not the principal's own behavior, but has direct legal effect on the principal, while the legal representative's behavior is the behavior of enterprises and institutions.

The legal representative of an enterprise shall exercise its functions and powers and perform its obligations within the scope of functions and powers stipulated in the laws, regulations and articles of association of the enterprise, participate in civil activities on behalf of the enterprise as a legal person, be fully responsible for the production, operation and management of the enterprise, and accept the supervision of all members of the enterprise and relevant authorities.
